REQUEST: CONSIDERATION OF AN EXCEPTION TO MUNICIPAL CODE SECTION
9.58.010 (CONSUMPTION OF ALCOHOLIC BEVERAGES ON PUBLIC
PROPERTY) AND 25.64.040 (USES PERMITTED SUBJECT TO
TEMPORARY USE PERMIT) FOR VARIOUS PRIVATE EVENTS AT THE
PALM SPRINGS ART MUSEUM -PALM DESERT (THE GALEN).

Recommendation
By Minute Motion,
1. Approve an exception to Municipal Code Section 9.58.010 (Consumption of
Alcoholic Beverages on Public Property) for the noted private events at the Palm
Springs Art Museum -Palm Desert (The Galen), located at 72-567 Highway 111.
2. Authorize the City Manager to execute the Temporary Use Permits associated
with these events.
3. Approve an exception to Municipal Code Section 25.64.040 (Uses Permitted
Subject to Temporary Use Permit) permitting the Palm Springs Art Museum -Palm
Desert (The Galen), located at 72-567 Highway 111, to have more than ten
special events, requiring a temporary use permit, for Calendar Year 2012.
Background
Palm Springs Art Museum (PSAM) officials indicated that they wish to hold various private and
public events at their Palm Desert satellite facility, also known as The Galen (72-567 Highway 111),
associated with their upcoming grand opening in March 2012.
Some of these events will include the consumption of alcoholic beverages, both inside the facility
and within the Sculpture Gardens. Staff is collectively bringing forward those events that are
currently known (noted below) for an exception to Municipal Code Section 9.58.010 (Consumption of
Alcoholic Beverages on Public Property). Please note that their likely will be additional events in
Calendar Year 2012 (currently unscheduled) that will require a similar municipal code exception.
Staff will also collectively bring these forward to the City Council's consideration when they are
known.
A Temporary Use Permit is still required for all these special events and will be submitted to the
Planning Department and circulated to the appropriate City Departments for comments. However,
the Museum also seeks an exception to Municipal Code Section 25.64.040 that limits a special
event from occurring greater than a period of ten days per calendar year. The Museum will likely
exceed this limit with their planned private and public events at The Galen in 2012.
Staff recommends approval of the requested exceptions to Municipal Code Sections 9.58.010
(Consumption of Alcoholic Beverages on Public Property) and Municipal Code Section 25.64.040
(Uses permitted subject to temporary use permit).
