Recommendation
By Minute Motion: Approve design guidelines for the El Paseo shopping district,
and direct staff to develop procedures and fees for establishing an outdoor
dining permit.
Committee Recommendation
At the direction of the City Council, the draft guidelines were reviewed by the board of the El
Paseo Business Improvement District at their October 18, 2012, meeting. They
unanimously recommended that the City Council adopt the guidelines with the following
modifications: 1) the minimum clear sidewalk width should be reduced from eight to six feet;
2) hours of operation for outdoor dining should not be restricted; and 3) use of paper goods
should be allowed for establishments that do not have outdoor service, such as coffee
shops and ice cream shops. They also requested that the City consider budgeting for new
street furnishings (benches, trash receptacles, etc.) to replace the ones that were installed
in the late 1990s.
Executive Summary
Approval of the staff recommendation would allow restaurants on El Paseo to encroach into
the public right-of-way to provide outdoor dining. It would also set in place a process by
which the City could exercise aesthetic control over outdoor dining through a staff review
process. Staff decisions would be appealable to the Architectural Review Commission and,
ultimately, to the City Council. Several of the recommendations from the El Paseo Business
Improvement District vary from the staff recommendations; Council direction is appropriate
in these areas, which are discussed below under Review Comments and Responses to the
Draft Guidelines.

Background
In June 2012, a property owner requested that the City Council allow a dining patio to
extend five feet into the public right-of-way on El Paseo. The City Council asked staff to
study the issue for all restaurants on El Paseo so that no one business would be given
preferential consideration. Additionally, they suggested that design standards be drafted so
that sidewalk dining could be encouraged by the City, while assuring that there be no
compromise to the high -end shopping experience and the pedestrian -oriented experience
for which El Paseo is known.
To study this issue, staff identified a number of shopping districts that have good dining
opportunities and lively street scenes. These shopping districts included State Street in
Santa Barbara, King Street in Alexandria, Virginia, Orange Avenue in Coronado, Palm
Canyon Drive in Palm Springs, and Colorado Street in Pasadena. Each of the studied areas
was unique, and all had at least some characteristics or qualities to recommend. Each also
had attributes that would either not work well on El Paseo, or are not desired there.
The study of these popular pedestrian -oriented shopping districts resulted in a series of
recommendations for El Paseo. Given that the original interest dealt with sidewalk dining,
most of the standards are focused on that element. Since existing procedures and approval
processes address building architecture very well, it is not addressed again here.
Key elements of the design guidelines include the following:
• All restaurants will need to get a permit in order to provide sidewalk dining. The
permit will require staff -level approval to assure aesthetic quality, public safety, and
that the dining does adversely impact neighboring businesses. Staff decisions will be
appealable to the Architectural Review Commission.
• An eight -foot wide clear walkway is required at all times. When there is more
sidewalk room available, a restaurant can use it to provide outdoor dining, even if the
dining encroaches into the public right-of-way.
• If sidewalk clear width is limited by a planter, a business that chooses to eliminate
seasonal flowers and install a tree grate can take advantage of the extra clear width
created by doing so. In this instance, sidewalk width is measured to the trunk of the
tree, rather than to the edge of the planter.
• With appropriate approvals, businesses may place street furnishings (such as
seating, umbrellas, and decorative planters) on the sidewalk, provided that they are
on private property. Street furnishings in the public right-of-way will be chosen and
installed by the City so that a common theme is developed throughout the El Paseo
shopping district as a backdrop for the unique architecture and furnishings of the
individual businesses.

The right-of-way line on El Paseo is ten feet behind the curb, and most buildings are set
back five feet from the property line, for a total of fifteen feet from the curb. Since the palm
tree planters extend 4'-6" back from the curb, there is 10'-6" between the planter and the
face of most buildings. Requiring eight feet clear width of sidewalk would leave only 2'-6" of
width for outdoor dining, which is not enough room for even a single row of dining tables.
The guidelines presented for approval require eight feet clear width of sidewalk, which is
staff's recommendation. However, the neighboring retailers argue for a lesser standard, and
this is a policy issue on which City Council direction is sought.
Staff also studied two other concerns —smoking and outdoor entertainment —that were
expressed by City Council members at the October 11, 2012 meeting. Each of the two
concerns can be addressed by provisions already in the municipal code. Neither
pedestrians nor diners will be able to linger while smoking within 20 feet of the primary
entrance to the restaurant or surrounding businesses, and the City's relatively new
ordinances for entertainment and for noise will prohibit the restaurants from being a
nuisance to nearby residences.
Fiscal Analysis
Approval of this staff report will not have a direct fiscal impact on the City of Palm Desert.

