Backqround: The Assembly Committee on Rules would like to continue to lease Suite 116 for a local office for Assemblyman Brian Nestande. The amendment changes the lease term for an additional two years commencing on January 1, 2013 and terminating on December 31, 2014 with one two-year option to extend. The lease is designed as a full gross lease with the monthly lease payments set at $1,000 per month for the two-year period. There are no tenant improvements planned with the execution of this lease amendment. Sincerely, ��.`'".` � Richard Wagaman , RW:vm Enclosure Printed on Recycled Paper SEVENTH AMENDMENT TO LEASE This Seventh Amendment to Lease is made and entered into as of the 20th day of December, 2012, by and befinreen CITY OF PALM DESERT (the "Lessor") and the ASSEMBLY COMMITTEE ON RULES, CALIFORNIA STATE ASSEMBLY (the "Rules Committee"). RECITALS � A. The Lessor and the Rules Committee entered into a lease, dated November 18, 1998 (the "Lease"), whereby the Lessor leased to the Rules Committee certain office space located at 73-710 Fred Waring Drive, Suite 112, Palm Desert, CA 92260 (the "Premises"). The Original Lease was amended by that certain First Amendment to Lease, dated December 19, 2000, whereby the Premises was moved to Suite 108; by that certain Second Amendment to Lease, dated March 7, 2003; by that certain Third Amendment to Lease, dated November 24, 2004; by that certain Fourth Amendment to Lease, dated November 27, 2006, by and between the Lessor and the Rules Committee; by that certain Fifth Amendment to Lease, dated December 31, 2008, by and between the Lessor and the Rules Committee, in which the Premises was relocated to Suite 116; and by that certain Sixth Amendment to Lease, dated November 22, 2010, by and between the Lessor and the Rules Committee. The Original Lease, as amended by the First Amendment, Second Amendment, Third Amendment, Fourth Amendment, Fifth Amendment, and Sixth Amendment may be referred to herein as the "Lease". B. By this Seventh Amendment to Lease, Lessor and Rules Committee desire to extend the term of the Lease and to otherwise modify the Lease as provided herein. In consideration of the foregoing recitals and the mutual covenants contained herein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereby agree as follows: AGREEMENT 1. Rent. Rent shall be based on an occupancy of approximately 500 sf in the Premises and shall be One Thousand and 00/100 Dollars ($1,000.00) starting January 1, 2013. 2. Extended Lease Term. The Lease termination date shall be such that the Lease shall terminate on December 31, 2014. 3. Option to Extend. Lessor grants Rules Committee one (1) option to extend the term for the Premises for a period of two (2) years, subject to agreement between the parties as to fair market rent. 4. Name Chanqe. The name of Brian Nestande shall be substituted in alt parts of this Lease where an Assemblymember's name appears. Except as set forth in this Seventh Amendment, all of the provisions of the Lease shall remain unchanged and in full force and effect. In witness, thereof, this Seventh Amendment has been executed as of the day and year above written.
