Upon Motion by Commissioner Thompson and second by
Commissioner Bussing, the Minuies of June 19, 2013 were approved
unanimously with Commissioner Darby absent.
V. DISCUSSION ITEMS
A. ORAL REVIEW OF CITY COUNCIL ACTION —
Councilmember Susan Marie Weber
Ms. Schwartz announced that Commissioner Kim Snyder
resigned from the Art in Public Places Commission.
B. PLANNING COMMISSION REPORT— Ken Stendell
Mr. Stendell reported that at its meeting of July 2, the
Planning Commission reviewed the request from Palm
Desert Country Club to change the previously approved
location of its maintenance yard to a different location within
the site. Because many residents were opposed of the new
location, the applicant withdrew its request and will build the
facility in the original location.
At its meeting of July 16, the Planning Commission approved
32 single family homes located on Shepherd Lane and Julie
Court.
C. ARCHITECTURAL REVIEW COMMISSION REPORT —
John Vuksic
Mr. Vuksic reported that the Architectural Review
Commission approved final construction drawings for the
remodel at 111 Town Center where Whole Foods and
Nordstrom Rack will be housed. Construction drawings for
the remodel at the north end of Westfield Shoppingtown
where Dick's Sporting Goods will be were approved. The
Architectural Review Commission reviewed and approved
color schemes for the Village at University Park (Cook Street
and Gerald Ford Drive) as well as a professional building on
the east side of San Pablo. The proposed color scheme was
denied for the PGA Tour Superstore that will occupy the old
Mervyn's building in Waring Plaza. The developer will come
back with a revised color scheme for review and approval.
The Starbucks on San Pablo and EI Paseo received
approval for a color change, railings, and an awning with a
more contemporary design.

VII. NEW BUSINESS
A. CONSIDERATION OF PROPOSAL OF "LAKE CAHUILLA
PALMS" BY LARRY AND NANCY CUSH AS THE PUBLIC
ART COMPONENT FOR THE COACHELLA VALLEY
WATER DISTRICT'S STEVE ROBBINS ADMINISTRATION
BUILDING LOCATED AT 75-515 AND 75-525 HOVLEY
LANE EAST
Ms. Schwartz reminded the Commission of the public art
project that the Coachella Valley Water District (CVWD)
brought before the Commission and City Council in April
2012. The proposal consisted of an interior public art project
for which the City granted a waiver to allow CVWD to move
forward with it. Following the approvals, the project was
presented to the CVWD Board which denied it. Ms.
Schwartz met with CVWD staff to look at the proposed art
site and encouraged them to consider an exterior project.
Ms. Schwartz introduced Larry and Nancy Cush, the artists
for the proposed project. Ms. Cush presented the project
that will consist of ceramic tiles placed on a 54 foot length
wall, six feet in height (facing Hovley Lane East) depicting
Lake Cahuilla and fan palms with mountains in the
background. They will also create a mosaic bench for the
site. The current landscaping will be enhanced and will also
include blue cobbles that will create a water effect through
the landscaped area. Ms. Schwartz referred to the agenda
packet that included an overall rendering of the project. Ms.
Schwartz informed Heather Engel that their staff will need
the City's landscape department to review the landscape
plan. Ms. Cush noted that the plants will be indentified.
It was moved by Commissioner Bussing and seconded
by Commissioner Thompson to accept the proposa/ of "Lake
Cahuilla Pa/ms" by Larry and Nancy Cush as ihe public art
component for ihe Coachella Valley Water Districi's Steve
Robbins Administration building /ocated at 75-515 and 75-525
Hovley Lane East. Motion carried unanimous/y with
Commissioner Darby absent.
The artists mentioned that the art project will probably be complete
at the end of November.

B. APPROVE CHANGE TO THE ART IN PUBLIC PLACES
COMMISSION MEETING DAY FROM THE THIRD
WEDNESDAY TO THE SECOND WEDNESDAY OF THE
MONTH
Ms. Schwartz asked the Commissioners to consider
changing the Art in Public Places Commission meeting from
the third Wednesday of the month to the second Wednesday
of the month. Holding the meetings on the second
Wednesday of the month would enable staff to better serve
the needs of projects that require City Council's approval.
Ms. Schwartz stated that the City Council meetings are held
on the second and fourth Thursdays of the month. Most
items that are approved by this Commission need to be
approved by City Council. In order for staff to prepare for the
City Council meeting, the deadline for staff reports, which
have to be written for all projects brought before City
Council, is the Tuesday prior to the Council meeting. This
change will allow for public art projects to be placed on the
agenda of the second Thursday City Council meeting
instead of holding the items until the following month.
It was moved by Commissioner Hough and seconded by
Commissioner Mlller to approve the change of moving the Art
in Public P/aces Commission meeting from the third
Wednesday of the month to the second Wednesday of the
month beginning October 9y 2013. Moiion carried
unanimous/y with Commissioner Darby absent.
C. CONSIDERATION OF ARTISTS TO BE INCLUDED IN
CITY OF PAM DESERT'S ARTIST REGISTRY
The following artists applied to be included in the City of
Palm Desert's Artist Registry. Laurel Porcari and Kipp
Kobayashi.
It was moved by Commissioner Hough and seconded by
Commissioner Miller to inc/ude artists Laure/ Porcari and Kipp
Kobayashi in the City of Pa/m Desert's Artist Registry. Motion
carried unanimous/y with Commissioner Darby absent

