Recommendation
By Minute Motion, concur with staff's recommendation to retain the existing Regular City
Council Meeting schedule on the second and fourth Thursdays each month, concurrently
with Successor Agency, Housing and Financing Authority Meetings, and time as set forth
in Resolution No. 02-57, with the regular meeting convening at 3:00 p.m. and adjourning
to Closed Session, reconvening the regular meeting at 4:00 p.m. for the conduct of regular
business and public hearings.
Background
On August 2, 2013, Ms. Terry Wood submitted a request, including a petition of 31 Palm Desert
residents'/business owners' signatures, seeking the City Council move its regular meeting time
to 5:00 p.m. on the second and fourth Thursdays each month.
Upon its incorporation, Palm Desert City Council Meetings were scheduled for 7:00 p.m. on the
second and fourth Thursdays. As meetings became longer and longer due to substantial
testimony and debate, Council decided to conduct pre-meeting Study Sessions before each
Council Meeting to receive presentations and ask questions of staff to help streamline the regular
meeting that followed. In November 1985, Councilmembers agreed to do away with the practice
of conducting pre-meeting Study Sessions and change the regular meeting time to 4:00 p.m. The
first meeting held at4:00 p.m.was December 12, 1985, and on May 8, 1986, Council directed staff
to permanently set the schedule for a 4:00 p.m. start time, and it has remained as such ever since,
with some slight variation observed as to conducting a dinner break and Closed Session during
the meeting that convenes at 4:00 p.m. Members of the public are free to come and go from the
meeting at any time once it begins (i.e., they do not have to be present at convening in order to
participate). Responding to question raised in the petition, Palm Desert City Council Regular
Meetings have never been scheduled to begin at 6:00 p.m.
Palm Desert has a very participatory form of governance. Most Council agenda items are brought
through one or more of our some 16 standing Committees/Commissions before being heard by
the entire City Council. The majority of the City's standing Committees/Commissions

meet some time befinreen 8:00 a.m. -5:00 p.m., Monday- Friday; the Planning Commission and
Youth Committee being the only bodies each with a 6:00 p.m. start time.
In order to provide City Council and the public with the most amount of time available to review
the agenda and its contents, Palm Desert typically posts its upcoming agenda at least six (6)
days in advance of the meeting. Minimum requirements per The Ralph M. Brown Act are three
(3) days (72 hours) in advance. Additionally since November 2011, the City website also
contains a feature whereby all staff reports and relevant back-up, including supplemental
information received up to the time of the meeting, is available to the public. It is also usually
available by 5:00 p.m. the Friday prior to the regular meeting date. Members of the public can
comment on agenda items by sending an e-mail,fax, or letter to the Council;they can telephone
City Hall and leave a voice message with their thoughts on an agenda item, or they may come
in person to the meeting to express their comments publicly for the record. Note, all
correspondence received on any agenda item prior to the meeting is retained for the record with
the subject file.
Since November 2011, City Council Meetings are live web-streamed from the City website.
Further, alt past meeting videos and audio recordings from that date forward are also available
24/7, providing the ability for a viewer to see the entire meeting or skip directly to review only the
portion of their choosing by clicking on it from the linked agenda for that date.
Fiscal Analysis
If the meeting time were to be changed, General Fund impact would be minimal, with all City
Department Heads and Managers being exempt from overtime, and only a very few employees
required to be at Council Meetings being eligible for overtime or a varied work schedule to
accommodate a later meeting start time. However, a time change may impact the scheduling
of Palm Desert Police Officers who attend Council Meetings for security purposes. Further, it's
possible that with a later start time, Council would desire to have a dinner break. Catering a
meal to City Hall runs around $300 per occurrence, and some ancillary staff members would be
necessary to meet the delivery and help set it up.

Sumrnary: The City of Palm Desert started off as more of a seasonal tourist/second home
community years ago, but in the last 12 years it has transformed into a majority c�f at least 70%
plus stable fulltime residents who live here all year long. In addition, many Palm Desert
business owners who contribute to our tax revenue also reside here as well. I have spoken up
before at meetings in the past and also when I was running for an council seat with regard to
moving the council meeting time to 5p.m. , so that citizens of Palm Desert and business
owners here can attend meetings to be informed and to be heard. The city talked about being
more transparent and people want to know when decisions of taxpayer money is being made
instead�of afterwards when council has voted already. Whenever I am out around town many
business owners have told me that the 4p.m. meeting tirne does not work for them and
citizens can't make it because they are still at work at 4p.m. Meetings should be for the
convenience of the taxpayers and not set for a preference of paid elected officials. Other
committee and commission's meet at bp.m. or later with"city officiai such as city manager or
legal counci{ residing etc. It would not affect payroll if staff could come in later twice a month,
so there wouldn't be overtime. Also, at one time Palrn Desert's rneetin;g�vere at 6p.m.

was now complete; Fred Waring and Monterey was significantiy
complete by last evening, with a few manhole adjustments occurring
and traffic signal loops still being installed, but less lanes closed
during construction periods now. He added that the City's received
a number of positive comments about the new condition of
Highway 111.

