Recommendation:
Waive further reading and adopt Resolution No?o13-osamending fees relative
to Fuel Cell permits and Microfilm fee.
Backaround or Discussion:
The City of Palm Desert offered fee-free permits for energy efficiency measures, such
as photovoltaic, thermal solar, water heater, fuel cell, and HVAC permits. On June
14, 2012, the City Council passed Resolution No. 2012-37, which updated the
Development Services Fees, and in effect, eliminated the fee-free permits. Since the
implementation of new fees, staff has discovered that Fuel Cell permits were
inadvertently missed during this approval process. It was staff's intention that Fuel Cell
permits were to be included in the City Council action to amend Development Services
Fees. Exhibit I outlines the proposed fees for both residential and commercial Fuel Cell
installations. The proposed fees will match the fees currently charged for both
residential and commercial photovoltaic systems. The only difference is that
commercial plan check for Fuel Cells will be a one-hour ($168.00) plan check deposit
versus a two hour ($336.00) flat plan check fee. The commercial Fuel Cell systems are
much more complex to plan check based on historical data (7 hours for a 200kw
system).
The Department of Building and Safety staff has been inputting all of its fees into the
new One-Solution software system. It was discovered during this audit that the Microfilm
fee that has been historically charged for all permits issued was low based on the
current rate the City is charged for archiving all its records.

Exhibit II outlines the current rate that is charged based on the type of document that is
being digitally archived. The current Microfilm Fee is based on 30 cents per sheet,
regardless of the size or color of the document. A recent project that was inventoried
calculated the Microfilm fee for the project consisting of 77 sheets at $23.10. The actual
cost for that same project taking into account sheet size, would consist of 44 24" x 36"
sheets and 33 8'/"x11" sheets sent to be digitally scanned, would cost $37.50. Staff is
recommending covering the cost of archiving based on the rate in which we are charged
per our bid agreement with Scanning Service Corp. This increase will cover the actual
cost for each project based on an inventory of all documents in size and type.
Fiscal Analvsis

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT AMENDING RESOLUTION 2012-37, AS IT RELATES TO THE
BUILDING AND SAFETY FEE SCHEDULE FOR FUEL CELL PERMIT
AND MICROFILM FEES
WHEREAS, the City Council of the City of Palm Desert, California, did on July
8th, 2004 approve the "Cost of Services Study" as the City's model and policy for
all future service fees' adjustments; and
WHEREAS, this nexus study set forth a mechanism for ensuring that fees
adopted by the City for development services rendered do not exceed the
reasonable estimated cost of providing the services; and
WHEREAS, the City Council of the City of Palm Desert on June 14, 2012
passed Resolution NO. 2012-37, this updated the Development Services Fees, and in
effect, eliminated all fee-free permits. Since the implementation of new fees, staff has
discovered that Fuel Cell permits were inadvertently missed during this approval
process. In addition Microfilm fees being collected at the time of permit issuance is
insufficient to cover the actual cost of digitizing said documents.
NOW THEREFORE, BE IT RESOLVED THE CITY COUNCIL OF THE CITY OF PALM
DESERT DOES HEREBY AMEND THE BUILDING AND SAFETY FEE SCHEDULE
AS IT RELATES FUEL CELL PERMIT AND MICROFILM FEES AS FOLLOWS:
Section 1: The Development Fee Schedule for specific services provided to its
citizens by the City of Palm Desert attached as "Exhibit A", hereto is hereby approved
and adopted.
PASSED, APPROVED, AND ADOPTED by the City Council of the City of Palm Desert,
California at its regular meeting held this day of , 2013, by the following vote,
