Aryan, Risk Manager DATE: October 25, 2012 CONTENTS: Temporary Use Permits Recommendation By Minute Motion, Ratify approval of an exception to Municipal Code Section 9.58.010 (Consumption of Alcoholic Beverages on Public Property) for two private events (10/13/12 & 10/20/12) at the Palm Springs Art Museum -Palm Desert (The Galen), located at 72-567 Highway 111. 2. Approve an exception to Municipal Code Section 9.58.010 (Consumption of Alcoholic Beverages on Public Property) for numerous private events (10/30/12, 11/10/12, 11/13/12. 11/14/12, and 11/15/12) at the Palm Springs Art Museum -Palm Desert (The Galen), located at 72-567 Highway 111. Background Palm Springs Art Museum (PSAM) officials indicated that they wish to hold numerous private events at their Palm Desert satellite facility, also known as The Galen (72-567 Highway 111). These events are listed in more detail in the table below and also include the consumption of alcoholic beverages, both inside the facility and within the Sculpture Gardens. Temporary Use Permits (TUPs) were submitted to the Planning Department and circulated to the appropriate City Departments for comment. Please note that two of these events will have already occurred by the time the City Council considers this request. These items were not brought sooner to the City Council because a staff member had to take an earlier than expected maternity leave. Staff recommends an exception to Municipal Code Section 9.58.010 (Consumption of Alcoholic Beverages on Public Property) for the events listed below. This action will not approve the TUPs, as they still need to be reviewed by various City Departments before final approval can be granted. Please note that the Palm Springs Art Museum indicated that all events are catered by licensed caterers and an alcohol license will be required by all bar tenders and caterers. They also indicated that the Museum and City will be listed as additional insureds. PURPOSE: Temporary use permits allows for short-term activities that may be appropriate when regulated. The temporary use permit process is covered under article 26.64 of the Palm Desert Municipal Code. The normal review time for these requests is one to three days. A Temporary Use Permit may only be granted for the following: ■ Sales of art work • Christmas tree sales • Carnivals, circuses, special events of not more than 72 consecutive hours ■ Parking and storage of earth moving or construction equipment ■ Storage of materials incidental to the carrying on of a public works project, subdivision, or construction project • Real estate tract sales office • Construction - garage or shed for subdivision construction • Model homes, model home sales offices ■ Such other uses as the Zoning Administrator may consider being within the intent and purpose of this section SUBMITTAL REQUIREMENTS: 1.
