HomeMy WebLinkAboutPalm Springs Art Museum in Palm Desert - Various Private Events - Temporary Use PermitCITY OF PALM DESERT DEPARTMENT OF COMMUNITY DEVELOPMENT STAFF REPORT REQUEST: CONSIDERATION OF AUTHORIZING THE CITY MANAGER TO GRANT EXCEPTIONS TO PALM DESERT MUNICIPAL CODE SECTION 25.64.040 (USES PERMITTED SUBJECT TO TEMPORARY USE PERMIT) FOR VARIOUS PRIVATE EVENTS HELD AT THE PALM SPRINGS ART MUSEUM IN PALM DESERT (THE GALEN) FOR A PERIOD OF FIVE YEARS SUBMITTED BY: Lauri Aylaian, Director of Community Development DATE: October 11, 2012 Recommendation By Minute Motion, approve for a period of five years: 1. Authorization for the City Manager to execute on behalf of the property owner Temporary Use Permit (TUP) applications for events held by the Palm Springs Art Museum in Palm Desert. 2. An exception to Municipal Code Section 25.64.040 (Uses Permitted Subject to Temporary Use Permit) permitting the Palm Springs Art Museum in Palm Desert (The Galen), located at 72-567 Highway 111, to have more than 10 special events per year that require Temporary Use Permits. Background Since their opening earlier this year, the Palm Springs Art Museum in Palm Desert has been holding multiple events at the site known as Entrada del Paseo. City staff regularly reviews the Temporary Use Permit (TUP) applications for these events. The events are unique in nature, so review of the configuration of tents, seating, stage areas, parking, food and beverage service areas, and related barricades and access control is necessary to assure public safety. As property owner for Entrada del Paseo, the City must sign each application for a Temporary Use Permit. However, staff believes that City Council authorization of each event individually does not provide additional protection or control, and is not necessary. To streamline this process, staff requests that the City Council delegate the authority to sign the TUP applications to the City Manager for a period of five years. Staff Report Palm Springs Art Museum Exceptions Page 2of2 October 11, 2012 Staff also suggests that it is appropriate to allow The Galen to hold more than 10 events per year requiring Temporary Use Permits. The City chose to lease The Galen to the Palm Springs Art Museum in part because of their willingness to hold special events that engage community members in the Entrada del Paseo setting. Allowing a greater number of events will increase the number of residents introduced to the drought - tolerant gardens and sustainable design of the building, both of which increase awareness of environmentally -friendly living. Conducting special events at The Galen does not detract from the success of Palm Desert businesses, and does not involve use of balloons, pennants, banners, or aggressive marketing techniques that detract from the image of Palm Desert as a high -end resort destination. Staff is unaware of any complaints from residents or businesses regarding the events that have been held to date at The Galen. Approval of the staff recommendation would allow the City Manager to execute the TUP application forms and to approve special events at The Galen for a period of five years. The City Manager would require staff review of all such applications, and would impose appropriate conditions to protect public safety and to minimize or eliminate adverse impact to the neighboring businesses and residents. Fiscal Analysis There is no direct fiscal impact associated with the approval of this request. The City does not receive fees associated with these events since the Palm Springs Art Museum is classified as a 501(c)(3) through the Internal Revenue Service and the entity serves as a non-profit organization.
