HomeMy WebLinkAboutGrant of Easement & Right-of-Wy w/in Julie Laner / CITY OF PALM DESERT PUBLIC WORKS DEPARTMENT STAFF REPORT REQUEST: AUTHORIZE THE MAYOR TO EXECUTE A GRANT OF EASEMENT TO THE CITY OF PALM DESERT FOR PUBLIC USE, A PERMANENT EASEMENT, AND RIGHT-OF-WAY FOR STREET AND PUBLIC UTIITY PURPOSES WITHIN JULIE LANE SUBMITTED BY DATE: Mark Greenwood, P.E., Director of Public Works August 28, 2014 ATTACHMENTS: Grant of Easement Vicinity Map Recommendation By Minute Motion, authorize the Mayor to execute a Grant of Easement to the City of Palm Desert for public use, a permanent easement, and right- of-way for street and public utility purposes within Julie Lane. Backqround In June 2002, the Palm Desert Redevelopment Agency conveyed a strip of land in fee title to the City of Palm Desert intended to be used as street right-of-way for Julie Lane, a 610-foot long street between Portola Avenue and Shepherd Lane. Additionally, the Successor Agency to the Palm Desert Redevelopment Agency conveyed another strip of land in fee title to the City of Palm Desert in July 2014, also intended to be used as street right-of-way for Julie Lane. The City Attorney has opined that public utility rights are not included in the aforementioned conveyance. Therefore, a Grant of Easement must be executed by the Mayor and recorded to provide an easement for the utility purveyors in order to have their facilities constructed and maintained with Julie Lane.
