Recommendation
Approve design guidelines for the El Paseo shopping district, and direct staff to develop
procedures and fees for establishing a Sidewalk Cafe Permit.
Council Subcommittee Recommendation
At its 15 November 2012 meeting, the City Council asked then-Councilmembers Benson and
Harnik to meet with staff to review several outstanding issues regarding the proposed El Paseo
Design Guidelines. Specifically, they were asked to address the minimum clear sidewalk width,
privately -owned street furnishings in the public right-of-way, and ways to prevent dining tables
and chairs from "creeping" too far out into the sidewalk.
After several meetings, the ad -hoc subcommittee recommended that the minimum clear
sidewalk width be eight feet, with a process by which staff could approve seven feet clear width
in cases of hardship or extenuating circumstances. The subcommittee also recommended that
restaurants that don't use barriers to define their spaces be required to have their approved
dining area defined with pavers, decorative saw cuts, or other aesthetic treatments, and that
private businesses be allowed to put street furnishings in the public right-of-way if the
furnishings are first approved by the City. Additionally, the subcommittee reviewed the number
and location of existing El Paseo restaurants to determine whether the street would take on a
cluttered appearance if all restaurants were to take advantage of the sidewalk dining
opportunity.
Finally, the Council subcommittee asked staff to prepare a white paper for replacing the existing
street furnishings on El Paseo with new ones that are more comfortable and more aesthetically
appealing. This white paper will provide cost and style information, and will be submitted for
consideration through the annual budget process.
El Paseo Business Improvement District Board of Directors Recommendation
At the direction of the City Council, the draft guidelines were reviewed by the Board of Directors
of the El Paseo Business Improvement District ("the Board") at their 18 October 2012 meeting.

They unanimously recommended that the City Council adopt the guidelines with the following
modifications: 1) the minimum clear sidewalk width should be reduced from eight to six feet; 2)
hours of operation for outdoor dining should not be restricted; and 3) use of paper goods should
be allowed for establishments that do not have outdoor service, such as coffee shops and ice
cream shops. They also requested that the City consider budgeting for new street furnishings
(benches, trash receptacles, etc.) to replace the ones that were installed in the late 1990s.
The Design Guidelines presented for approval here expand the hours of operation to 5:00 a.m.
to midnight and incorporate the Board's recommendation on use of paper goods, but leave the
minimum clear sidewalk width at eight feet (8'). An adjustment is available incases of hardship
to reduce that width to seven feet (7').
Executive Summary
Approval of the staff recommendation will establish a design standard for placement of art,
street furnishings such as benches and trash receptacles, umbrellas, canopies, sidewalk
clearances, and other aesthetic elements on El Paseo. It will also allow restaurants on El
Paseo to encroach into the public right-of-way to provide outdoor dining. Approval will set in
place a process by which the City could exercise aesthetic control over outdoor dining through a
staff review process. Staff decisions would be appealable to the Architectural Review
Commission and, ultimately, to the City Council.
Background
In June 2012, a property owner requested that the City Council allow a dining patio to extend
five feet into the public right-of-way on El Paseo. The City Council asked staff to study the
issue for all restaurants on El Paseo so that no one business would be given preferential
consideration. Additionally, they suggested that design standards be drafted so that sidewalk
dining could be encouraged by the City, while assuring that there be no compromise to the
high -end shopping experience for which El Paseo is known.
To study this issue, staff identified a number of shopping districts that have good dining
opportunities and lively street scenes. These shopping districts included State Street in Santa
Barbara, King Street in Alexandria, Virginia, Orange Avenue in Coronado, Palm Canyon Drive
in Palm Springs, and Colorado Street in Pasadena. Each of the studied areas was unique, and
all had at least some characteristics or qualities to recommend. Each also had attributes that
would either not work well on El Paseo, or are not desired there.
The study of these popular pedestrian -oriented shopping districts resulted in draft design
guidelines that were reviewed by the Board and by the City Council. Given that the original
interest dealt with sidewalk dining, most of the standards are focused on that element. Since
existing procedures and approval processes address building architecture very well, it is not
addressed again here.
Key elements of the design guidelines include the following:
• Each restaurant will need to get a Sidewalk Cafe Permit in order to provide
sidewalk dining. (Existing businesses that currently offer outdoor dining will have one

year in which to obtain their Sidewalk Cafe Permit.) The permit will require staff -level
approval to assure aesthetic quality, public safety, and that the dining does not
adversely impact neighboring businesses. Staff decisions will be appealable to the
Architectural Review Commission.
• An eight -foot (8') wide clear walkway is required at all times. When there is more
sidewalk room available, a restaurant can use it to provide outdoor dining, even if the
dining encroaches into the public right-of-way. The clear walkway may be reduced to
seven feet (7'-0") in instances where the applicant can demonstrate to the satisfaction of
staff that their business has a physical or financial hardship that precludes the provision
of eight feet of clearance.
• With appropriate approvals, businesses may place street furnishings (such as
seating, umbrellas, and decorative planters) on the sidewalk, provided that they are on
private property. Street furnishings in the public right-of-way may be chosen and
installed by the City so that a common theme is developed throughout the El Paseo
shopping district as a backdrop for the unique architecture and furnishings of the
individual businesses. With staff approval, businesses may locate street furnishings in
the right-of-way in the event that the City chooses not to do so.
With approval of the recommendation, staff will prepare detailed procedures and application
forms for the Sidewalk Cafe Permit. Staff will also analyze the amount of work needed to
review and take action on the permits, and will recommend to the City Council an appropriate
fee for the permit based upon this analysis. Existing businesses which already offer sidewalk
dining will be given one year to acquire their Sidewalk Cafe Permit.
Fiscal Analysis
Approval of this staff report will not have a direct fiscal impact on the City of Palm Desert. A
white paper that analyses the design and cost of providing new benches, trash receptacles, and
other street furnishings will be prepared for City Council consideration during the annual budget
process.
