By Minute Motion, adopt Resolution 2014- 54 vacating excess street
right-of-way within De Anza Way as shown on the map of Palma Village
Unit No. 3, filed in Book 20, Pages 3 and 4, records of the County of
Riverside.
Backqround
The subject area requested to be vacated is located approximately 200 feet north of the
intersection of Alessandro Drive (east) and San Carlos Avenue. The subject area is
actually partially within the improved area and parking lot of what was formerly Wises
Gym, now proposed for Venus de Fido. The right-of-way was originally dedicated to the
County of Riverside on the map of Palma Village Unit No. 3 which recorded with the
County of Riverside on May 29, 1941, and accepted by the County as shown by Road
Abstract dated July 11, 1949.
The portion of street right-of-way to be vacated is considered excess by staff because
there is no current or future need for it. Additionally, the physical location of the street
alignment was changed in about 1979 and, therefore, this subject street right-of-way
area has not been used for its dedicated purpose for more than five consecutive years
immediately preceding this proposed vacation. This particular case meets the
requirements of a "summary vacation" pursuant to the California Streets and Highways
Code, Division 9, Part 3, Chapter 4, whereby the vacation procedure does not involve
an evaluation from the Planning Commission, nor the scheduling of a public hearing.

Therefore, staff requests that City Council waive further reading and adopt Resolution
2014- 54 vacating excess street right-of-way within De Anza Way as shown on the
map of Palma Village Unit No. 3, filed in Book 20, Pages 3 and 4, records of the County
of Riverside.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, VACATING EXCESS STREET
RIGHT-OF-WAY WITHIN DE ANZA WAY AS SHOWN ON THE
MAP OF PALMA VILLAGE UNIT NO. 3, FILED IN BOOK 20,
PAGES 3 AND 4, RECORDS OF THE COUNTY OF RIVERSIDE
UNDER PROVISIONS OF DIVISION 9, PART 3, CHAPTER 4 OF
THE STREETS AND HIGHWAYS CODE OF THE STATE OF
CALIFORNIA
WHEREAS, the subject vacation is made pursuant to the requirements of the
California Streets and Highways Code, Division 9, Part 3, Chapter 4; and
WHEREAS, the City Council of the City of Palm Desert considered such matter
and finds from the evidence submitted that the street right-of-way described in Exhibits
"A" and "B", attached hereto and made a part hereof, is in excess and is unnecessary
for present or prospective public purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF PALM DESERT,
CALIFORNIA, AS FOLLOWS:
1. That the portion of De Anza Way as shown on Palma Village Unit No. 3 be
vacated as described and as set forth in Exhibits "A" and "B" attached
hereto subject to and retaining all public utility easements and other
easements of record existing within said public street right-of-way; and
2. That the City Clerk of the City of Palm Desert, California, shall cause a
certified copy of this Resolution and order to be recorded in the Office of
the County Recorder of Riverside County, California; and
3. That from and after the date that this Resolution is recorded, the subject
portion of public street right-of-way will no longer constitute a public
service easement.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm Desert
City Council held on this 12t" day of June, 2014, by the following vote, to wit:
