Parcel Map No. 36395.
Backqround
Parcel Map No. 36395 is bounded by Frank Sinatra Drive, College Drive, University
Park Drive, and Cook Street. The map provides for the subdivision of a single parcel
into one 3.4-acre commercial parcel, and one 15.9-acre multiple-unit residential parcel,
known as The Vineyards. All buildings and improvements are existing. Department of
Public Works condition number 2 can be eliminated because formal apportionments are
not processed for Community Facilities District subdivisions, unlike assessment
districts. The tentative map was approved by the Planning Commission on October 18,
2011 and will expire October 18, 2013.
Those conditions of approval related to the map have been satisfied. This map
conforms to the requirements of the Subdivision Map Act and City ordinance and it is
substantially the same as it appeared on the tentative map.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING THE
SUBDIVISION MAP OF PARCEL MAP NO. 36395
BE IT HEREBY RESOLVED, by the City Council of the City of Paim Desert,
California, as follows:
1. That the map of Parcel Map No. 36395 of the City of Palm Desert,
California, is hereby approved as the official map of said Parcel Map, subject to the
conditions of the Tentative Map.
2. The City Engineer is directed to process the Parcei Map for recording upon
receipt of the payment of atl fees.

i. The development of the property shail conform substantially with exhibits on file
in the Department of Community Development, as modified by the following
conditions.
2. Tentative Parce{ Map 36395 sha{I be recorded within two (2) years from the date
of final approval unless an extension o# time is granted; otherwise said parce{
map approval shall become null, void and of no effect whatsoever.
3. Applicant agrees to maintain the existing landscaping installed pursuant to these
conditions. Applicant shall enter into an agreement or revise an existing agreement
through a property owners' association to maintain said landscaping for the life of
the project, which agreement shall be notarized and which agreement shall be
recorded. It is the specific inte�t of the parties that this condition and agreement run
with the iand and bind successors and assigns.
Department of Publlc Works:
All previaus conditions from PP 06-01 shaN apply to this map except for Public
Works condition number 16. The applicant is not responsible for the modification of
the Cook Street median.
2. The applicant shall submit a completed application to apportian special
assessment (Community Facilities District) 2Q05-1.

conditions.
2. Construction of a portian of said project shaN comrnence within one year from #he

3. The deveiopment of the property described herein shall be subject ta the restrictions
and limitations set forth herein which are in addition to all municipal ordinances and
state and federa! statutes now in farce, or which hereafter may be in force.
4. Prior to issuance of a building pe�mit for construction of any use contemplated by
this approval, the applicant shal( first obtain permits andlor ctearanca from the
following agencies:
Coachella Valley Water District
Palm Desert Architectural Review Commissidn
City Fire Marshai
Pubiic Works Department
Evidence of said permit or clearance from the above age�cies shall be presented to
the Department of 8uilding and Safety at the time of issua�ce of a building permit
for the use contempiated herewith.
5. All sidewaik plans shali be reviewed and approved by the Department of Public
Works prior to Architectural Review Cammission submittai.
6. All onsite utilities shall be underground.
7. Applicant agrees to maintain the landscaping required to be installed pursuant to
these canditions. Appiicent will enter into an agreement to maintain said
landscaping for the life of the project, which agreement shall be notarized and which
agreement shaN be recorded. lt is the specific intent of the parties thatthis condition
and agreement run with the {and and bind successors and assigns. The final
landscape plan shalt include a long-te�m maintenance program specifying among

of the year for the specific materials to be planted, as weil as periodic replacement
of materiais. Al) #o be consistent with the Property Maintenance Ordinance
(Ordinance No. 801) and the approved landscape plan.
8. The project shall be subject ta all applicable fees at time af issuance af permits
including, but not limited to, Art in Public Pfaces, TUMF and School Mitigation iees.
9, That the residential portion of the project shall provide parkin� pursuant to Municipa►
Cade Section 25.58.3QQ.0 except that the studio units shall anly be required #o
pravide 1.25 spaces per unit. The 260-unit project, therefore, wiN be required to
provide a totai of 507 parking spaces of which a minimum of 260 spaces must be in
garages or carports.
If, based on the grading plan review, fewer parking spaces are provided, the
number of uriits will be reduced accordingly.
10. That the commercial porkion of the project shall provide parking at a minirnum of
four spaces per 1,O�Q square feet exclusive of non-usable space, not to excesd
15% of the gross buitding area. lf, �ased on a review of the project, working
drawings (floor plans and grading plans) the project daes not meet the four spaces
per 1,OOQ square foot ratio, the project sha{I be reduced in size accordingly.
i f. That the applicant shall construct a bus turnout and shelter to be installed on Cook
Street, per direction of Special Programs memo dated February 16, 2006.
12. That the applicant shail obtain approval af Waste Management and the Director of
Community Devetopment for location of a11 an-site #rash enclosures.
13. That the project landscapir�g shatl be reviewed through the Ciry's Landscapa
Beautification Committee.
14. That the appiicant shall enter inta a Housing Agreement with the City Housing
Authorityto provide 20°/a of the units affordable to those households earnirtg 110%
af m+edian incame and shall make available an additional 2d°Jo of the units at market
rents established by a regional market survey.
Housing Authority shall have at its option the ability to pravide rental assistance to
"low" income households.
15. In addition to the minimum energy efficiency standards set forth in the current
edition of Title 24 Califomia Administrative Code (CAC), the project shal) incorporate
the energy efficiency features as specified in the memorandum from Pat Con(on
(Office of Energy Management) dated November 28, 2005 {attached). Clubhouse
shall have minimum 2 kw photovoltaic panels installed.

Landscaping maintenance of any cornmon areas and property frontages shal! be
provided by property owner and be water efficient in nature in accordance with the
City of Pafm Desert landscape design standards. Landscaping plans shaiS be
submitted for review simuttaneously with grading pians.
2. A complete preliminary soils investigation, conducted by a registered soils engineer,
shalf be submitted to, and approved by, the Department of Public Works pfior to the
issuance of a grading permit.
3. The maintenance o# the retention areas shali be by the praperty owner.

4. Drainage fees, in accordance with 5ectio� 2fi.49 of the Palm Desert Municipal Code
shall be paid prior to issuance of grading permit.
5. Signafizatian feas, in accardance with City of Palm Desert Resalution Nos. 79-17
and 79-55, shall be paid prior to issuance of grading permit.
6. The project shafl be subject to Transportation tJ�iform Mitigation Fees (TUMF}.
Payment of said fees shall be at the time of building permit issuance.
7. A standard inspection fee shall be paid prior to issuance of grading permits.

8. Stonn drainlretention area design and co�struction shatl be contingent upon a
drainage study prepared by a registered civi! engineer that is reviewed and
approved by the Oepartment af Public Works prior to start of construction. Project
is required to retain an-site the increase in flows for a 100 year storm.
9. Complete grading and improvement plsns and specifications on electronicfrles shall
be submitted to the Director of Public Works for checking and approv�l prior to
issuance of any permits.
10. lmprovement plans for utiiity systems shall be approved by the respective provider
or senrice districts with "as-built" plans submitted to the Department of Public
Warks prior to project final. U#ility plans shal! be submitted ta the public works
department for improvements in the public right of way prior to issuance of any
permits.

19 . Any and ai) offsite improvements shali be preceded by the approval of plans and the
issuance of valid encroachment permits by the �epartment of Public Works.
� 2. Pad elevatio�s, as shown on the tentative map dated 4-10-6, are subject ta
review and modificatian in accordance with Chapter 26 of #he Palm Desert
Municipal Cvde and shall take intp account future qrading of adjacent Lot 17.
13. Any entry gates for the project shall be set back 100 feet from the curb-line of the
adjacent street.
14. Waiver of access to Cook Street, Frank Sinatra Dnve, Callege Drive and University
Park Drive, except at approved locations, shall be granted on the plan.
REQUIREQ CONS�'RUCTION
15. Full public improvements required by Sections 26.40 and 26.44 of the Palm Desert
Municipal Code sfiall be installed in accordance with applicable City standards, i.e.
• 8' sidewalk on Cook Street and Frank Sinatra Dr., 6' sidewalk an University Park
and Cotlege Drives
• Qeceleration lane on Cook Street and Frank Sinatra Drive at project entr�tnces.
• Modify Cook Street median to accommodate a"left turn only fane in" at the project
entrance to be shared with future project at the Cook Street-Frank Sinatra Drive
corner.
Rights-o#-way necessary for the instailation of the above referenced improvements
sha41 be dedicated to the city prior to the issuance of any permits associated with
this praject.
16. All public improvements shall be inspected by #he Department af Public Works and
a standard inspection fee shall be paid prior to issuance of grading permits. No
occupancy permit shall be granted until public irnprovemen#s have been completed.
17. Tcaffic safety striping st�aN be installed to the specificatians of the Director of Public
Works. A traffic contrQl plan must be submitted to, and approved by, the Director of
Public Works prio� to the placement of any pavement markings.
18. A!I public and private improvements shatl be inspected by the Public Works
Departrnent.
i9. Applicant shall camply with provisions of Palm Desert Municipaf Code Section
24.12, Fugitive Dust Control as wefl as Section 24.20, Storm water Management
and Discharge Control.

20. Priorto the start af construction, the applicant shal! submit satisfac#ory evidence to
the Director of Pubfic Works of intended compiiance with the Nationai Pollutant
Oischarge Elimination System (NPDES} Genera! Construction Permit for storm
water clischarges assaeiated with construction. Developer must contact Riverside
County Flaod Cantrol Distr�ct for informational materials.

issuance of any permits associated with this project,
Fire De�artment:
That the project sha(I comply with City Municipal codes, appropriate NFPA
Standards, CFC, CBC and/ar recognized Fire Protection Standards.