X. PROJECT STATUS REPORTS
A. Palm Desert Community Gallery
Ms. Schwartz reported that the reception for the exhibition,
"Fresh from the Fields" with Careen Moore and Regina
Kirillov was on Monday, July 1, and was well attended.
B. Docent Program
Ms. Schwartz will be training a new group of docents in the
fall.
The docent program is quiet right now, but a few group tours
have been scheduled for October and December.
XI. REPORTS AND REMARKS
A. STAFF
Due to questions that arose in the May 2013 Art in Public
Places Commission meeting, Ms. Schwartz asked Ms.
Aylaian to explain the roles of the Planning Division,
Planning Commission, and the Architectural Review
Commission (ARC) to the Art Commission.
Ms. Aylaian explained that the Planning Division is
responsible for the Planning Commission and the
Architectural Review Commission each of which is an
independent review body. She stated that projects are
typically reviewed first by ARC, then Planning Commission,
then City Council for final approval. The City staff, as a
whole, is trying to implement the policy makers' vision of
Palm Desert and how it should develop and be built out.
Every ten to twenty years the City develops a strategic plan
which engages citizens from the communiry to give their
vision and speak their interest in how the City should
develop. Once completed, the strategic plan gets adopted
by the City Council. The General Plan is then prepared and
adopted as Palm Desert's "guide" of physical development
for the next ten to twenty years. The most recent strategic
and general plans stated that Palm Desert will be a high end

golf resort community with a small and denser university
element in the north end. The City has accomplished almost
everything stated in the last Strategic Plan and is now
looking ahead to see what direction it is going to take during
the next twenty years.
At its May Art in Public Places meeting, a few of the
commissioners were concerned that another grocery store
may occupy the old Toys R Us store at the southwest corner
of Highway 111 and Fred Waring Drive. The concern was
what happens to the other specialty grocery stores that are
in the surrounding area when a larger chain grocery store
moves in and now there are multiple grocery stores. Ms.
Aylaian explained that the City does not control the market,
but establishes a structure in which individual, private
enterprises come into Palm Desert, execute their business
plans, and dreams. They can propose what they want to do
as long as they live within the framework of what is
developed in its vicinity. The City does not target a specific
business and entice it to do business in Palm Desert. The
City wants to set the stage so that there are low taxes and
fees so that businesses want to be in Palm Desert. The City
strives to be clean and neat with good code enforcement to
attract business owners and visitors. What happens, for
example, to surrounding grocery stores if a Wal-Mart
Grocery Store opens? There is a possibility that surrounding
stores could go out of business. The appropriate number of
grocery stores for residents will be achieved through the
market if we let the market operate freely.
Ms. Aylaian talked about the ordinance for covered parking.
She stated that a certain number of trees are required to be
planted per so many parking stalls. The property owners
provide trees and the trees can thrive, or the business who
maintains them may not know better, and cut them such that
the trees do not provide shade. A majority of the time the
trees do not do well in parking lots as it is too hot. Carports
can be expensive for the property owners, but are also
permissible for providing shade.
As far as zoning, every piece of property in town is assigned
a zone, and there are fifteen to twenty zones. Each zone
has regulations regarding how much and what type of
building it can have, how tall it can be, the number of parking
spaces required, the amount of landscape it has to have,
etc. The City has commercial zones, residential zones, and

agricultural zones as well as service industrial areas. The
Planning Division has to ensure that businesses are placed
in the proper zone.
B. COMMISSION MEMBERS
Commissioner Miller stated that she met someone who was
in charge of the World Chess Hall of Fame - A Queen Within
project, and would like to see it at the Palm Springs Art
Museum in Palm Desert. Ms. Schwartz referred her to
Commissioner Hough to possibly coordinate it with the Palm
Springs Art Museum.

Commissioner Bussing moved to adjourn the meeting at 10:10 a.m.
Motion was seconded by Commissioner Hough.
