SUBMITTED BY: John Wohlmuth, City Manager DATE: March 22, 2012 CONTENTS: Resolution No. 2012- 19 Recommendation By Minute Motion, adopt Resolution No. 2012- 19 authorizing the City Manager or designee to execute agreements with the California Department of Transportation relative to a Community Based Transportation Planning Grant. Background The State of California Department of Transportation (Caltrans) has released a Call for Projects under their Community Based Transportation Planning (CBTP) Grant Program. Applications are due on April 2, 2012. There is $3,000,000 available statewide for local projects. No one applicant can request more than $300,000. Grant funds must be used for conceptual -level plans or study activities that include community -based stakeholder collaboration and consensus building through active public engagement. Each application should display a transportation and/or land use benefit. At its January 30, 2012 meeting, CVAG's Executive Committee authorized submitting a grant application. CVAG would use the funding to further provide public outreach for a 1 e11 Parkway Project: Grant Application Request: To fund public outreach efforts for the 1 e11 Parkway primarily to the Coachella Valley through workshops (English and Spanish) which may also necessitate childcare and food; a website (English and Spanish); newspaper articles; radio and TV spots in both English and Spanish; pamphlets and brochures; presentations to groups and social media outlets. CVAG, as a joint powers authority, is not eligible to serve as a grant applicant. CVAG can, however, be a Sub -applicant. CVAG requests that the City of Palm Desert be the Applicant and CVAG be the Sub -Applicant. Staff Report Transportation Planning Grant Project March 22, 2012 Page 2 of 2 In their role as Sub -applicant, CVAG will: • Prepare the grant application consistent with the Grant Program's guidelines; • Serve as the Project Manager; • Procure services related to the project, including a third -party consultant, • Produce and maintain all minutes, notes, maps, records, accounting files and all other records pertaining to the use of program funds • Provide the City with a Memorandum of Understanding which will further define roles and responsibilities of the applicant and sub -applicant. Local Cash Match: The CBTP Grant requires a 10% match for the funds received. As the applicant, the City must provide a minimum 7.5% cash match with the remainder coming from other sources such as in -kind services from the Sub -Applicant. Should the maximum $300,000 CBTP Grant be awarded to the City, the City's match will be $22,500. Under this scenario, CVAG will deposit into the City's general fund the $22,500 to support the program and provide the required match prior to execution of a Fund Transfer Agreement between the City and Caltrans. The City may also consider other funds, if applicable, as matching funds. In their role as Applicant, the City will: • Need to sign the application prior to sending it to Caltrans. It is expected that the announcement of awards will take place in June or July with funding available by the end of the 2012 calendar year; • Enter into a Memorandum of Understanding with CVAG detailing responsibilities for the 1 e11 Parkway Outreach project; • Receive and deposit the local cash match from CVAG sometime between the announcement of the award and execution of the Fund Transfer Agreement with Caltrans in order to provide the local cash match to Caltrans; • May provide a staff liaison for the project; Fiscal Impact There may be a minor expense to the City for staff time to be involved in the project including attending meetings and other related project tasks as determined by the project manager. However, the City already expends time on non -motorized and golf car transportation planning so grant activities would be consistent with those efforts. Krdor NOES: ABSENT - ABSTAIN: VERIFIED BY: L2_ Original on File with City erk's Office RESOLUTION NO. 2012-19 A RESOLUTION OF THE CITY OF PALM DESERT AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE AGREEMENTS WITH THE CALIFORNIA DEPARTMENT OF TRANSPORTATION. The City Council for the City of Palm Desert, California, does hereby DETERMINE, ORDER and RESOLVE as follows: WHEREAS, the City Council for the City of Palm Desert is eligible to receive Federal and/or State funding for certain transportation planning related projects, through the California Department of Transportation; and WHEREAS, the Coachella Valley Association of Governments (CVAG) desires to apply for State funding through the California Department of Transportation for a Community Based Transportation Planning (CBTP) Grant for a 1 e11 Parkway Project Outreach effort but is ineligible to do so due to its status as a joint powers authority; and, WHEREAS, for the purposes of this specific grant application, CVAG has approached the City of Palm Desert and the City agrees to serve as the "Applicant" and CVAG will serve as the "Sub -Applicant"; and, WHEREAS, should the City of Palm Desert be awarded the State CBTP Grant for CVAG's 1e11 Outreach Project, CVAG will provide a Memorandum of Understanding outlining responsibilities between the City and CVAG for the 1 el 1 Parkway Project Outreach effort and, WHEREAS, a Fund Transfer Agreement between the City of Palm Desert and the California Department of Transportation must be executed before such funds can be claimed through the CBTP Grant Program; and, WHEREAS, CVAG, in accordance with the Fund Transfer Agreement and prior to the execution of the Agreement between the City and California Department of Transportation, will deposit into the general fund of the City of Palm Desert an amount equal to 7.5% of the required 10% match to the grant award for an amount not to exceed $22,500 which will serve as the grant's required local cash match; and WHEREAS, the City of Palm Desert wishes to delegate authorization to execute the agreement and any amendments thereto. NOW, THEREFORE, BE IT RESOLVED that the City Council for the City of Palm Desert authorizes the City Manager or designee to execute all Fund Transfer Agreements and any amendments thereto with the California Department of Transportation.
