Approve Outside Agency Funding Committee's FY 2013/2014 Community Development Block Grant (CDBG) funding recommendations as proposed; 2. Approve FY 2013/14 CDBG One-Year Action Plan; 3. Approve CDBG Five-Year Consolidated Plan; 4. Authorize the City Manager to sign CDBG One-Year Action Plan Certifications; and 5. Authorize staff to submit the CDBG Action Plan and Strategic Plan to the U.S. Department of Housing and Urban Development (HUD). Executive Summary The Outside Agency Funding Committee met on Thursday, March 7, 2013, to review the Community Development Block Grant (CDBG) applications for FY 2013/2014. The table below reflects the funding recommendations of the Committee for this grant cycle. The City has not received notice from the U.S. Department of Housing and Urban Development (HUD) of its FY 2013/14 CDBG allocation; therefore, the proposed awards are based on the FY 2012/2013 CDBG allocation in the amount of$283,181. In addition, the City had $35,357.85 in previous year un-programmed funds that were reallocated as part of this process. Based on the two funding allocations, the total CDBG funds available to award is $317,538.85. Once HUD has notified City staff of the actual FY 2013/2014 allocation, all projects will be reduced/increased equally, if a change in allocation occurs. In addition, the Five-Year Consolidated Plan and One-Year (FY 2013/2014) Action Plan was submitted to Council for review prior to May 9, 2013, Council meeting. STAFF REPORT FY 2013/14 CDBG OUTSIDE AGENCY FUNDING RECOMMENDATION, ACTION PLAN AND CONSOLIDATED PLANS APPROVAL MAY 23, 2013 PAGE 2 OF 11 At the May 9, 2013, City Council meeting Councilmember Robert Spiegel requested staff to determine whether the Palm Desert Charter School lunch shade structure could be assist through CDBG funds. After discussing the project with Ms. Sallie Fraser, Principal and reviewing CDBG eligible criteria it was determined that the school does not qualify for two reasons (1) the school only has 47% low-income students; however, CDBG requires that 51% of those served must be low-income; and (2) regardless of percentage of low-income, the only type of school CDBG funds could be utilized for are schools for higher learning. Backqround It should be noted that qualifying programs/projects funded through CDBG must meet one of the three National Objectives of CDBG as identified, which are: 1) to benefit low and moderate income (51% or more must be low income) persons; 2) to aid in the prevention of or elimination of slum or blight; and 3) to meet an urgent need such as a natural disaster. On March 7, 2013, the Committee reviewed all CDBG applications received and made recommendations for funding as outlined in the tables below. The tables below outline all CDBG applicants who submitted an application, the funding recommendation, the proposed award amount, and the original amount requested by each organization. Those applicants listed in the recommendation for funding column have been identified as potential funding recipients. The award distribution formula as stipulated by HUD is provided below and reflected in the awards as shown in the tables below: � 15% (maximum) for public service; � 20% (maximum) for administration; and • 65% up to 85% (if all 20% administration funds are not utilized) for capital improvement projects. The specific funding recommendations for each category is Capital Improvement at 65% _ $219,425.85 (including un-programmed funds); Pubic Service at 15% _ $42,477, and Administrative at 20% _ $56,636. (The only category that may exceed the maximum cap is Capital Improvement.) City Administrative Costs $25,600.00 (Davis Bacon, NEPA,Analysis to Impediments(HI) issues, and staff costs Totals: $56,636.00 The Committee based its funding recommendation on organizations with programs that provide the most benefit to the Palm Desert Community, identified needs within the community (e.g., homeless and food), previous funding history, type of program and target recipients, new programs, benefit to Palm Desert residents, and if the programs qualified for CDBG funding. See notes in the attached table for specific reasoning of funding recommendations made pertaining to each applicant. Note: The Outside Agency Funding Committee directed $15,000 be awarded to the FIND Project, if project/organization was identified by HUD as qualifying. Also, if the organization provided food directly to very low to low-income individuals, then they would meet a National Objective; however, they provide food directly to other non-profit organizations not clients. As a result, as approved by the Committee, the $15,000 was awarded to Desert Aids Project. In addition, since the City's current Five-Year Consolidated Plan expires at the end of the FY 2012/2013 cycle, a new Consolidated Plan was required to be undertaken and approved by City Council as well as the Annual One-Year Action Plan for FY 2013/2014. Both documents were completed and submitted to City Council prior to the Public Hearing to provide adequate time for review. The documents outline what the City plans to undertake during the short and long term. The Consolidate Plan covers the time period for FY 2013/2014 to FY 2017/2018 and includes the first year Action Plan for FY 2013/2014. Council will only be required to approve the Annual Action Plan separately starting with next year's (FY 2014/2015) funding cycle and continue until FY 2017/2018 at which time a new Consolidated Plan will be required. Staff will monitor the subrecipients until funded programs/projects have been completed through various means such as on-site visits to the organizations; monthly, quarterly and annual reports; phone calls; emails. If capital improvement type projects, staff will be on- site throughout the project to monitor progress of work as well as to conduct random employee interviews of the contractor and subcontractors, which is required as part of Davis-Bacon Prevailing Wage regulations. City Council's final approval of CDBG applicants and awards will be included within the One-Year Action Plan and submitted to HUD upon approval. The City will open the public hearing scheduled for Thursday, May 9, 2013, at 4:Q0 p.m. or thereabouts and continue the public hearing to Thursday, May 23, 2013, at 4:00 p.m. or thereabouts at which time Cauncil will accept public comments related to the Community Development Block Grant (CDBG) Program and related items stipulated herein. Anyone interested in providing input to inclusion into the proposed Final Plans is encouraged to attend the meeting or contact the City staff person designated below. The hearing will be held in the Palm Desert Civic Center, Council Chambers located at 73-51 Q Fred Waring Drive, Palm Desert. The City, as part of the existing Consolidated Plan process completed a Needs Assessment of which is also available to assist in providing public comment. If desired, a copy may be obtained from the City's website at www.citvofpalmdesert.org or by request to the City of Palm Desert's Special Programs Department. The City as part of the Citizen's Participation Plan will also accept pubtic input until May 23, 2013, by 5:00 p.m. The City, as part of the Consolidated Plan and Action Plan process, will make available the proposed Final Plans upon request at the following location: Palm Desert Civic Center at 73-510 Fred Waring Dr., Palm Desert, CA 92260. The general public may request a copy of the document by contacting City Hall at(760) 346-0611, ext. 331 or by picking up a copy at the above location from 8:00 a.m. to 5:00 p.m., regular business hours.