, a) Signed Petition from Terry Wood - Council Meeting Time —
Councilmember Weber asked that the letter and petition submitted by
Ms. Wood, where several people are asking City Council to consider
changing the time of its meetings from 4:00 p.m. to 5:00 p.m. so that
business owners can attend them be considered.
Mr. Wohlmuth said staff could do so, noting that Council Meeting
times are set by resolution. He asked if the meeting time was moved
to 5:00 p.m., if it would also include scheduling Study Sessions for a
later start so that members of the public were better able to attend.

Councilman Tanner said he understood there was some concern,
he'd previously been asked about it. However, 30 people signed a
petition asking Council to move its meeting to a later start time, and
he wondered if that was sufficient groundswell to make a change. He
felt this could prompt requiring it be looked at over and over whenever
someane asks. He agreed it should be discussed but was unsure it
should be acted upon. Councilman Spiegel noted there are 50,000
residents in total.
Mayor Harnik pointed out that this would qualify as one of the
"Suggested Items for Future City Council Meeting Agendas,"and now
that Councilmember Weber has asked, it can be considered. She
observed that it was important to remember many of Palm Desert's
business owners are in the hospitality industry, and many of them
operate at night. So that 5:00 p.m. may then exclude that segment
of the community; it was a moving target and would be difficult to
please every business owner. She added that's why the meetings are
now live-streamed and delay-broadcast, and the videos are also
archived on the website for viewing anytime.
Councilmember Weber concurred that if it was placed on the agenda,
members of the public can show up and address the Council and
there can be discussion about it, and direction can be given.
Mr. Wohlmuth responded that this is certainly a policy issue, staff
would prepare an agenda item forthe Council. He noted that he'd not
received any complaints over residents being unable to make the
4:00 p.m. meeting times twice a month in his four years as City
Manager. However, he'd be happy to place on the agenda for
discussion.
Councilmember Weber didn't think staff should spend an inordinate
amount of time trying to analyze an�thing yet, just make it a
discussion item for input.

Councilman Spiegel reported that over 29 qualified people applied for
the General Manager position at SunLine. That list was pared down
to four; two candidates from the West Coat and two from the East
Coast. He said all four of those candidates were qualified to run the

PALM DESERT, CALI�ORNIA, SETTING THE T1ME AND P�ACE OF
REGULAR MEETINGS OF THE PALM DESERT ClTY COUNCIL
WHEREAS, the City Council of the City of Palm Desert, California, established
the time and place for its regular meetings by adapting Ordinance Nos. 2, 75, and 83;
and
WHEREAS,on November 14, '1985,the City Caunci!voted to adopt an amended
agenda farma# for its r.egular rneetings an the second and fourth Thursday of each
month, each regular meeting to begin at 4:00 p.m., with the regular session to run until
6:00 p.m., the observance of a dinner break from 6:00 p.m. to 7:40 p.m., and
pubfic hearings scheduled for 7:Oq p.m., with consideration of any items held over from
the 4:0� p.m. session to be considered thereafter; and
� WHEREAS, on June 22, 2000, #he City Council voted ta amend its reguiar
' meeting schedule sa that all items, inciuding public hearings,be schedufed for4:00 p.m.,
with the Mayor/Mayor Pro Tem and City Manager authorized to review the
Posted Agenda for exact order of consideratian, reserving the right to hold items to

Councilman Spiegel moved to waive further reading and adopt Resolution
No. 02-57. Motion was seconded by Kelly and carried by a 4-0 vote, with Councilman
Ferguson ABSENT.

XI. NEW BUSINESS
A. REQUEST FOR APPROPRIATION OF FUNDS FROM DRAINAGE FUND ~"
NO. 232 FOR THE PROJECT KNOWN AS "TRAFFIC SIGNAL, STREET,
STORM DRAIN, AND WATER IMPROVEMENTS AT COOK STREET AND
FRANK SINATRA DRIVE (CONTRACT NO. C19620,
PROJECT NO. 678-01)."
Mr. Ortega noted that this was a bookkeeping item and that Council had
previously approved the project but had not appropriated the storm drain
funds.
Councilman Spiegel moved to, by Minute Motion, appropriate $239,030 from
Drainage Fund No. 232 to construct the storm drain system associated with the subject
project—there is no net effect on the contract awarded to Granite Construction Company
on April 25, 2002. Motion was seconded by Benson and carried by a 4-0 vote, with
Councilman Ferguson ABSENT.
B. CONSIDERATION OF ALL-WAY STUP CONTROL AT THE
INTERSECTION OF SHADOW MOUNTAIN DR1VE AND
IRONWOOD STREET.
Mr. Ortega noted the staff report and recommendation in the packets and �
stated that this was the subject of discussion earlier in the meeting.

