By Minute Motion:
1. Approve Change Order No. 1 to Contract No. C31450 with Statewide
Stripes, Inc., for the 2012 Citywide Striping Program in the amount of
$23,695.00 (Project No. 564-12);
2. Move $23,695.00 from contingency to base;
3. Authorize the Mayor to execute the subject Change Order; and
4. Accept the work as complete and authorize the City Clerk to file the
Notice of Completion for Contract 31450.
Funding is available for this project in General Fund Account No. 110-4315-433-3320,
Striping.

Background
On May 10, 2012, City Council awarded the contract for the 2012 Citywide Striping
Program to Statewide Stripes, Inc., in the amount of $262,773.83, and approved a 10
percent contingency in the amount of $26,277.38. In late July, staff identified several
areas where striping improvements were needed, but were not included in the original
contract. Staff requested an estimate from Statewide Stripes for the additional work.
Staff reviewed the price estimate and found it to be well within industry standards.
On August 7, 2012, staff requested that the City Manager authorize extra work for this
project in the amount of $23,695.00, and a copy of that memo is attached. This amount
was below the 10 percent contingency approved for this project.
Staff has inspected the work performed by the contractor and has found said work to be
complete and in accordance with the contract requirements.
Fiscal Analysis
This is an on -going maintenance activity with no fiscal impact beyond the contract and
change order amount. Funding is available for this project in General Fund Account No.
110-4315-433-3320, Striping.

This Change Order covers changes to the subject contract as described herein. The Contractor shall construct, furnish
equipment and materials, and perform all work as necessary or required to complete the Change Order items for a
lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as Owner.
Contract Time Extension 0 Days.
Revised Contract Total $286,468.83 .
The undersigned Contractor approves the foregoing Change Order # 1 as to the changes, if any, in the contract
price specified for each item including any and all supervision costs and other miscellaneous costs relating to the
change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Change Order # 1. The Contractor agrees to furnish all labor and materials and perform all other necessary work,
inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Order
items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood
that the Change Order shall be effective when approved by the Owner.
Execution of this Change Order by the Contractor constitutes a binding accord and satisfaction that fully satisfies,
waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of
or related to the subject of the Change Order, whether known or unknown, including but not limited to direct and
indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as
any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.

The 2012 Citywide Striping Program was awarded to Statewide Stripes, Inc. on May 10, 2012
for the amount of $262,773.83. The striping work began July 9, 2012 and will be completed in
September 2012. Since the start of the project, Public Works staff has identified several
additional areas where striping improvements are needed that were not included in the original
contract. These improvements include: installation/ modification of median edge line stripes and
markers; modification of double -double yellow striped medians to two-way left turn lane stripes;
additional removals of old conflicting striping; and restriping of parking stalls on Velie Way and
Joni Drive. Exhibits which detail the extra work to be performed are attached for reference.
Staff requested a quote from Statewide Stripes to perform the extra work. A quote was received
on August 6, 2012 in the amount of $23,695.00 to complete the extra work. This amount is
approximately 9.0% of the original project costs and does not exceed the $26,277.28
contingency amount set aside for the project.
I am requesting your authorization to issue a Change Order to Statewide Stripes, Inc. in the
amount of $23,695.00 to perform the additional roadway striping work. Funds are available in
Account No. 110-4315-433-3320, Striping.

percent contingency in the total amount of $26,277.38 and
3. Authorize the Mayor to execute the subject agreement.
Funding is available for this project in General Fund Account No. 110-4315-433-3320,
Striping.
Backaround
The 2012 Citywide Striping Program will repaint al] streets within Palm Desert. The
items to be restriped include all traffic stripes, pavements markings and pavement
legends. The project includes all streets in Palm Desert except for Highway 111.
Highway 111 was kept off the list because the street is scheduled to be repaved this

summer. Additionally, bike/golf cart lanes will be striped on Portola Avenue between
Hovley Lane West and Magnesia Falls Drive as part of this project.
The project was advertised and contractors were encouraged to submit bids. At the
April 24, 2012, bid opening, three contractors submitted bids. The bid summary is
below:
