Backqround 2013- 4i vacating excess Public the common line of Lots 8 and 9 of The subject PUE is located along the common line of Lots 8 and 9 of Tract No. 2184 on Fairway Drive between Fox Hills Court and Canterbury Court. The proposed vacation will rescind portions of two six-foot wide adjoining strips of PUEs. The PUE was dedicated to the County of Riverside and accepted on the map of Tract No. 2184 by the County Board of Supervisors on July 3, 1961. Said map recorded with the County of Riverside on July 5, 1961. The portions of the PUEs to be vacated are considered excess by staff because there are no in-piace public utility facilities within said portions, nor is there a future need for them. A house was actually constructed over the subject portions of the PUEs on Lots 8 and 9 of Tract No. 2184 in 1963. The common lot line is to be eliminated by Planning Commission action through a Parcel Map Waiver application. This particular case meets all of the requirements of a"summary vacation" pursuant to the California Streets and Highways Code, Division 9, Part 3, Chapter 4, whereby the vacation procedure does not involve an evaluation from the Planning Commission, nor the scheduling of a pubtic hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF PALM DESERT, CALIFORNIA, AS FOLLOWS: 1. That the portion of public utility easement located along the common line of lots 8 and 9 of Tract No. 2184 on Fairway Drive be vacated as described and as set forth in Exhibits "A" and "B" attached hereto; and 2. That the City Clerk of the City of Palm Desert, California, shall cause a certified copy of this Resolution and order to be recorded in the Office of the County Recorder of Riverside County, California; and 3. That from and after the date that this Resolution is recorded, the subject portion of public utility easement will no longer constitute a public service easement.
