REQUEST: CONSIDERATION OF VARIOUS REQUESTS BY THE PALM
SPRINGS ART MUSEUM -PALM DESERT (THE GALEN)
RELATED TO THE GRAND OPENING OF THE MUSEUM.

Recommendation
By Minute Motion,
1. Approve a request by the Palm Springs Art Museum -Palm Desert to
install removable lockable bollards at each end of Carriage Lane located
on the east side of the Museum and at the entrances into the Sculpture
Garden, including any walkway wide enough to accommodate vehicular
access, conditional to final acceptance of the plans and specifications by
the City of Palm Desert and Fire Marshall's Office.
2. Approve a request by the Palm Springs Art Museum -Palm Desert to
remove and cap seven light bollards, at no additional cost to the City of
Palm Desert, which they indicate will detract from the aesthetics of
adjacent sculptures.
3. Approve a request by the Palm Springs Art Museum -Palm Desert to
install a gravel style moat around the Donald Judd sculpture, at no
additional cost to the City of Palm Desert and conditional to final
acceptance of the plans and specifications by the City.
Background
The Palm Springs Art Museum -Palm Desert (The Galen) officials indicated that they are
tentatively planning for a February/March 2012 opening of The Galen. The Museum is
planning on phasing in the installation of the proposed sculptures at the Sculpture Garden
(Eric Johnson Memorial Garden). They indicate such action allows them to have some
sculptures installed by The Galen's opening. Please note that per the lease agreement, the
Museum is required to install ten or less sculptures in the first year of its actual operation.

The initial phase would include up to four pieces on the Museum Grounds and two pieces
immediately east of the Museum. The second phase would by the installation of the
remaining balance of sculptures within the Sculpture Garden (see attached exhibit).
Museum officials requested the City's approval of the various tasks outlined below, which
they indicate are necessary for them to meet their opening schedule:
1. As recommended by the insurance underwriter's security surveyor, The Galen
requests permission to install removable and lockable bollards at each end of
Carriage Lane located east of the Museum, including any walkway into the
Sculpture Garden wide enough to accommodate vehicular access.
Such a measure should mitigate any threat of vehicular access for the purpose of
sculpture theft. Staff recommends such action contingent upon final approval of the
plans and specifications by the City and Fire Marshall's Office. Please note that the
regular and handicap parking stalls adjacent to the Sculpture Garden will still have
vehicular access.
2. Museum officials request permission to remove and cap seven light bollards,
located on the east side of Carriage Lane, which they believe detract from the
aesthetic experience of viewing the adjacent Judd and Shami sculptures.
Staff initially denied this request, as the bollards act as visual barriers allowing
drivers to distinguish between the street and existing rolling curb. However,
contingent upon the closing of the fire lane to non -emergency vehicular access,
staff does not have any issue with this request.
3. One of The Galen's proposed sculptures by Donald Judd requires the concrete
around the sculpture to be removed and replaced with gravel to aid in the
prevention of skateboarders utilizing the sculpture. Staff recommends such action,
contingent upon final approval of the plans and specification by the City.
Museum officials indicated that the base construction required for this art piece,
along with the one for the adjacent Shami sculpture, would be funded by them and
they will not seek reimbursement from the City for such work The cost associated
with transporting and installing the two pieces would be paid for per the terms of the
lease agreement. The City is required to reimburse the Museum up to $10,000 for
the transportation, installation, and removal of each sculpture. Museum staff will
work closely with the City's Public Art Coordinator to ensure costs are in -line with
industry standards.
Please note that the current lease agreement requires that the City shall be
responsible for accomplishing all tasks and paying all costs associated with the
remaining sculptures located within the Sculpture and Multi -Sensory Gardens. Such
responsibilities includes without limitation, the installation of sculpture
bases/foundations, site lighting, cleaning, and ongoing maintenance. Museum
officials did initially request to manage the bases/foundation and lighting system
project; however, they subsequently withdrew this request and will work closely with
City staff to provide any necessary guidance.

