REQUEST: Review status of building at above -location

Discussion:
The Council has expressed concern regarding the on -going condition of 73340
Highway 111/McGowan's Irish Pub. I have reviewed the current City Ordinance both as
a public nuisance and/or as an abandoned building. The building was "partially
destroyed by fire". The property could at some point be determined to be in violation of
Chapters 8.70 or 8.21 of the City Code. Such a violation can be remedied by actions of
the Owner to clean and secure the building and area. The Owner and City Code
Enforcement have been in discussions over a substantial period of time. The structure
and area have been secured by the Owner in accordance with the requirement of City
Staff and can be retained in that manner for some reasonable period of time.
It is my understanding that there is a dispute between the Owner and insurance
company. If and when that dispute is resolved, the property will be refurbished and re-
leased and/or sold. The Owner does have a local agent who is also dealing with the
property and insurance company.
I do have available a copy of the City's file indicating all of the contacts and
communications with the Owner if you would like to review same.

In regards to your July letter I had already spoken with Mrs. More in regards to
the PBL property that as soon as I would settle with the insurance I would do
what was necessary and put the property up for sale or lease. There are still
some items remaining to deal with the Insurance but my agent Mr. Jack
Easum has been preparing the property and has complied with the infractions
that your code enforcement officer Mr.Terfehr had requested so I felt you
would get the reports.
Both Mrs. More and Mr.Terfehr have the phone numbers of my attorney
Simone and my agent Jack Easum who has completed the clean up and will be
installing front doors so that the property can be shown.
In regards to the front of the building I do not quite understand what you want
however not knowing what the use of the building would be it may be a waste
of money so it would be more prudent to have the new owner use the City
matching funds.

Dear Mr. Puluqi:
The City of Palm Desert has not yet received a response to its letter to you dated July 9,
2013, regarding the status of your property located at 73-340 Highway 111, Palm Desert,
California, formerly leased to McGowan's Irish Inn. Therefore, I am following up to inquire
as to the status of the property and your interest in a facade enhancement program
application for that location.
As you are aware, a fire occurred at the property last summer, and the building has been
boarded shut since that time. I understand from your conversation in May with Economic
Development Manager Ruth Ann Moore that you were completing your negotiations with the
insurance company and would then be putting the property on the market for sale or lease.
The property, in its current state, reflects poorly on Palm Desert's main access corridor, and
I would like to give the City Council a progress report as to the timeline for your renovations.
The City Council has asked me to investigate Code Enforcement options if your property
does not come up to community standards in the very near future.
As noted in our previous letter, your property may qualify for a facade enhancement
program which the City will be re -instituting in the next month. Ms. Moore can assist you
with this should you like to consider applying for the matching funds. In addition, she may
be able to offer assistance with potential businesses to fill the space.
