1. Approve a Grant of Easement in favor of CVWD for the extension of the
recycled water line at Desert Willow Golf Resort.
2. Authorize the Mayor to execute the Grant of Easement
Backqround
The Desert Willow Golf Resort utilizes recycled water provided by Coachella Valley Water
District (CVWD) to irrigate both golf courses. The courses utilize over 90% recycled water for
golf course irrigation. CVWD currently has an easement over the existing 20" recycled water
line that enters Desert Willow Golf Resort on Cook Street, north of Market Place. The water line
runs west underneath an existing service road, through the golf course, the driving range and
connects into the existing irrigation bladder (water storage facility).
Discussion
CVWD is proposing to connect into the existing recycled water line near the bladder and extend
it to the west, along the south side of the existing service/golf cart path and out on to Desert
Willow Court and Portola Avenue (see attached map). The line is being connected on to the
Portola Avenue line in an effort to loop the water system and improve delivery capacity. CVWD
is requesting approval of a 10 foot wide easement following the path of the extended recycled
water line and ending at Desert Willow Court (see attached map).
The easement will allow CVWD to access the site to repair and maintain the water line as
necessary. City staff and Kemper Sport Management have coordinated with CVWD to minimize
impacts to golfers, maintenance crews and the resort in general, during installation of the
pipeline. CVWD will repair any damaged irrigation lines and will reinstall landscaping and turf
that is disturbed. The installation of the water line is scheduled to begin this July and is
expected to be complete by the end of August. Impacts to golfers will be minimal as the
construction will take place during the off-season.

GRANT OF EASEMENT / PIPELINE(S)
FOR VALUABLE CONSIDERATION, the receipt of which is hereby acknowledged,
("Grantor") does hereby grant to
COACHELLA VALLEY WATER DISTRICT, a public agency of the State of California ("Grantee"),
and its successors and assigns, a perpetual, nonexclusive easement and right-of-way to install, construct,
enlarge, survey, reconstruct, remove and replace, operate, maintain, repair, improve and relocate
underground pipeline(s), which pipeline(s) may be installed at different times, and over a period of time,
and necessary devices and appurtenances thereto in, on, over, under, along and across that certain real
property in the County of Riverside, State of California, described in Exhibit "A" and depicted in
Exhibit "B" attached hereto and by reference made a part hereo£ Grantee will promptly repair any
damage caused to Grantor's land as a result of Grantee's exercise of the easement rights described
herein.
The foregoing easement includes the reasonable right of access to and from said easement for the
purpose of exercising the rights granted herein.
Said pipeline(s) and every part thereof shall, where it crosses Grantor's land, be confined to lands
hereinabove-described, and shall be constructed by Grantee with sufficient ground cover (i.e., distance
between ground surface and top of such pipeline(s)) as shown on the construction plans for such
pipeline(s), and in no event less than three (3) feet below ground level. Notwithstanding the foregoing,
the ground cover shall not be changed by any party other than Grantee. Fixtures and appurtenances used
or useful in the operation of said pipeline(s) may be constructed any distance either below or above the
ground surface.
The Grant of Easement herein contained shall include the right to enter said premises, to survey,
construct, reconstruct, lay, relay, maintain, operate, control, use and remove said pipeline(s), fixtures,
appurtenances, and to remove objects interfering with the construction, operation and maintenance

thereof; provided, however, that approval by Grantor will be required with respect to removal or
relocation of any such objects, which approval will not be unreasonably withheld, conditioned or
delayed.
The Grantor reserves the right to cultivate, occupy and use said premises for any purpose not
inconsistent with the rights and privileges above granted and which will not interfere with or endanger
said pipeline(s), fixtures and appurtenances or the use thereof. Landscaping within the area of the
easement will be permitted; provided, however that grass, shrubs and plants will be less than three (3)
feet in height and trees will not be permitted within fifteen (15) feet of the easement area. No permanent
structures, including buildings, walls, gates or fences will be constructed within the easement area. The
Grantee shall use due care in the construction, operation and maintenance of said pipeline(s), fixtures
and appurtenances.
