Waive further reading and adopt Resolution No. 2013- 34 vacating
excess Public Utility Easement (PUE) and the Emergency Vehicular
Access Easement (EVAE) over a portion of Lot "A", Summit Cove, Tract
No. 28575-3, in Canyons at Bighorn.
Backqround
A lot line adjustment was approved May 7, 2013, by the Planning Commission under
Parcel Map Waiver 12-205, which basically removes the easterly 90 feet of Summit
Cove, a private street in Canyons at Bighorn shown as Lot "A" in Tract No. 28575-3,
from within Lot 6, a residential lot of the same tract map. As part of the lot line
adjustment process, Bighorn Homeowners Association, owner of Summit Cove, Lot "A",
will transfer/convey ownership of the aforementioned 90-foot portion of Summit Cove to
the owner of Lot 6. A PUE and EVAE exists within all of Summit Cove, Lot "A", and the
portions of the easements to be vacated are located within the easterly 90-foot portion
of Summit Cove.

The PUE to be vacated is considered excess by staff because there are no in-place
public utility facilities within said portion that don't already have a separate easement
provided, nor is there a future need for a PUE within this portion of Summit Cove, Lot
"A", because it will now be part of a residential lot. The City has received non-
interference letters from all utility companies. The Gas Company has relocated their
line, and Verizon and Time Warner had no facilities in the area to be vacated.
Coachella Valley Water District and Southern California Edison have their own
easements over Summit Cove, Lot "A", by separately recorded documents, so those
easements will be quitclaimed separately by those utility companies.
The subject EVAE is located within the same area of Summit Cove, Lot A". Both the
PUE and the EVAE were dedicated to the City and accepted on the map of Tract No.
28575-3 by City Council on December 14, 2000. The map recorded with the County of
Riverside on December 29, 2000.
The EVAE being vacated has not been used for its dedicated purpose by the Fire
Department for more than five consecutive years prior to this request (Lot 6 is a vacant
lot). The Fire Department has approved this request.
This particular case meets all of the requirements of a "summary vacation" pursuant to
the California Streets and Highways Code, Division 9, Part 3, Chapter 4, whereby the
vacation procedure does not involve an evaluation from the Planning Commission, nor
the scheduling of a public hearing.

There is no fiscal impact associated with this action.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, VACATING EXCESS
PUBLIC UTILITY EASEMENT AND THE EMERGENCY
VEHICULAR ACCESS EASEMENT OVER A PORTION OF
LOT "A", SUMMIT COVE, TRACT NO. 28575-3, IN

DIVISION 9, PART 3, CHAPTER 4 OF THE CALIFORNIA
STREETS AND HIGHWAYS CODE
WHEREAS, the subject vacation is made pursuant to the requirements of the
California Streets and Highways Code, Division 9, Part 3, Chapter 4; and
WHEREAS, the City Council of the City of Palm Desert considered such matter
and finds from the evidence submitted that the easements described in Exhibits "A" and
"B", attached hereto and made a part hereof, are in excess and are unnecessary for
present or prospective public purposes and that there are no in-place public utility
facilities within the described area that don't already have other easements for those
facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF PALM DESERT,
CALIFORNIA, AS FOLLOWS:
Section 1: That the public utility easement and the emergency vehicular access
easement located over a portion of Lot "A", Summit Cove, Tract No. 28575-3, be
vacated as described and as set forth in Exhibits "A" and "B", attached hereto; and
Section 2: That the City Clerk of the City of Palm Desert, California, shall cause
a certified copy of this resolution and order to be recorded in the office of the County
Recorder of Riverside County, California; and
Section 3: That from and after the date this resolution is recorded, the subject
portion of public utility easement and emergency vehicular access easement will no
longer constitute public service easements.

Subject: Request for the City of Palm Desert to Vacate a Portion of Easements Within Lot
"A"of Tract 285�5-3.
Dear Mr.Garner,
On behalf of our client, we are requesting that the City of Palm Desert vacate a portion of an
emergency vehicular access and public utility easement as shown on the attached Exhibit"B".
T'he emergency vehicular access and public utility easement was dedicated to the City of Palm
Desert as a "private street" per Tract Map No. 28575-3. This portion of Lot "A" will be
transferred to Lot 6, a private single family residence, via Parcel Map Waiver 12-205. This
portion of the emergency vehicular access and public utility easement is at the termination of
Summit Cave S�d only serves Lot 6. Once the City of Palm Desert agrees to vacate the
easement we wil notify the necessary utiliry agencies so they can remove their utilities from
the area. We are also requesting that the City of Pa1m Desert prepare a letter agreeing to the
vacation of the easements that RCE may share with the utility agency when requesting the
removal of their urilities. Additionally, CVWD has agreed to vacate their easement, we are
coordinating with them to remove the water and sewer mains from this area.
