Recommendation
Waive further reading and adopt Resolution 2012- 37 amending Development
Service Fees and reinstating permit fees for solar panel installation, and water
heater, pool pump and HVAC inspection.
Background
A Comprehensive Cost of Services study (nexus study) was adopted in July of 2004. Since
then, Council adopted one update of the study based on FY 2004/05 costs on December 14,
2006. The second update of the study based on FY 2005/06 costs was deferred and ultimately
was not implemented due to the downturn in the economy and housing market. There has been
no increase in revenue to keep up with fee -related costs for staffing both at City Hall and in the
field since December 2006. State Law allows the City to recover the full cost of services
provided. Current fees are based on FY 2004/05 actual cost which is six years behind the
current cost.
On August 25, 2011, staff presented the updated Comprehensive Cost of Services study based
on FY 2009/10 costs. Included in the staff report was a survey based upon one hypothetical
subdivision consisting of 35 detached units situated on a ten -acre parcel of land value at
$150,000 per acre. Staff used the same survey criteria conducted by the Rose Institute in 2007
so that we could compare the total fees that were being charged in 2007 and earlier to fees that
were being charged during the time of survey in 2011. This model included all fees, not just
cities' fees which represent the estimated amount that would cost for developer to build homes
on ten acres of land.
The results showed that the City of Palm Desert has the lowest fees compared to other
neighboring cities even with the proposed fee increase in the first table, and the third -lowest
valley -wide in the second table. Without the increase, Palm Desert remains the city with the
lowest fees throughout the valley, while other cities have continued to implement their increase
over the last several years. The details of the survey are contained in the attached exhibit
labeled "Exhibit I".

Per request by local and regional building industry chapters, staff report and attachments are
provided to Mr. Bill Blankenship, Riverside County Building Industry Association, and Ms.
Gretchen Gutierrez, Desert Valley Builders Association so that they may have an opportunity to
review proposed fee. Both organizations asked to delay implementation of any fee increase
during the most recent public hearing. City Council agreed to defer implementation of the
adjustment for a period of six months with the next review to occur during the process of
formulating FY 2012-2013 budget. At the budget study session in April, Council directed staff to
implement fees and prepare the budget accordingly.
In response to Council's request, a comparison of permit fees for building a single-family home
in the cities of Palm Desert, La Quinta, Rancho Mirage, and Indio is included in the attachment
labeled "Exhibit II".
Fiscal Analysis
The City of Palm Desert has accommodated the building industry in the past five to six years by
postponing implementation of the fee adjustments. This accommodation is a contributing factor
in approximately $849,776 of foregone revenue as demonstrated in the attachment labeled
"Exhibit III". Adoption of this resolution will allow the City to collect fees based on an updated
analysis. With the loss of the Redevelopment Agency, Palm Desert has lost a major revenue
source, and has seen staff decrease from 170 to 117 positions. The economic downturn has
affected the City in much the same way as it has the building industry, and it is in the City's best
interest to update its fee schedule and collect revenue that is due without further delay.
Should Council choose not to adopt the resolution and implement the revised fee structure, staff
will be required to revise the entire budget as it will no longer be balanced. Additionally, a further
delay of ultimate implementation will likely result in a far more substantial increase as time
passes. Staff recommends that Council adopt the resolution and immediately implement the
revised fee structure.

RESOLUTION NO. 2012-37
A RESOLUTION OF THE CITY COUNCIL OF PALM DESERT,
CALIFORNIA, AMENDING THE DEVELOPMENT SERVICES FEE
SCHEDULE TO REFLECT THE UPDATE BASED ON FISCAL YEAR
2009/2010 ACTUAL EXPENDITURES.
WHEREAS, the City Council of the City of Palm Desert, California, did on July 8cn
2004 approve the "Cost of Services Study" as the City's model and policy for all future
service fees' adjustments; and
WHEREAS, this nexus study set forth a mechanism for ensuring that fees adopted
by the City for development services rendered do not exceed the reasonable estimated
cost of providing the services; and
WHEREAS, the costs associated with service delivery have risen, and increased
requirements by the State of California have further increased costs. The City of Palm
Desert accordingly adjusts the cost of services based upon Fiscal Year 2009/2010
expenditures and staff times, so that the associated fees for existing and potential
applicants are current and reasonable, and the residents of Palm Desert continue to
receive a high level of quality service.
WHEREAS, California Government Code Section 66016 requires notice to be
given and data made available at specified times prior to the adoption of amending
service fees for permits and building inspections sometime hereinafter at a public
meeting of this City Council; and
WHEREAS, all requirements of California law are hereby found to have been
complied with in and for these proceedings;
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY
OF PALM DESERT AS FOLLOWS:
Section 1: The Development Fee Schedule for specific services provided to its
citizens by the City of Palm Desert attached as "Exhibit A, B, C, and D" hereto is hereby
approved and adopted.
Section 2: The fee established herein shall become effective immediately.
Section 3: The City Clerk shall certify to the adoption of this Resolution.

