Commission Recommendation At its regularly scheduled meeting of January 8, 2014, the Art in Public Places (AIPP) Commission recommended with a vote of 5-0-1 (Commissioner Miller abstaining), to approve a co-sponsorship with Renova Energy Corporation (Renova) to commission Deborah Flowers to create artwork for the set of three utility cabinets on the northeast corner of EI Paseo and Highway 74. Staff Report Co-Sponsorship of Traffic Signal Cabinets Painting January 23, 2014 Page 2 of 3 Executive Summary In late 2013, Renova donated the painting of a design by Deborah Flowers on the set of utility cabinets on EI Paseo and Larkspur. The project was completed in late December 2013. Subsequently, Renova has proposed co-sponsoring, with the City, Deborah Flowers to create a design and to paint it on the set of three utility cabinets on the northeast corner of EI Paseo and Highway 74. Renova has proposed that the artist be paid a total fee of $3,000, with $2,250 to be paid by Renova and $750 to be paid from the City's Public Art Fund for the project. The artist's design for the cabinets is based on the sunburst and solar panel design that she created for and painted on the set of two traffic signal cabinets on EI Paseo and Larkspur. The design for these cabinets will differ slightly from the previously painted set in that the angle of the design radiating from the sun will be different. The color palette will remain basically the same. Traditionally when the Public Art Program commissions an artist to create artwork for a set of traffic signal cabinets, the artist selection is done through an open call for artist process where artists from the Coachella Valley are invited to submit their qualifications for review and selection by the Art in Public Places Commission. From the pool of qualifications, up to three artists are selected to be paid an honorarium to create a site specific proposal. Completed proposals are reviewed and voted on by the Commission prior to being brought before City Council for final approval and contracting. Co- sponsorship of this project would result in a cost savings for the Ciry, but would limit the City's abiliry to select which set of signal cabinets is painted as well as to select the artist and his or her unique design through an open call to artists process. Fiscal Analvsis In order for the Commission to properly analyze the fiscal impact of the project, it is helpful to compare it to the costs of recently commissioned traffic signal cabinet design painting projects. The artists who were selected to paint the sets of signal cabinets at Fred Waring Drive and Town Center Way and Phyllis Jackson Lane and Fred Waring Drive were paid a $125 honorarium each to create a proposal and $1,500 each to paint the designs on the sets of two cabinets (one large and one small). The artist who was commissioned to paint a design on the large cabinet on Fred Waring Drive and Coliege of the Desert was paid an honorarium of $125 and a $750 commission fee. If the City were to commission the painting of a set of three cabinets on its own with no co- sponsor, staff would recommend a commission amount of $2,000 plus $125 for a design fee to each of three artists in their proposals for a total cost of $2,375. Co- sponsoring this project would result in a savings of $1,625 in proposal and commission fees. Staff Report Co-Sponsorship of Traffic Signal Cabinets Painting January 23, 2014 Page 3 of 3 In addition to the co-payment of $750, the City would also be responsible for the preparation of the cabinets, at an estimated cost of $350; the UV/graffiti coating of the cabinets at an estimated cost of $150; and a plaque for the artwork at an estimated cost of $125. The City would be responsible for all of the aforementioned costs whether co- sponsoring the painting of the cabinets or commissioning an artist on its own. If approved by the City Manager, the encroachment fee may be waived. If the encroachment fee is waived the City will be responsible for an estimated total of $1,375 for this project. We have shared our concerns over the years about the disruption that putting artwork on the utility boxes in front of our displays would cause. It would be a direct conflict to our efforts as a commercial art gallery not to mention that the aesthetic would be awkward. I will be out of town on January 23 and having just been notified of this today cannot adjust my schedule. I ask that the City of Palm Desert Council move this issue to their next available scheduled meeting so that I might have an opportunity to share my concerns about this conflict with them. I have been a gallerist in Palm Desert for over 10 years and have actively participated in and supported our community I ask that you reconsider your recommendation. As you and I have previously discussed, community members/businesses are welcome to proposal sponsoring or co-sponsoring the painting of a design on utility/traffic signal cabinets in the City of Palm Desert. Just after we last spoke, I received a proposal for the painting of a design on the City owned set of three utility cabinets on the corner of EI Paseo and Highway 74 next to your gallery. The proposal has been reviewed by the Art in Public Places Commission, which has recommended it for approval by the City Council. As a regular course of action, I let the businesses adjacent to the cabinets know about the proposal (which is attached)to give them opportunity to give feedback to the City Council before it makes its decision. The proposed artwork is a sunburst design with solar panels and is created by the same artist who painted the set of two cabinets on EI Paseo and Larkspur(see attached). The design is a close variation on the theme of the already painted cabinets,so that will give you an idea of how it would look. Please review the proposal, and if you have any feedback that you would like to give to the City Council you are welcome to send an email or a letter to me or directly to City Council, and/or you or a representative can come to the City Council meeting to give your feedback publically. This item will be on the City Council agenda for the January 23, 2014 meeting, which starts at 4:00 p.m. I know that you will be out of town on the date of the meeting, and have expressed an interest in having the item continued.
