PALM DESERT IMPROVEMENTS (PROJECT NO 872-12)

Recommendation
By Minute Motion:
1. Approve contract extension (C31880) for Zeus Construction for the Palm Springs Art
Museum -Palm Desert Improvement Project to January 4, 2013 (Project No. 872-12).
2. Approve Change Order to Contract No. C31880 in the amount of $1,875.00.
3. Appropriate $1,875.00 from the Unobligated General Fund for Project No. 872-12,
Palm Springs Art Museum -Palm Desert Improvements to Account No.
110-4800-454-3885.
Background
The City of Palm Desert entered into an agreement (Contract No. C31880) with Zeus Construction, Inc.
(Palm Desert, CA) for Project No. 872-12, concerning improvements at the Palm Springs Art Museum -
Palm Desert (PSAM-PD). This project to install sculpture foundations and lighting is a City requirement
under the lease agreement entered between the City of Palm Desert and PSAM on July 1, 2010.
As part of this project, various lockable bollards are placed at key entry points into the Sculpture Garden
to prevent vehicle access to mitigate any potential artwork theft. At some locations, bollards could not be
placed due to the disruption to existing landscaping that would occur. At these locations, a vehicle would
have enough room to drive on the landscape area to traverse around the bollards. To inhibit such action,
staff recommends placing additional boulders at three locations that will also blend in with the existing
landscaping. Please note that one location will have an existing trash canister bolted into the concrete
providing a cost effective solution, while still providing an effective barrier.
Under the existing agreement with Zeus Construction, they had 30 days to complete this project (by
October 17, 2012), which staff felt was appropriate given the work involved. However, staff learned after
contract execution that the light poles at this project require a special custom order and typically take six
to eight weeks to manufacture. Therefore, the original 30-day project timeline was unreasonable and
could never have been met. Staff recommends not imposing liquidated damages for this reason. The
contractor has also made a good faith effort as he will install, at no additional cost, temporary light poles
within the Sculpture Garden that will, in the interim, meet the needs of the many events planned at the
PSAM in the coming weeks.

The permanent custom light poles are anticipated to ship on November 30, 2012. Therefore, staff
recommends extending the completion date of Contract No. C31880 to Friday, January 4, 2013. Staff
anticipates these poles will be installed sooner, but extra time is warranted for unforeseen delays due to
the Holiday Season.
Fiscal Analysis
Approval of staffs recommendation will extend the project completion deadline to January 4, 2013, and
increase the costs associated with Project No. 872-12 by $1,875.00, as indicated:

With approval of staff's recommendation, an additional appropriation is required from the Unobligated
General Fund in the amount of $1,875. Please note that the Museum has deposited $19,060 in estimated
revenue with the City in a trust account to go towards this project upon its completion.
