HomeMy WebLinkAboutPostponement of New Appointments to the Citizens Adversary Committee for PA4 and Housing CommissionCITY OF PALM DESERT STAFF REPORT REQUEST: APPROVE THE POSTPONEMENT OF NEW APPOINTMENTS TO THE CITIZENS' ADVISORY COMMITTEE FOR PROJECT AREA NO. 4 AND THE HOUSING COMMISSION UNTIL FURTHER INFORMATION IS AVAILABLE REGARDING THE DISSOLUTION OF THE PALM DESERT REDEVELOPEMNT AGENCY SUBMITTED BY: Martin Alvarez, Redevelopment Manager DATE: January 12, 2012 CONTENTS: Project Area 4 Boundary Map Recommendation By Minute Motion, approve the postponement of new appointments to the Citizen's Advisory Committee for Project Area No. 4 and the Housing Commission until additional information is available regarding the dissolution of the Palm Desert Redevelopment Agency. Background Project Area No. 4 is one of four Redevelopment Project Areas within the City of Palm Desert. Project Area No. 4 was established in 1993, and consists of properties bounded by Country Club Drive, Washington Street, Fred Waring Drive, and El Dorado (see map attached). As part of the formation of the Project Area No. 4, the Agency Board established a Citizens' Advisory Committee, which provides input to the Redevelopment Agency Board on matters directly related to redevelopment of commercial, industrial, affordable housing, and public uses in the Project Area. The Committee membership is reserved for residents within the Project Area boundary. The Citizens' Advisory Committee for Project Area No. 4 has 11 appointed members. Currently there are four vacancies on the committee. On December 29, 2011, California Supreme Court issued a ruling on Assembly Bill 1X 26 and Assembly Bill 1X 27. The two measures intended to eliminate 400 redevelopment agencies in the California. In the ruling, the Supreme Court upheld AB 26 but invalidated AB 27; therefore, the State can eliminate redevelopment agencies. The Citizens Advisory Committee for Project Area No. 4 and Housing Commission are directly linked to the existence of the Redevelopment Agency. If the Redevelopment Agency is dissolved in the future, the Committee's participation may not be required. Staff Report Postponement of the Project Area No. 4 Committee Member Appointments January 12, 2012 Page 2of2 Staff recommends that the City Council postpone the appointment of new members to the Committee until additional information is available regarding the timing and schedule of the wind down period for the Redevelopment Agency. Staff is currently working with our legal team to determine the implications and timing of AB 26. Once staff has additional information, we will return to the City Council with a recommendation.
