Recommendation
By Minute Motion, reappoint Douglas J. Walker as the City of Palm Desert's
representative to the Coachella Valley Mosquito and Vector Control District
(CVMVCD) Board of Trustees for a four-year term, January 2013 to
January 2017.
Background
Mr. Walker was first appointed as the City's representative to the CVMVCD on
January 11, 2007, and reappointed to the position on June 12, 2008, for a four-year
term (January 5, 2009 - January 5, 2013). The District's Clerk of the Board has
notified the City that it is time to either reappoint Mr. Walker or appoint another
eligible City resident to the position for a term that commences January 7, 2013 (first
Monday of January).
Staff contacted Mr. Walker to inquire of his continued interest in serving the City in
this capacity, and the response was a very resounding, "Yes," providing, of course,
that the City would like him to do so. It was learned that not only is Mr. Walker
currently serving as Secretary to the local District, but he is also serving our area
regionally and Statewide on various affiliated boards. As a retired Professor of
Natural Resources and Entomology, Dean, and Division Chair at College of the
Desert, he is perfectly qualified for the appointment. Therefore, staff recommends
your approval.

Dear Ms. Klassen:
I am writing to inform you that Trustee Walker's term, on the Coachella Valley
Mosquito and Vector Control District ("District") Board of Trustees, will expire
at noon on January 5, 2013. (Health and Safety Code § 2023(c))
A Trustee appointed by a City Council must be a voter in that City and a resident
of that portion of the City that is within the District. (Health and Safety Code
§2022(b)). Incidentally, a member of the City Council may be appointed to serve
on the Board without violating the prohibition on holding incompatible offices.
(Health and Safety Code §2022(c)).
Trustees appointed to the Board should have "experience, training, and education
in fields that will assist them in the governance" of the District (Health and
Safety Code §2022(d)) and the term of the new appointment may be for either two
years or four years, at the discretion of the appointing authority. (Health and
Safety Code §2024(a)).
Once a Trustee is appointed, he or she shall exercise their independent judgment
of the interests of the public as a whole and not solely the interests of the City
Council. (Health and Safety Code §2022(d)) In addition, once appointed, the
Trustee may not be removed or replaced by the City Council prior to the
expiration of the Trustee's term, with limited exceptions. (Attorney General
Opinion No. 09-502).
In light of the foregoing, the District respectfully requests that your City Council
either appoint a new Trustee or reappoint Mr. Walker, on or before the expiration
of his term, as set forth above.

Recommendation: By Minute Motion, that the City Council approve a four year term of
office for Douglas Walker, Trustee, Coachella Valley Mosquito and Vector Control, beginning
January 5, 2009.
Executive Summary: On April 24, 2008, the City Council appointed Mr. Douglas Walker to
serve as the City's representative to the District's Board of Trustees for calendar year 2008.
The City received a letter from the Interim General Manager for the District indicating that the
appointment must conform to Section 2024 of the Health and Safety Code. Section 2024
requires the terms of office for appointees be for either two or four years at the appointing
authority's discretion, to commence on the first Monday in January. Mr. Walker is willing to
serve this term.

Re: Request that Future Appointments be Based on Calendar Year
Dear Carlos:
I am writing to ask for your assistance regarding the future
appointment of Trustees from your agency to our Board. It has
recently been brought to my attention that the terms of office for
certain Trustees from member agencies are not in conformity with
Section 2024 of the Health and Safety Code. This Code Section
requires that terms of office for appointees be for either two or four
years, at the appointing authority's discretion, and must commence
at noon on the first Monday in January, and follow the calendar
year.
The terms of office for several Trustees are set to expire in the near
future. In light of this fact, I request that the appropriate appointing
bodies take action to conform these new terms to the
aforementioned requirement.

management role.

10/2000 to 6/03: Dean/Division Chair, Applied Science & Fine Arts Division
In October of 2000, 1 was asked to serve as Division Chair for the Fine Arts Division
in addition to my existing position as Division Chair, Applied Sciences. These
combined divisions contained approximately 100 faculty and staff, with 17 full-time
faculty, 14 classified staff and about 75 adjunct faculty.
A title change to Dean occurred in July, 2002.
9/87 to 9/2000: Division Chair, Applied Sciences
Since the formation of the Applied Science Division at College of the Desert in 1987,
1 served as the administrative leader for the unit. This role included a forty percent
Aft teaching assignment.
4/79 to 9/87: Department Chair, Agriculture and Natural Resources
Prior to the formation of divisions, my faculty assignment included chairing this
department. Following a merger with the Engineering/Technology/Math Department
in 1987, 1 was selected to fill the newly created Division Chair role.
8/71 to 6/2002: Professor of Agriculture and Natural Resources
In 1971, College of the Desert hired me to develop the Natural Resources program
and to strengthen the plant science offerings.

Dear Councilman Kelly:
This letter is a follow-up to a conversation we had late last fall. Having recently retired
from College of the Desert after serving thirty-four years at that institution, I am hoping
to use my expertise and experience to serve our community. It has come to my attention
that the City of Palm Desert appoints a representative to sit on the governing board for
the Coachella Valley Mosquito and Vector Control District. Apparently, you have a very
capable individual currently serving in that role, and I am not interested in displacing that
Aft person. However, if and when he decides to step aside, I would appreciate being
qW considered for filling the vacancy.
Attached, you will find a resume that includes some of my qualifications for serving as
the Palm Desert representative on the CV Mosquito and Vector Control District board. It
appears that my academic background in entomology, and career in education, including
management experience, would provide an excellent fit for this particular board position.