NOTICE IS HEREBY GIVEN that a Public Hearing will be held before the Palm
Desert City Council to consider the implementation of Resolution 2012- relating to
amending Development Service Fees and to reinstate permit fees for water heater, and
HVAC inspection.
SAID PUBLIC HEARING will be held on Thursday, June 14, 2012, 4:00 p.m. in the
Council Chamber of the Palm Desert Civic Center, 73-510 Fred Waring Drive, Palm
Desert, California. All citizens are invited to present oral or written comments relative to
the proposed development services fee report. Any citizen unable to attend may submit
written comments to the City Clerk prior to the Public Hearing.
Copies of the report may be reviewed at the Civic Center, Monday through Friday
between the hours of 8:00 a.m. and 5:00 p.m.

Dear Mr. Gibson;
Thank you for providing the Desert Valleys Builders Association the opportunity
to review the Staff Report proposing to raise the City of Palm Desert Development Service
Fees. We have examined the attached exhibits and comparisons. The DVBA understands
that there will always be differences in fee rates between cities, so we did not focus on
the city comparisons.
However, we were very interested in the lists of fees collected by the City and
any reasonable support of those costs as per Government Code 66014 (a) "when a local
agency charges fees for zoning variances; zoning changes; use permits, building
inspections; building permits; filing and processing applications and petitions filed with the
local agency formation commission those fees may not exceed the estimated
reasonable cost of providing the service for which the fee is charged. „
Exhibits I and 11 each break down the cost of development service (Proposed) fees
per unit. However, Exhibit I shows the cost per unit using the example of a 35 unit, 10
acre project. As an alternate, Exhibit 11 breaks down the development services costs of a
solitary single family residential unit of similar size and density. We found it interesting
that between these two scenarios, costs increased 128% per unit in building a solitary
unit. However, there is nothing within these exhibits that correlates between the
existing fee rates with the proposed rate(s).
Exhibit III does not state the loss of revenue as suggested in its Title "Estimated
Foregone Revenue". This matrix shows us what the City could have collected, should it
have increased the fee rate prior to the fiscal year. There is only a loss once it is
established that cost to provide services out -weighed the fees collected.

Therefore, we have a list of observations and requests for more detailed
explanation:
• Exhibits A-D show a time per square foot or per item cost. However, it
does not establish or support how these time schedules were developed.
o Please provide documentation on how this was determined.
• None of the information provided has established the work -load or
number of hours worked by any staff member in providing these public
services.
o Please provide an accounting of number of hours worked (billable
hours) for each description of service. An over-all budgetary cost
per employee by department isn't necessarily reflective of public
service performed.
In the broader sense the DVBA requests additional information/documentation in
order to better understand how these numbers reflect the true cost of providing
development services. For instance, how was it determined that services took a certain
period of time to perform the tasks per square foot of development? What study or
methodology was under taken? When? How many billable hours were produced in Fiscal
Year2009/2010?
We look forward to reviewing the additional materials requested.

Dear Mr. Gibson:
Thank you for the opportunity to speak with you yesterday concerning the proposed
increase in the City of Palm Desert Development Service Fees. While the DVBA
recognizes the ongoing fiscal challenges that the City continues to face with loss of
revenue and the elimination of their Redevelopment Agency & it's funding, the
homebuilding and construction industry also continues to struggle with tough economic
challenges.
Any increase in fees does have a direct impact on the fiscal viability of a development,
whether it is to consider acquisition and start of project or the continuation of an active
housing community. While the construction industry is seeing brief pockets of recovery,
we would urge Council members to not adopt this increase at this time.
The DVBA would ask that the Council consider as an alternative.., an extension of 6
months to January 1, 2013 of the current Development Service fee levels.
Once again, thank you for the opportunity to provide comments to this issue and the
DVBA looks forward to continuing our business relationship with the City of Palm Desert,
its staff and Council Members.
