REQUEST: STAFF DIRECTION CONCERNING ISSUANCE OF A TEMPORARY USE
PERMIT FOR GREATER THAN TEN DAYS IN A CALENDAR YEAR, TO
ALLOW RECREATIONAL VEHICLE SALES AT 34-220 MONTEREY
AVENUE (SAM'S CLUB).

Recommendation
That the City Council provide staff direction on a requested Temporary Use Permit for
Recreational Vehicle (RV) sales located within the Sam's Club parking lot. Upon Council
consideration, direct staff to modify, approve or deny the proposed temporary use.
Background
On June 23, 2011 the City Council approved a Temporary Use Permit for Mike Thompson RV to
conduct monthly events from July 2011 through December 2011 for RV sales in the Sam's Club
parking lot. Each event was held within the first fourteen days of each month and lasted four to five
days. The flexibility allowed the applicant to work out appropriate dates with the property owner.
During those months the applicant was current on paying their sales tax to the City, and had no code
enforcement issues during the events.
On February 28, 2012, Mike Thompson RV submitted an application for a Temporary Use Permit to
conduct RV sales within the Sam's Club parking lot during the months of April 2012, September
2012, and November 2012. Each event would take place Wednesday through Sunday of each week
during those months from 9:00 a.m. to 5:00 p.m.
Special private or public events require a Temporary Use Permit and allow each business or
applicant to use up to ten days per calendar year. Mike Thompson RV has already used the
allowable ten days during previous events within the 2012 calendar year. The applicant is requesting
62 additional sales days through the end of this year.

Staff is requesting that the City Council provide direction on the proposed Temporary Use Permit to
allow RV sales on the dates and location requested. If approved, the applicant would be required to
obtain a daily City Business License, and complete and return appropriate sales tax forms after each
event. To date, the applicant has generated interest during past events in Palm Desert, then has
reported and paid all taxes for sales that occur in the City of Palm Desert.
In the event that the City Council elects to grant the applicant's request, staff recommends that the
following conditions be imposed on the Temporary Use Permit:
• Applicant must obtain a daily City Business License for all dates on which the temporary use
is conducted.
• Applicant must apply for and be granted by the State Board of Equalization a Sublocation for
the Palm Desert site and must credit Palm Desert as the point -of -sale for all revenue
generated from transactions originating from this approved temporary use.
Fiscal Analysis
Fiscal impact regarding the approval of the Temporary Use Permit for Mike Thompson RV sales
would result in a sales tax benefit for any units sold during future events. These RV units generally
range in price from $25,000 to $250,000.