Fiscal Analysis
Museum officials indicated that they are not seeking any additional costs, outside of what
is already required under the existing lease agreement, associated with the
aforementioned requests. The Museum will pay for the cost of installing bases on two
sculptures, the concrete cutting costs associated with the Judd sculpture, and
removal/installation of bollards as indicated. As noted, the City is still responsible for the
costs associated with the construction of the remaining sculptures' bases/foundation and
site lighting system. Such costs are unknown at this time, pending the final results of the
bidding process.

Re: Palm Springs Art Museum in Palm Desert
Dear Mr. Arayan,
We are pleased with the Public Art Commission's approval of our sculpture program for the Eric
Johnson Garden adjacent to the new Palm Springs Art Museum in Palm Desert. We are also
looking forward to the City Council's review of our sculpture program at their 1/12/12 meeting.
Subject to the Council's approval of the sculpture program, we would like to request that the
Council also consider the following outstanding issues which relate to more detailed
requirements for the sculpture program.
We intend to install the sculpture in two phases. This will permit us to have some sculpture
installed by the Museum opening next month. The first phase would include up to four pieces on
the Museum grounds and the two pieces immediate east of the Museum. These pieces are
identified in blue on the attached Exhibit A. The second phase would be the installation of the
balance of sculptures within the Eric Johnson garden and are identified In pink on the attached
Exhibit A.
Our insurance underwriter's security surveyor has toured the site and reviewed the sculpture
program. Their recommendations for risk management in the sculpture garden are outlined in
the attached Exhibit B. In order for the Museum to comply with the insurance requirements for
the installations within the Sculpture Garden, as well as any sculpture placed on the east side of
the Museum, we are requesting that the City approve the following actions:
1. The City allow for the installation of removable bollards to be placed at each end
of the fire lane located on the east side of the Museum and also at the entrances into the
Garden at any walkway wide enough to accommodate vehicular access.
We have discussed the installation of the bollards with the Fire Marshall's office
and this is acceptable subject to the final review of the bollard specifications and
compliance with their emergency access requirements.
2. The insurance underwriter is also requiring the installation of a "rock moat'
around the Donald Judd concrete sculpture in order to deter skateboard
vandalism of the sculpture. This is depicted on the attached Exhibit C.
The security cameras necessary to monitor the Phase One installation are being installed
directly on the Museum building.

3. The insurance requirements for the Phase Two sculptures include the installation
of security cameras within the Garden capable of monitoring all of the sculpture installations.
These cameras will be continuously monitored by the Museum staff, both in Palm Desert and
Palm Springs.
The logistics and requirements for the sculpture installations within the Garden are unique in
that the Museum will be responsible for the design of the security system and it's monitoring.
The Museum is also responsible for the design of the sculpture installations to prevent theft and
also the lighting design. Because of these special conditions, we are requesting that the City
allow the Museum to manage the installation of all of these improvements within the Sculpture
Garden subject to the terms and conditions normally required by the City for public work, as well
as the terms of the lease agreement between the City and the Museum.
Previously we had met with Staff and requested that the City allow us to remove the light
bollards on the east side of the fire lane, (see Exhibit C). We strongly believe the bollards
detract from the aesthetic experience of viewing the adjacent sculptures, particularly the Donald
Judd sculpture. John Wohlmuth was unable to approve our request because he stated that the
bollards acted as a visual barrier allowing drivers to distinguish between the street and the
existing curb. We had made this request prior to receiving the site requirements from our
insurance company. If the City allows us to restrict the fire lane to emergency vehicles, drivers
would not have access to the fire lane. If the City approves our request to close off the fire lane
to all non -emergency vehicles we are also requesting that the Council allow the removal of the
light bollards. The attached Exhibits D1 and D2 illustrate the differences between viewing the
sculptures with and without the light bollards.

