Backaround
Based on a review of the subject Claim and the recommendation of the Claims Adjuster,
Risk Manager, City Attorney, and staff, it is recommended that the Claim be rejected.
Discussion of this item should be held in Closed Session pursuant to Government Code Section
54956.9(b), potential litigation.
Fiscal Analvsis
City of Palm Desert participates in the self-insurance pool of the California Joint Powers Insurance
Authority (CJPIA). Action to reject the subject Claim does not have a fiscal impact on the City at
this time.

Hello Everyone:
I want to make you aware of a potential claim resulting from a non-injury single vehicle traffic incident
because of a sinkhole in the City. The sinkhole was subsequently found to be a resuit of a sewer line
and the Coachella Valley Water District is conducting the repair work. The following is a link to the
recent newspaper article on the matter:

Please note where the motorist, Mr. Ron Chan, is quoted as saying, "The cify didn't really take care of

think that's right fhe city can get away scot-free while peoples' lives are at risk."
I wilf be completing an incident report on the CJPIA website and forward the traffic incident report
once I receive it from the Police Department.

2315 hours — Deputies P. Mushinskie and Overton responded to Cook Street and Sheryl
Ave in reference to a single vehicle traffic collision. The investigation revealed the
vehicle was iraveling south on Cook Street approaching Sheryl Ave. The driver decided
to conduct a u-turn and drove into the left hand turn lane at which time the pavement
opened up. The vehicle's drivers side front wheel fefl into the hole. Nobody was
injured. Palm Desert city roads and CVWD were summoned and arrived on scene to
take care of the situation.

The Riverside County Sheriff's Department called the sinkhofe in ai
11:53 p.m. Monday, when the car's front tires became stuck in the 5 Mational prescription

like 1:30 a.m.," she said.

The tuming iane hote is about 20 feet by 10 feet and drops 12 feet
to a broken sewer line — thought to be its cause.
One lane of northbound Cook and the northbound tuming lane from
Cook onto Sheryl are closed to traffic to accommodate a convoy of
seven CVWD vehicles, including an excavator and a dump truck,
but delays were minimal Tuesday moming.
CVWD hoped to have the sinkhole filled by day's end, but there is
currently no timetable for completion, Engel said.
The repair crew uncovered a break at the top of the sewer line,
wMich potentially leaked sewage — softening the surrounding
ground. But the sinkhole could just as easily have been caused by
whatever cracked the piping.
No sewage leaked outside the sinkhole, according io a CVWD
news release, and water and sewer services remain unaffected.
"What the crew has done is taken the sewer line out of service and
directed sewage into other pipeline to guarantee there's no
disruption in service," Engel said. "We know that any of the sewage
leaked was minimal and did not reach the surface."

CVWD is handling the repairs because it provides about 108,000
residential and commercial customers across 1,000 square miles of
mostly Riverside County with water, agricultural drainage,
wastewater treatment and reclamation, storm water protection,
groandwater management, and water conservation.
It's at least the second time this summer that valley crews have
worlced on a sinkhole.
A water main ruptured and created a sinkhole July 9 on
Washington Street in La Quinta.
