THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, AMENDING SECTIONS 2.48.110 & 2.48.090 OF
THE PALM DESERT MUNICIPAL CODE (AMENDING

ADMINISTRATION AND EMERGENCY RELIEF.

Recommendation

to second reading.
Commission Recommendation
The Palm Desert Public Safety Commission is scheduled to review this item on
February 12, 2013, after this report was prepared. Staff can provide an oral update on
the Commission's recommendation upon request.
Backqround
Staff recommends amending Sections 2.48.110 & 2.48.090 of the Palm Desert
Municipal Code. These sections relate to the "City Manager's Duties" and the
"Declaration of a Local Emergency" specifically related to an emergency incident
succession strategy, which lists staffing positions no longer filled due to the City's recent
reorganization. Staff recommends that the City Council approve these administrative
modifications that will better assist the City during a major emergency incident and do
not significantly alter the original intent of the specific code sections.

ORDINANCE NO. 1253
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, AMENDING SECTIONS 2.48.110 � 2.48.090 OF THE PALM DESERT
MUNICIPAL CODE (AMENDING ORDINANCE NOS. 758 � 116), RELATIVE TO
DISASTER ADMINISTRATION AND EMERGENCY RELIEF.
WHEREAS, the City Council adopted Ordinance No. 758 on September 8, 1994,
and Ordinance No 116 on April 8, 1976, establishing procedures for disaster
administration and emergency relief.
WHEREAS, the City Council has determined it is desirable to amend these
ordinances with respect to the "City Manager Duties" and "Declaration of Local
Emergency", to reflect changes in city staffing.
NOW, THEREFORE. BE IT ORDAINED by the City Council of the City of Palm
Desert, California, that the following sections of the Palm Desert Municipal Code are
hereby amended as follows:
2.48.110 Citv Manaqer Duties.
The City Manager shall be Emergency Corps Commander. In the absence or
inability of the City Manager to act, he/she shall automatically be succeeded as
Emergency Corps Commander by any of the following officials in the order named:
1. Risk Manager
2. Director of Public Works
3. Director of Finance
4. Director of Building & Safety
5. Director of Community Development
6. Director of Housing
7. Director of Economic Development
8. Director of Special Programs
9. City Clerk
2.48.090 Declaration of Local Emer�encv.
A. A local emergency may be declared for good and sufficient reason by the
City Council, or if the City Council is not in session, by:
1. City Manager
2. Risk Manager
3. Director of Public Works
4. Director of Finance
5. Director of Building & Safety
6. Director of Community Development
7. Director of Housing
8. Director of Economic Development
9. Director of Special Programs
10. City Clerk

B. Whenever a local emergency is proclaimed by other than the City Council,
the City Council shall take action to ratify the proclamation within seven days thereafter
or the proclamation shall have no further force or effect. (Ord. 758 § 4, 1994: Ord. 116 §
5.2, 1976)

Desert, California, at its regular meeting held this 14th day of February 2013, by