NEW BUSINESS: With Board approval, the order of the presentations as listed
on the agenda was amended as follows.
1. City of Palm Desert
A. Design Guidelines: Lauri Aylaian introduced proposed
design guidelines for El Paseo outdoor dining and seating
to the Board for discussion and recommendation
(distributed in board packets). Items for discussion
included proposed hours outdoor dining from 7am to
midnight, minimum set back of 8ft from the sidewalk curb,
smoking pedestrians, use of paper products, signage
usage for outdoor dining and street furnishings.
a. A motion was made to recommend to the City that
there are no restrictions on dining hours
(Hanson/Stauber); passed unanimously.
b. John Wessman requested a setback with 6-7ft
clearance to allow for comfortable outdoor dining.
A motion was made to recommend to the City to
revise the setback to a minimum of 6ft
(Hanson/Stauber) and passed unanimously,
c. David Fletcher commented that the Design
Guidelines were too restrictive in awning
allowances, setbacks and would like to see artistic
benches for public seating areas. Lauri to take his
comments back to city council.
d. All Board members agreed that they would like to
see comfortable public seating areas and that
paper products should only be allowed for "casual
dining" restaurants such as coffee shops and yogurt
shops.
2. Palm Springs Life:
A. Catalogue/Directory Update: Jim Doyle presented two
design cover options to the Board and the catalogue/
directory for review. David Fletcher requested a timeline of
two weeks for future review, Jim advised that he can give
the board until Monday to send comments or revisions. By
a show of hands, the majority liked the design cover.
B. Fashion Week: Susan Stein gave a brief report on events
tentatively scheduled for Fashion Week. More info to
follow.
C. Other. Nothing to report.
3. FG Creative:
A. Review New Campaign: Stephanie will email radio spots,
once approved in-house. New campaign displays will be
presented at the Oct 30 Merchant Mixer.
B. Review Media Plan: Running as presented and approved;
nothing to report,
C. PR/Facebook Update: Stephanie distributed the monthly
Facebook report, showing an increase in fans and
interaction. For the PR, which is outlined in the monthly
report, focus is on new stores, Art Walk and the many
charity walks and events coming to El Paseo.
D. Online Co -Op with City of Palm Desert: The City has
confirmed that they have co-op budgets available and will
present ideas at the December meeting for consideration,
E. Merchant Mixer: The mixer is set for Oct 30 at the Palm
Springs Museum in Palm Desert as discussed.
F. Other. Stephanie reminded the Board to participate in the
upcoming Ernst and Young shopping passport. FGC will
send out a new notice and follow-up with merchants.

Review Comments and Responses to the Draft Guidelines:
Staff presented the draft guidelines to the board of the El Paseo Business Improvement
District (BID) at their October 18, 2012, meeting. The board members had a chance to
review the guidelines in advance of the meeting, and came prepared with a number of
specific items to discuss. They also received comments from the public, including a
property owner who is developing a restaurant that would like to offer outdoor dining.
The recommendations of the El Paseo BID board of directors were that 1) the minimum
clear sidewalk width should be reduced from eight to six feet; 2) hours of operation for
outdoor dining should not be restricted; and 3) use of paper goods should be allowed for
self -serve and carry -out dining establishments. They also requested that the City consider
budgeting for new street furnishings (benches, trash receptacles, etc.) to replace the ones
that were installed in the late 1990s.
Based on the suggestions of the City Council at the October 11, 2012, meeting and on the
input from the El Paseo BID, staff made two revisions to the draft guidelines: the hours of
operation were expanded to start at 5:00 a.m. to allow for coffee shops to open early; and
the prohibition on paper goods (such as napkins and plates) was limited to restaurants with
outdoor table service. Businesses such as ice cream shops or coffee shops where
customers purchase food and beverages indoors, then carry it outside to sit at tables, would
be allowed to use paper goods.
The last area in which the El Paseo BID recommendation differs from the staff
recommendation is the minimum clear sidewalk width. Staff recommends that eight feet
clear width be required between dining facilities and the curb or any street furnishings,
signs, planters, or obstructions. This space will allow a strolling couple to pass another
individual comfortably, without need for either party to step aside. Representatives of the
BID do not disagree that this width is preferable. However, they correctly identify that few
locations on El Paseo be able to provide outdoor dining with this constraint. A depiction of
