Background Per terms of City of Palm Springs Ordinance No. 1724, the City of Palm Desert is required to nominate a representative from its jurisdiction for selection and final appointment to the Palm Springs International Airport Commission (PSIAC) by the Palm Springs City Council. Mr. Rolf Hoehn has served the Palm Desert in this capacity since March 2008. Staff contacted Mr. Hoehn to inquire of his continued interest in serving, and he is very interested, providing, of course, that the City would like him to do so, noting that he is currently serving as Vice Chair of the PSIAC. As the current Director of Sales for the BNP Paribas Open and the Mercury Insurance Open, and as a former executive of both Aeromexico Airlines and Lufthansa Airlines, he is perfectly qualified for the appointment. Therefore, staff recommends your approval. Background: In November 2007, the City of Palm Springs adopted an ordinance amending the manner in which the Cities of Cathedral City, Coachella, Desert Hot Springs, Indian Wells, Indio, La Quinta, Palm Desert, Rancho Mirage, and the Riverside County Board of Supervisors are represented on the Palm Springs International Airport Commission. Commissioners who were in place at the time continued to serve out their terms as appointed by their respective agencies. After that time, the aforementioned agencies would nominate a representative from their jurisdiction for selection and final appointment by the Palm Springs City Council. Mr. Bill Bizzell served as the City of Palm Desert's appointed representative from February 1999 until his passing in 2007. At that time, his three-year term was set to expire June 30, 2009. Subsequently, Palm Desert accepted an application from and recommended Rolf Hoehn to be its representative to the Palm Springs International Airport Commission to fill Mr. Bizzell's vacancy. Mr. Hoehn was recommended on February 14, 2008, and appointed by the City of Palm Springs shortly thereafter. Staff Report - Reappointment to Palm Springs Intemational Airport Commission - August 27, 2009 After Mr. Hoehn inquired earlier this summer, the City Clerk's Office communicated with Palm Springs' City Clerk's Office to ask how the term expiration would be handled. The response given was that if it was the City of Palm Desert's desire, it would be appropriate for the City to forward a recommendation for Mr. Hoehn's reappointment and continued service on the Palm Springs International Airport Commission. It is our understanding that Mr. Hoehn has been representing the City very well and provides valuable input to the Airport Commission. Therefore, approval of the recommendation for reappointment is appropriate. Ordinance No. 1724 modified the appointment process, whereby a representative city nominates a member for appointment by the Palm Springs City Council. Such amendment was required for compliance with the City Charter. Based upon input from cities, the City Council modified the ordinance and eliminated the requirement for representative cities to nominate two -members to the Palm Springs City Council for selection and final appointment. Representative cities may provide only one nomination to the Palm Springs City Council for possible interview, ratification and appointment. The nomination process is effective upon the expiration of the term of office for the current representative city. Our records indicate the term for ends June 30 2009 we are sorry to hear of the passing of Commissioner Sizzell City Staff recommends for future nominees, representative cities submit the name of the nominee along with background information to the Palm Springs City Clerk, to place the appointment on the City Council agenda. Additionally, effective December 14, 2007, no person shall be eligible to serve or continue to serve as a member of the Commission who has served as a member of certain airport land use commissions or other airport boards or commissions. The City Council of the City of Palm Springs ordains: SECTION 1. Subsection (f) of Section 2.06.010 of the Palm Springs Municipal Code is amended to read: (f) Any member may be removed from office at any time, with or without cause, by a majority vote of the members of the city council. if a member is absent without advance permission of the board or commission or of the member's appointing authority, from three consecutive regular meetings or from twenty-five percent of the duly scheduled meetings of the board or commission within any fiscal year, the chair of the board or commission shall file a certification with the City Clerk that such absences have occurred, and the member's office shall thereupon automatically become vacant and shall be filled as any other vacancy. SECTION 2. Section 2.16.020 of the Palm Springs Municipal Code is amended to read: 2.16.020 Membership --Creation. (a) There is created in the city an international airport commission, which shall consist of nineteen members. The nineteen members shall be appointed in the following manner: ten members, appointed in accordance with Section 2.04.060 of the Palm Springs Municipal Code; nine members, each appointed by the Palm Springs City Council from candidates nominated by each of the city councils of Cathedral City, Coachella, Desert Hot Springs, Indian Wells, Indio, La Quinta, Palm Desert, and Rancho Mirage, and the board of supervisors of Riverside County. (b) No member of the international airport commission shall serve, as a member of the airport land use commission for Riverside County or any airport board or commission for another airport within Riverside, Imperial, San Diego, or San Bernardino counties while serving as a member of the international airport commission, created pursuant to the provisions of this section. No person shall be eligible to serve or continue to serve as a member of the international airport commission who has served as a member of the airport land use commission for Riverside County or any airport board or commission for another airport within Riverside, Imperial, San Diego, or San Bernardino counties within the twelve month period immediately preceding service as a member of the international airport commission.
