1. Ratify City Manager's approval to reimburse Southern California Edison, in
the amount of $30,724.66, for electrical line extension services pravided as
part of the Freedom Park Constriction Project.
Backqround
As part of the Freedom Park Construction Project in 2006, Southern California Edison
provided electrical line extension services to bring power to the site. At that time, the City's
contractor provided estimates to SCE on the anticipated electrical usage of the park. The
project manager also agreed to a Rule 15 credit with a refundable option. This meant that the
City would not be billed for the initial power line e�ctension, as SCE permitted a project
allowance ($60,200), which was based on an agreement not executed by the City Manager.
It was anticipated that the City would use a certain amount of power to meet this project
allowance; however, the electrical usage was lower than estimated and there subsequently
was a deficit owed to SCE. The lower usage resulted in an invoice from SCE for their services
in the amount of $38,405.82. This invoice has remained outstanding for several years with no
resolution.
The City Manager recently proposed paying the amount due, less twenty percent, which
totaled $30,724.66. SCE indicated that payment of this revised amount will satisfy the City's
obligation. As the refundable option was selected, any refund due to the City will first be used
to waive the deficit of $7,681.16 and no further action is required. Please note that staff does
not recommend pursuing the refundable option for future projects.

Fiscal Analvsis
The original invoice from SCE for electrical line extension services related to the Freedom
Park Project was in the amount of $38,405.82. SCE agreed to a proposed twenty percent
reduction to the overdue amount in the amount of$30,724.66. The City Manager approved this
payment and a check was issued to resolve this matter, which had remained outstanding for
several years. No appropriation is requested as funds were available in Account No. 233-
4670-454-4001.

I would like to thank you and your staff for your cooperation wh�e we work toward a resolution related to
the deficiency involce for the Freedom Parlt Project. I am pleased to notify you the Distribution Construdion
Contract Management{pCCM)department wi(I accept payment of$30,724.66 a�d update the system so the
City will no longer be invoiced for the remaining deficit amount of$7,681.16.
As requested,i provide the foliowing brieF expianation of the reason for the invoice.
This invoice was calculated based on original pianning estimates to extend power to the Freedom Park
Project in 2006. At that time,the City's contractor provided elect�kal usage estimates to the locai planning
department. The City agreed to a Rule 15 credit with a refundable option, The project was planned and
constructed. The City was not billed for the initial power line e�rtension,based on an agreement and a
$60,2�0 allowance granter),with the premise the aty would use a certain amount of power. The City did not
use power as it had anticipated;and therefore,there is an outstanding balance that exists related to the
project and agreement to extend the power to Freedom Park.
This invoice was calculated based on the obligation provided by the agreement for the power line extension
to Freedom Park.The obtigation is the cost to serve of$39,855.00.This is the amount of'revenue/usage that
needed to be generated within a twelve month period from the date of service.Revenue is calculated by
adding the distribution charges for one year and mukiplying them by the c�t to servfce factor(16.6896
pursuant to Rule 15).The largest a�nual distribution eharges for this work order have heen$1,396.92.To
calculate the revenue we muitiply these distribution charges by the cost to service factor(1,396.92 x 16.6896),
which totals S8,374.82.This amount is then subtraded from the obC�gation($39,855.00-$8,374.82)and in
this case would resuit in a deficit of$31,480.18 The ITCC is then applied to the deflcit and gives us the
invoice amount$38,405.82.
DCCM has provided that a payment of$30,724.66 will satisfy the Cty's obl'�gation,however,because the
refundable option was selected by the City under the original contract,DCCM wiN continue to review the
work order for possible refunds. In order for the city to receive any refund,if a�y,they wiN need to clear the
deficit waived of$7,681.16.Therefore,refunds cannot be issued untii the waived deficit is exceeded by
future credits.
Please remit payment for$30,724.66 with the attached a copy of the original invoice and this letter. Once
DCCM has reteived this payment,the Cfty will no longer be responsible for generating the remaining amount
of deficit.