Upon reconvening the meeting at 7:02 p.m., Mr. Erwin announced
� that on a 4-0-1 vote of the City Council, with Councilman Ferguson
ABSTAINING, approval was given for the Joint Exercise of Powers
� Agreement relative to the proposed Municipal Electric Utility, subject
to the approval by all affected cities in the Southern California Edison
service area, further arranging for the cities of Palm Springs and
Rancho Mirage to contribute their respective shares of the cost of the
study to date.
C. CITY CLERK
� 1. Mrs. Klassen reminded the City Council to adjourn today's
meeting to 3:00 p.m. on Thursday, May 23, 2002, in order to
conduct Closed Session.
With City Council concurrence, staff was directed to take the appropriate actions
that would allow all regular City Council and Redevelopment Agency Meetings to
convene at 3:Q0 p.m. for conducting Closed Session, with the regular session and
public hearings to convene at 4:00 p.m.

� A. CONSIDERATION OF THE SETTING OF PUBLIC HEARINGS.
With Council concurrence, this matter was added to the Agenda far Council consideration.
CounciIman Kelly suggested that Public Hearings be set earlier in the Council meetings so that
they can be considered prior to 7:00 p.m. if time permits.
Councilman Spiegel suggested that the meetings be planned for 4:00 p.m, to 6:00 p.m. Ifthere
is more business to be done,the Council can take a dinner break for one hour and then reconvene
to complete items held over from the 4:00 p.m. session.
Councilmember Benson stated that the purpose afthe 7:00 p.m. portion was to accommodate the
people who worked and could not attend the 4:00 p.m. session. She said she would have no
objection to the change as long as there is still some mechanism to allow items requiring public
input to be held until 7:00 p.m.
Mayor Pro-Tem Ferguson suggested advertising everything for 4:00 p,m. and then leave it up to
the discretion of the Council to put things over to a 7:00 p.m. hearing if either time or public ,,,.�,
interest demands it.

Councilman Spiegel moved to, by Minute Motion, direct staffto (on a trial basis) change the Agenda
order to provide notification of and agendize public hearings for 4:00 p.m., with the Mayor/Mayor Pro-Tem
and City Manager to review the Posted Agenda for exact order of consideration, reserving the right to hold
items to 7:00 p.m, if either time constraints or pubiic interest demanded. Motion was seconded by Benson
and canied by a 4-0 vote, with Mayor Crites ABSENT.
Upon motion by Spiegel, second by Benson, and 4-0 vote of the City Council with Mayor Crites
ABSENT, Mayor Pro-Tem Ferguson adjourned the meeting at 7:17 p.m.

Mr. Altmen reported thet the Police Oepartment would
be working with the enflfneer f�r thls proposed �
extenslon 1n stopping motorists on both Masht�gton �
Street and Bob Hope Drive to dete�mine where they
were dr i v i ng from , where they were gotng, end the
length of the trip. He said this data wes requtred
by Caltrans ss ,��stificetion �or the extension. He
said that if tr�ffic started to back up, ca�s wouid
be let th�ough until it eased.
' 2. ECONQMIC DEVELOPMENf CO#iMITTEE
I
Mr . Aitman reported that this committee had met
three tirnes . He said that this committee� as well
as the 2000 committee , Nas recommenaing e hotel
clrcle for the north sphere of the City. He added
that the committee was recommendtng that the C1ty
Council approve an Z18, 000 expendlture so thet the
economic consultant could look at this concept ss en
add-on to his originai contract. He said that the
draft economtc analysis was tn , the committee had
already ioaked at it , and it Would be before the
Plenning Commission and City Counctl 1n the r�ear
future.

