Recommendation
By Minute Motion, make appointments to the various open positions on the
City's established Committees and Commissions, following interviews
scheduled for Thursday, January 19, 2012, beginning at 8:00 a.m.
Background
On an annual basis at year's end, the City Council reviews vacancies, current applications,
and term expirations on the City's standing Committees and Commissions. Applicants are
selected for interviews, and resulting recommendations for appointment are provided to
the City Clerk for inclusion on the next available regular City Council Meeting agenda.
Applicant Interviews have been scheduled for Thursday, January 19. Once they are
conducted and City Councilmembers have an opportunity to provide their choices to the
City Clerk for tabulation, an updated report indicating the recommendations for
appointments and reappointments will be distributed for the January 26, 2012, agenda
packets.
Fiscal Analysis
There is no fiscal impact associated with appointments to the City's standing Committees
and Commissions.

PALM DESERT CITY COUNCIL
NOTICE IS HEREBY GIVEN that the Palm Desert City Council will convene
Thursday, January 19, 2012, at 8:30 a.m. in the Council Chamber Conference Room of
the Palm Desert Civic Center, 73-510 Fred Waring Drive, Palm Desert, California 92260,
in order to conduct a Study Session. Said Study Session will be for the purpose of
reviewing applications and interviewing applicants for various vacancies on and
considering reappointments to the City's established Committees and Commissions.
Resulting recommendations for appointment/reappointment will be considered at the
City Council's Regular Meeting of Thursday, January 26, 2012.

1) Architectural Review Commission:
a) Direct staff to prepare the necessary bylaws modification that consolidates the Landscape
Beautification Committee into and increases Membership of the Architectural Review
Commission (ARC) by two persons for a total of nine (9).
b) Reappoint Allan Levin, Ken Stendell, and John Vuksic each for a four-year term (Jan. 1,
2012 - Dec. 31, 2015).
2) Art In Public Places Commission: Reappoint Norma Bussing, Lesley Miller, and Kim Snyder each
to a four-year term (Jan. 1, 2012 - Dec. 15, 2015).
3) Audit. Investment & Finance Committee: Appoint Russell Campbell to the seat formerly held by
Jim Walker (Jan. 1, 2012 - Dec. 31, 2015), and Ron Crisp to the seat formerly held by
Everett Wood (Jan. 1, 2012 - Dec. 31, 2013).
4) Building Board of Appeals & Condemnation: Reappoint Rod Murphy to a four-year term (Jan. 1,

8) Parks & Recreation Commission: Appoint Jeff Ronci for the Desert Recreation District and

Background
In early December, City Councilmembers were provided with a binder of active applications, information
regarding vacancies and December 31, 2011, term expirations on the City's standing Committees and
Commissions. Interviews of selected applicants were scheduled and conducted at a City Council Study
Session held Thursday, January 19, 2012.
Following the Study Session, City Councilmembers provided their selections to the City Clerk and the
tabulation of respective recommendations was performed, as presented above.
Fiscal Analysis
Appointments and reappointments to City Committees and Commissions do not make a fiscal impact on
the City Budget.

I have worked in the insurance industry for over 38 years. To my knowledge, I would be
the only person on the finance committee who could contribute this type of risk
management expertise. With my prior membership on this committee, I believe I would
be able to continue a good working relationship with the city staff.
Having served on the Area 4 Redevelopment Committee, the Audit, Investment
Committee, and the Planning Commission I have a good working knowledge as to what

STATEMENT OF QUALIFICATIONS
As an affordable housing broker and project manager, Ron participated in the planning,
implementation and development of 17 affordable multi -family housing phases in Southern
California between 1998 and 2011.
Ron has been a licensed real estate broker in California for 34 years and has experience in
acquisition, financing, lending, development and construction, providing well-rounded
experience in the complexities of affordable housing development.
He has cultivated and maintains positive relationships with several city and county
redevelopment agencies, municipal staff, elected officials, state and federal financing sources,
lenders and investors.
Ron works to improve the industry by serving on the Brownfield Committee for the California
Redevelopment Association. He has also served as a past president of the Hawthom/Lawndale
Board of Realtors.

