HomeMy WebLinkAboutTUP 12-37 - Palm Desert Chamber - Valleywide Garage SaleCITY OF PALM DESERT DEPARTMENT OF COMMUNITY DEVELOPMENT STAFF REPORT REQUEST: CONSIDERATION OF A REQUEST TO APPLY FOR A TEMPORARY USE PERMIT TO ALLOW THE PALM DESERT CHAMBER OF COMMERCE TO HOLD A REGULARLY OCCURRING VALLEY -WIDE, ONE -DAY GARAGE SALE TWO TIMES PER YEAR LOCATED AT 72-559 HIGHWAY 111 (ENTRADA DEL PASEO) SUBMITTED BY: Missy Wightman Assistant Planner APPLICANT: Palm Desert Chamber of Commerce 72-559 Highway 111 Palm Desert, CA 92260 CASE NO: TUP 12-37 DATE: February 9, 2012 CONTENTS: Site Plan provided by applicant Recommendation That the City Council allow the Palm Desert Chamber of Commerce to apply for a Temporary Use Permit to hold a regularly occurring valley -wide, one -day garage sale two times per year at Entrada del Paseo, and authorize the City Manager to sign as authorized representative. Background The Palm Desert Chamber of Commerce is seeking approval to hold a garage sale at the Entrada del Paseo parking lot on March 17, 2012 and one in November 2012. They would like to hold this as a regularly occurring event once in March and once in November each year. Under Chapter 25.64.030 of the Palm Desert Municipal Code, permitted temporary uses require an application made by the property owner; the City of Palm Desert, as property owner, must authorize an application for these events. The events would be held for Coachella Valley residents to have a safe, approved place to sell their used household goods. Many communities and HOA's do not allow garage sales within their development. The Chamber is proposing this outreach to provide a valuable, needed community service. No vendors, professionals or businesses will be Staff Report Chamber Sale Temporary Use Permit Page 2 of 2 February 9, 2012 allowed to participate in this event and a maximum of 100 people will sell their household goods in the garage sale. More people will be present on -site as people walk through and browse the items for sale. The first event will occur on March 17 from 6:00 a.m. to 12:00 p.m., and clean-up will occur from 12:00 p.m. to 2:00 p.m. Each event will follow this schedule. Participants will be unloading, then parking along Painters Path, so the on -site parking spaces can be utilized for wares. This event is a nominal -fee event raising a small amount of money for the Palm Desert Chamber of Commerce as non -dues revenue and covering the cost of the event. A site plan is attached identifying event location. The Chamber successfully held the same event last year on November 19. Staff recommends that the City Council grant the applicant's request, and that the following conditions be imposed on the Temporary Use Permit: • Applicant must set up a voluntary collection site where residents can place unsold items at the end of the day for delivery to a local charity thrift store rather than throwing unsold items in the trash • Applicant must inform the owners or owners' representatives of Cuistot, La Spiga, and the Palm Springs Art Museum of their plans at least one week in advance and provide a site plan identifying event location so other on -site business owners can make appropriate parking arrangements the day of the event Submitted by: Missy AgKtman, Assistant Planner Approval: Z Jq* M.