Councilmember Benson stated that a resident of
indlan Springs Mobilehome Pa�k had contacted her
about a photo aibum shoWing this construction from
stert to finish and askf �g tf the Ctty would like
it . Mr. Folkers safd the City would love to have it .
4. TRAFF[C MITIGAtION F�ES
Mayor Kelly read the following prepared stateme�t :
"We all talk about vrderly development; we all talk
about traffic problems ; Ne all agree we must mitigate
adverse environmental impacts . In the Coachella
Valley , the ma,�or adverse envtronmental impact in
development is traffic congestion . [ f Palm Oesert
had no development , we would still be adversely
affected by development of other cities around us
and anywhere in the Coachella Valley. A plan and a
way needs to be developed with al1 othe� cities in
the Coachelia Valley. Orange County has a computer-
fzed system where developme�t mitigatton fees are
charged to each development in relatio�ship to the
trafftc generated by that development with the fees
to be used for common proJects . I propose that the
City of Palm Desert take the lead in proposing a
,�oint poNers agre�ment between the nine cities and
the County in the Coachella Vaiiey to develop such a
formula end assessment of fees . The fee� collected
would be used for the trafftc probiems cornmon to all
communitles generated by deveiopment . It could be

Mr. Altman said this dealt wlth en ordtne�ce whlch
enabled the City to tnstall. public lmprovements end
to bill property owners at a later time in an effort
to correct immediate problem areas. He stated that
the Public Works Director had pre�e�ted Couneil
with a list of proJect pr(orities at a cost of :1 .2
mtliton, end staff now asked for suthorizetion to
seek the servlces of a consulting engineer as well
as the eppointment of Mayor Kelly end one other
member of the Council to serve on a subcommlttee to
assist in meeting with vartous property owners who
will be impacted by thts ardinance. He felt that
the Ctty should initially focus on Portola Avenue
and Cook Street lmprovements for earliest posstble
completion but also look at �ur financing plan and
see how it dovetails with other proJects such as the
curb and gutter proJect. '
Councilman Wilson so moved and Councilmember Jackson 3econded the '
motion. Motion carried by unanlmous vote.
4. NEWMAN CENTER REQUEST 8 GREEN BELT PALMA VILLAGE
PLAN. �
Councilman Wilson moved to convey to the Piann(ng Commission that '
although the Council is desirous of lmplementing the Pelma Village i
Specifte Plen� et this ttme it woutd not be pract(cal to Smpose those
development 5tandards on this particular remodelfng proJect� and 1t
should be processing Nith parking adJacent to the facllSty. Counctl-
member Jackso� seconded the motion. Motion carrfed by unanfmous vote.
CounCllmember Bensan stated that she voted for the motion wlth the
understanding that it applied only to this particular pro�ect because
the C1ty wanted to implement the Plan ahen 1t had money to develop it es
a compliment to the area. Councilman wilson concurred and sald that
was the fntent of his motian.

1 . CLAIMS BY TENANT OF THE TOWN CENTER FIRE STATION.
Mr. ErNin stated that Ne were getting close to the
end of the road uith these complei�ts end that a
meeting was being scheduled for the first of December
with staff and one member of the City Council
beceuse there may be some dollar amount lnvolved
whtch could be in excess of ;33.000. Councll a9reed
that Mayor Kelly should represent the Council .

Councilman wilson, for the sake of discussion. suggested
that the City Counci 1 do awey Wlth Study Se9slons prior
� to Councll meetings and lnstead change the ordlnance
setting meeting times so that it convened at 4 p.m.
Staff could be instructed to restructure the agenda in
such a way tf�at discusslon items take place between 4 and
6 p.m. . dinner between 6 and 7 p.m. , and public hearings
set for 7 p.m. Additional study sesston or discussion
material not covered betWeen 4 and 6 p.m. �ould be
carrted over to the end of the agenda or after the pub) tc
hearings.

He went on to say that the purpose for this suggestton
Wae his feeling that the publlc was rtot aware that they
are welcome at study sessions. He said these sessions
are conducted in an informai environment that sometimes
does not gtve the pubtic a chence to see and hear public
busfness being discussed. He 9aid that by changing the
procedure so that it takes place in the Chamber and so
informing the public it was xelcome for the entfre
sesslon, it would be in its best interest. He stated
that hfs concern aes thet often tlmes Councii really� by
coming to a consensus in study session, was maki�g a
decision. and the item was then not fuily dtscussed wtth
viewpoints of Councilmembers fully stated in the formal
meeting.
Couneilmember Benson disagrted and sald that the publEc i
is we9come et study sessions. She felt these meetings I
were lesa formal and thu9 less intimldating both for
staff and the pubifc.
Councilmember Jack3on sald whlle she was reluctant to
change the meeting sc�edule. she xould be Nfliing to do
so on a temporary trial basis.
Counctlman Wtison moved to ad�ourn tha November 21st City Council
meettng to 4 p.m. on Thursday. Oecember t2, t985, and reorganize the
City Councll agenda on a trial basis for this meeting schedule. Council-
member Jackson seconded the motion. Motion carried on a 3-2 vote with
' Councilmembers 8en9on a�d Snyder voting N0.