Lessee and its guests, subject to any exclusive -use rights granted by Lessor to other persons or
entities. (c) Lessor agrees to restrict vehicular access at both ends of Carriage Lane, with access
available only to Lessor, the fire department, the police department and Lessee as approved by
the Fire Marshall and City Engineer. It is intended that Carriage Lane will be used, except in
limited circumstances, solely for pedestrians.
2.2 Condition; Compliance with Laws. Lessee shall lease the Premises in their "AS -IS"
condition, without representation or warranty, express or implied, and Lessee hereby
acknowledges that in no event shall Lessor be obligated to make any alterations, repairs or
improvements to the Premises, except as otherwise provided herein.
Lessee has made such investigation as it deems necessary with reference to such matters and
assumes all responsibility therefor. In addition, Lessee hereby expressly acknowledges that
Lessee has had full opportunity to inspect the Premises (including, without limitation the
presence/absence of hazardous materials, the condition of fixtures and equipment, and whether
the improvements comply with law). Lessor hereby agrees to make any changes to the Premises
required by existing laws or by amendments to existing laws or by new laws.
2.3 Sculpture Garden, Multi -Sensory Gardens, Plaza, Carriage Lane and Parking
Spaces. Lessee shall be responsible for transportation, installation, and removal of sculptures;
however, Lessor shall reimburse Lessee all reasonable costs in connection with the
transportation, installation, and removal of sculptures not to exceed $10,000 per installation or
removal, including transportation of each sculpture, unless approved by the Lessor. Lessor shall
be responsible for accomplishing all tasks and paying all costs associated with the sculptures
located within the Sculpture Garden and Multi -Sensory Gardens, including without limitation,
the installation of bases and/or foundations for the sculptures, lighting, cleaning and ongoing
maintenance as needed or reasonably requested by Lessee. Lessor shall pay to Lessee the sum of
$2,575.00 as a one-time honorarium for each piece of sculpture placed by Lessee at the Sculpture
Garden or Multi -Sensory Gardens, upon completion of the installation of the sculpture, which
amount shall be increased by $50.00 on the anniversary of the Commencement Date each year
during the term hereof or any extension. There shall be an initial maximum of twenty (20)
honoraria; additional honoraria payments shall be at the discretion of the Lessor. Lessor shall be
responsible for all landscaping, landscape and other maintenance, cleaning and trash removal,
irrigation and other related expenses to maintain the Sculpture Garden, Multi -Sensory Gardens,
Plaza, Carriage Lane and Parking Spaces at no less than their current level of maintenance
quality and to maintain the roads and parking areas surrounding the Premises. Lessor and Lessee
shall cooperate in the selection and approval of sculptures to be placed in the Sculpture Garden,
Plaza or Multi -Sensory Gardens, but the final determination of the selection of sculptures shall
be made by Lessee, provided that no sculpture shall be placed in the Non -Exclusive Use Areas
that is likely to cause substantial controversy in the community. (Lessee may display art and
sculptures selected in its sole discretion in the Museum.) Lessee shall install ten or less
sculptures in the first year of actual operation and five or less sculptures in any succeeding year.
Placement of the sculptures will be determined in cooperation between Lessee and Lessor.
Lessee shall have the right to nominate representatives for one seat on Lessor's City Marketing
_Committee and one seat on Lessor's Art in Public Places Commission during the initial and any
extended term(s) hereof. Appointment of nominees to the commissions shall be at sole
discretion of Lessor's City Council. Inasmuch as copyright(s) for the sculptures to be placed in

valuation engineers making appraisals of all forms of
taxable property in the State of California.

