Background A. Project Description: The applicant is proposing a facade renovation and tenant improvements to convert an existing vacant building into two separate suites. Approximately 4,380 sq. ft. will be improved as one restaurant suite, and another 2,600 sq. ft. will be improved as one retail suite. The applicant received approval from the Architectural Review Commission for exterior facade enhancements on April 10, 2012. The City Council granted approval of $50,000 of facade enhancement funding for the front of building on May 10, 2012, and $24,762 of funding for the rear facade on May 24, 2012. After receiving an ARC approval, the applicant returned to staff requesting approval of an encroachment into the public right-of-way for an outdoor seating area surrounded by wrought iron railing. Analysis: Public Works, Economic Development, and Planning staff met with the City Manager to discuss the proposed encroachment. Staff at this time is recommending denial to allow time to study this request as part of a larger plan for the entire street. Allowing one applicant with a restaurant use to encroach into the public right-of-way creates a precedent for other restaurant owners. Staff would like to research an outdoor seating plan, determine the appropriate sidewalk width for a pedestrian zone, and whether an encroachment into public right-of-way is appropriate for El Paseo comprehensively. Staff would be looking at various tools available for economic development and at design standards for maintaining and enhancing the pedestrian zone of the street. If an update of the General Plan is undertaken within the next year, the role of outdoor seating on El Paseo would be included in that review; otherwise it can be discussed as a part of the Economic Development Plan that is currently being prepared. The applicant has additionally found a good example of Outdoor Dining Design Guidelines, which is included for review with this report. These guidelines have been used to create a c very successful shopping/dining district in Old Town Alexandria, Virginia.