Hello
The following are the Recommendations made by Underwriters' security surveyor, which are to be
complied with for the insurance of the sculpture to be located at the Palm Desert site. Please review and
then advise of any questions or comments.
1. It is understood that there will be 11 to 12 sculptures in the Sculpture Garden site to be
installed within the next several months. Each of these sculptures to be hard mounted to a
concrete pad and undergo treatment with graffiti resistant coatings.
2. Assured will place large sodium halide street lamps within the park as well as a CCTV system
with night vision capabilities
3. Assured will arrange with City of Palm Desert for a private security detail to conduct a
walkthrough of the park eight times daily. The Assured will utilize the security guards during
non -business hours from approximately 8:00 P.M. to 7:00 A.M.
4. Visitors to the Sculpture Garden will be free to traverse the Sculpture Garden from the street
level or through the courtyard of the building. All movements into and out of the building as
well as the sculpture garden will be captured on CCTV
5. As respects specific sculptures anticipated to be installed in the Sculpture Garden:
a. Donald Judd, Untitled — a large concrete rectangle with interior walls. The most valuable
in the first groups of sculptures to be installed in the Sculpture Garden, due to its
composition, the Assured to take precautions to keep skateboarders from utilizing the
piece, by installing a gravel -style moat around the sculpture to prevent skateboarders
from gaining benefit in using the sculpture for stunts.
G. Pathways and mid -level walls of the sculpture garden to be fortified with anti -skateboarding
plates which prevent the skateboard from "grinding" along a corner as the metal plates will
cause them to fall. These plate to be installed in all necessary areas and upon inspection
surveyor has found most areas already been so covered
7. As respects Mark DiSUver0 sculpture, "OI'One Tooth", this massive sculpture to be placed on a
hilltop within the Sculpture Garden and to be surveilled by CCTV
8. Remaining sculptures in Sculpture Garden to be individually mounted to a concrete pad and
surveilled by the ASSUred's closed circuit system
9. Assured has designed Sculpture Garden to allow for the less valuable pieces to be installed on
exterior area of Scupture Garden while the more valuable to be installed within the interior of
the Garden
10. Assured to fortify the Sculpture Garden in order to prevent a vehicle from entering the Garden,
making the theft of a heavy object possible
1.1. Assured shall install removable bollards along all of the walkways wide enough to accommodate
a vehicle. The Assured is required to remain compliant with the American's Disability Act, and
the installation of the bollards must be fairly precise, requiring a 4-foot space between
individual bollards.
12. With the exception of authorized vehicles, the bollards will be locked in place, preventing
vehicles from moving throughout the garden.
13. The Sculpture Garden will be subject to CCTV surveillance and regular hourly patrols during
evening hours.
14. In interest of providing a better line of sight, surveyor suggests that the Assured remove the
underbrush from the large palms to provide for a canopy and an open line of sight between
sculptures.
15. Assured will install a multi -camera CCTV system. At time of Surveyor's inspection of the
Sculpture Garden, the exact specifications of the system had not yet been received; however,
the Assured confirms that the building plans include a large outdoor camera installation in the
center of the garden with a long telephone pole style mount providing an overall view of the
Sculpture Garden, specifically each installed sculpture
16. CCTV cameras will be placed along the exterior of the building to provide for surveillance of the
outdoor sculpture along the front as well as the perimeter of the building
17. Assured advises that they will have internet capability allowing them to view the camera system
remotely, both at the Museum and at the homes of authorized personnel
18. Assured to maintain a library of video activity for a minimum of 15 clays

Attached is the revised exhibit as we discussed.
Also to further elaborate, the Museum would like to install the Judd and the Shemi sculptures in Phase One. The
Museum would pay the cost of cutting the concrete for the Judd and the installation of any new bases to receive these
two sculptures. We don't anticipate any lighting to be installed for these pieces until the new lighting is installed
throughout the Garden. The cost associated with transporting and installing these two pieces would be paid for in a
manner consistent with the lease agreement between the City and the Museum.