Los Ange es, California. -I commenced work as a junior appraiser
and was classified as an Assistant Chief upon transferring
directly to State of California service. Experiences included
professional valuation work in the metropolitan Los Angeles

a field crew doing property appraisal work in major areas

Chapter 25.70 ARCHITECTURAL COMMISSION GOALS/POLICIES/PROCEDURES
25.70.010 Architectural commission established.
An architectural commission is established in order to accomplish the following:
A. Review commercial, industrial, multifamily projects and single-family dwellings and approve subject to
conditions and/or with changes, or deny the projects;
B. Recognize the interdependence of land values and aesthetics and provide a method by which the city
may implement this interdependence to its benefit;
C. Encourage the development of private and public property in harmony with the desired character of the
city and in conformance with the guidelines provided in this title with due regard for the public and private
interests involved;
D. Foster attainment of those sections of the city's general plan which specifically refer to the preservation
and enhancement of the particular character and unique assets of the city and its harmonious development,
through encouragement of private and public interests to assist in the implementation process;
E. Assure that the public benefits derived from expenditures of public funds for improvement and
beautification of streets and other public structures and spaces shall be protected by the exercise of reasonable
controls over the character and design of buildings and open spaces. (Ord. 326 (part), 1983)
25.70.020 Membership.
The architectural commission shall consist of seven members appointed by the city council who shall all be
voting members. (Ord. 942 Exhibit A § 1, 2000: Ord. 934 § 1, 2000: Ord. 452 § 2 (part), 1986: Ord. 326 (part),

25.70.030 Appointment and term of office. _
The voting members of the architectural commission shall be appointed by the city council. The first voting
members of the commission shall be appointed for the following terms:
A. Three shall serve for a term of four years;
B. Three shall serve for a term of two years; and
C. One shall serve for a term of one year.
Thereafter, the term of office for voting members shall be four years.
Five unexcused absences in any one year (January 1 through December 31) shall constitute an automatic
resignation of any architectural review commission member and the chairman or acting chairman shall declare
the office of such member vacant. The secretary shall immediately thereafter inform the city council. (Ord. 942

25.70.040 Secretary.
The director of environmental services shall serve as the official secretary to the architectural commission.
The records of all proceedings and the basis for all findings shall be available to the city council and to the

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT ESTABLISHING A CITIZEN'S
SUSTAINABILITY COMMITTEE TO GUIDE THE
DEVELOPMENT OF THE ENVIRONMENTAL
SUSTAINABILITY PLAN RECOMMENDED ACTIONS
WHEREAS, the City Council of the City of Palm Desert voted unanimously on
February 11, 2010 to adopt the City of Palm Desert Environmental Sustainability Plan;
and
WHEREAS, the City of Palm Desert has an increasing population that demands
increasing energy needs and vital resources to the Coachella Valley; and
WHEREAS, the City of Palm Desert must direct clear policies and objectives to
maintain and ensure these resources are being conserved and managed effectively; and
WHEREAS, the City of Palm Desert is a leading sustainable city and must
maintain demonstration of high levels of civic leadership on many issues related to
environmental sustainability, including; the Built Environment, Energy Management,
Materials Management, Regional Air Quality, Transportation Resources, and Water
Management; and
WHEREAS, the need has been identified for active direction and oversight in the
implementation of the recommended action items in the Environmental Sustainability
Plan from citizens of Palm Desert with a general knowledge of sustain abil ity; and
WHEREAS, that direction would be best provided by a committee composed of
citizens and City staff who can develop appropriate policies and actions.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert,
California, as follows:
Section 1. An Environmental Sustainability Committee is hereby created as an
advisory body to the City Council, and further, that upon the
�;,�► appointment of nine members of such Committee by the City
council, such Committee shall, with assistance from City staff as
required, generate its by-laws which shall generally follow the stated
purpose of this resolution. Said by-laws shall, among other
provisions, set out specific goals and objectives, terms of office,
chairman selection, meetings, and procedures and shall be subject
to approval by the City Council, as shall be all other formal or
informal action of the Environmental Sustainability Committee.
