Executive Summary d adopt Resolution No. 2012-30 amending administrative citations and repealing Resolution In 1998, the City Council adopted Resolution No. 98-6 and Chapter 8.81, Administrative Citations, of the Palm Desert Municipal Code as an additional tool to assist code compliance staff in obtaining compliance with nuisance property violations that adversely affect the quality of life in the city. This resolution updates the schedule of fines associated with Chapter 8.81 Administrative Citations. Background Administrative citations can be issued to affect compliance with violations affecting the quality of life for Palm Desert residents. Administrative citations are generally issued for property maintenance violations such as unmaintained landscaping in front yards, trash containers in public view, substandard structures, building code violations, inoperable/abandoned vehicles, violations of the recently adopted short-term rental ordinance, and various other municipal code violations. Staff Report Schedule of fines Page 2 of 3 May 10, 2012 The purpose of revising the schedule of fines for administrative citations is to ensure accuracy with recently adopted ordinances and consistency of fine amounts with the fines from adjacent jurisdictions. Procedurally, this administrative process does not require the involvement of the City Attorney or the court system, which results in a reduction of legal fees. The schedule of fines adopted in Resolution 98-6 has not been revised since its inception fourteen years ago. During this time, new ordinances have been added to the municipal code, and certain code sections have been amended, repealed and/or consolidated. These changes are not appropriately reflected in the current schedule of fines as outlined in Resolution 98-6. Additionally, some fines need to be adjusted to reflect consistency with surrounding jurisdictions, as well as with the approved bail schedule utilized for court citations. The court citation schedule of fines has received approval from the Presiding Judge at the Riverside County Superior Court. The purpose of the schedule of fines is to set the amount of a fine imposed for municipal code violations when the fine amount is not specified in the code. For example, Chapter 5.10 Short-term rentals, has fine amounts actually called out in the code. However, a majority of the City's ordinances do not specify fine amounts, therefore a schedule of fines is necessary to designate the amount of the fines. Attached for your review is a redline version of Resolution 98-6 reflecting the proposed changes (Exhibit B). Resolution No. 2012 -30 is the revised schedule of fines (Exhibit A). Highlighted in yellow are the new ordinances, sections of ordinances, and proposed fines. Below is a comparison chart of administrative citation fines between surrounding jurisdictions for municipal code violations. The jurisdictions listed below do not utilize a schedule of fines. Instead, they impose one fine amount for all municipal code violations that escalates with reoccurring violations. This practice does not allow for a lesser fine amount for less serious violations. Please note that Palm Desert's fines are in line with, or lower than, those of surrounding cities. Fiscal Analysis Implementing the proposed schedule of fines will result in a nominal increase in the amount of revenue collected from administrative fines, but it will not offset the entire cost of code compliance activity associated with compelling a property owner to comply with the City's property maintenance ordinance. SCHEDULE OF FINES The administrative citation fine amounts set forth are hereby established for violations(s) of the Palm Desert Municipal Code as set forth in Exhibit A, (attached hereto): Section 2. Except as otherwise specifically set forth in Section 1 above, the fine amount for a second violation of the same Municipal Code section by the same person within a thirty- six (36) month period shall be equal to one hundred twenty-five percent (125%) of the fine amount listed in this Resolution for a violation of that Municipal Code section. Section 3. Except as otherwise specifically set forth in Section 1 above, the fine amount for a third and subsequent violation of the same Municipal Code section by the same person within a thirty-six (36) month period shall be and equal to one hundred fifty percent (150%) of the fine amount listed in this Resolution for a violation of that Municipal Code section. Section 4. Any fine amount imposed pursuant to Chapter 8.81 of the Palm Desert Municipal Code and this Resolution shall be deemed delinquent if it is not paid in accordance with the terms and conditions of Chapter 8.81. Any person who fails to pay to the City the amount of any fine imposed pursuant to the provisions of Chapter 8.81 of the Palm Desert Municipal Code and this Resolution on or before the date that fine amount is due shall be liable for the payment of an additional delinquency penalty. The delinquency penalty is equal to ten percent (10%) of the amount of the fine due to the City, or ten percent (10%) of the amount of the fine remaining unpaid to the City if a portion of the fine amount was timely paid. Interest shall accrue on all delinquent fine amounts, exclusive of delinquency penalties, at the rate of one-half of one percent per month, pro rata, of the total delinquent fine amount, from the date the fine amount becomes delinquent until the date that all delinquent fine amounts are paid to the City. Section 5. This Resolution shall go into full force and effect immediately, but shall be subject to the terms and conditions of Ordinance Nos. 864, 865, and 868.
