REQUEST: Approve Eight Ordinances Updating Various Municipal
Code Sections

CONTENTS: Technical Municipal Code Revisions
Staff from the various departments and the city attorney's office have done a
comprehensive review of the city's municipal code to identify technical, largely non -
substantive changes that (1) conform the code sections to current law; (2) conform the
code sections to current practice in the city; and (3) make the code sections internally
consistent.
The ordinance revision package on the agenda contains eight proposed ordinances, each
of which change multiple Municipal Code Sections. The eight ordinances contain
changes to code sections that deal generally with the following subject matters:

PALM DESERT, CALIFORNIA, AMENDING SECTIONS
10.20.010, 10.20.020, 10.32.060, 10.48.120, 10.48.150, 10.72.010,
25.58.312, AND DELETING SECTIONS 10.12.030, 10.12.040,
10.32.050, 10.40.010, 10.40.030, 10.56.020, 10.60.010, 10.68.010

DEALING WITH TRAFFIC ISSUES
The City Council of the City of Palm Desert, California does hereby ordain as follows:
SECTION 1.
That Section 10.12.030 of the Code of the City of Palm Desert, California, be and
the same is hereby deleted.
SECTION 2.
That Section 10.12.040 of the Code of the City of Palm Desert, California, be and
the same is hereby deleted.

SECTION 3.
That Section 10.20.010 of the Code of the City of Palm Desert, California, be
and the same is hereby amended to read as follows:

10.20.010 traffic assident collision studies.
Whenever the aeeideRts collisions at any particular location become numerous
the traffic division shall cooperate with the city traffic engineer in conducting studies of
such accidents and determining remedial measures.
SECTION 4.
That Section 10.20.020 of the Code of the City of Palm Desert, California, be and
the same is hereby amended to read as follows:

SECTION 5.
That Section 10.32.050 of the Code of the City of Palm Desert, California, be and
the same is hereby deleted.
SECTION 6.
That Section 10.32.060 of the Code of the City of Palm Desert, California, be
and the same is hereby amended to read as follows:
10.32.060 Distinctive roadway markings.
The city traffic engineer is authorized to place and maintain distinctive roadway
markings as described in the Vehicle Code on those streets or parts of streets where
the volume of traffic or the vertical or other curvature of the roadway renders it
hazardous to drive on the left side of such markings or signs and markings. Such
markings or signs and markings shall have the same effect as similar markings placed

Vehicle Code.
SECTION 7.
That Section 10.40.010 of the Code of the City of Palm Desert, California, be and
the same is hereby deleted.
SECTION 8.
That Section 10.40.030 of the Code of the City of Palm Desert, California, be and
the same is hereby deleted.
SECTION 9.
That Section 10.48.120(B) of the Code of the City of Palm Desert, California, be
and the same is hereby amended.
10.48.120(B) Unlawful parking —Peddlers and vendors.
B. No person shall park or stand on any street any lunchwagon, eating cart
or vehicle, or pushcart from which tamales, pea%tS ^^^^^Y^ Gandy, iGe Gre m er ether
articles of food are sold or offered for sale without first obtaining a written permit to do
so from the city traffic engineer which shall designate the specific location in which such
cart shall stand.

SECTION 10.
That Section 10.48.150 of the Code of the City of Palm Desert, California, be and
the same is hereby amended to read as follows:
10.48.150 Twenty -few minute parking.
Green curb marking means no standing or parking for a period of time longer
than twenty -fete minutes at any time between nine a.m. and six p.m. on any day except
Sundays and holidays.
SECTION 11.
That Section 10.56.020 of the Code of the City of Palm Desert, California, be and
the same is hereby deleted.

25.58.312 Valet parking.
Valet parking is subject to review and approval either at the time the predominant
use is approved through a conditional use permit with insurance provisions or later as a

resulting from the conditional use permit. Existing commercial uses utilizing valet

SECTION 16.
The City Clerk of the City of Palm Desert, California, is hereby directed to publish
this ordinance in the Desert Sun, a newspaper of general circulation, published and
circulated in the City of Palm Desert, California, and shall be in full force and effective
thirty (30) days after its adoption.
