Executive Summary The Palm Desert Municipal Code contains provisions regulating exterior building modifications to real property when visible from the public right-of-way. This includes the regulation of exterior paint color changes to both commercial and residential property. Code Compliance Officers responded to complaints from neighbors regarding a newly painted home on the block of Avenida Estrada, south of Hovley Lane. The officer directed the property owner to seek approval of the color change with the Planning Department; who referred the matter to the City's Architectural Review Commission (ARC). The ARC reviewed the paint color change and denied the property owner's request, finding that the color was out of character with the neighborhood and did not relate well to the color of the home's roof tile. The property owner has appealed this decision to the City Council. Architectural Review Commission The City's Architectural Review Commission reviewed the proposed wall exception application at their meeting on May 27, 2014. The Commission discussed the paint color change, including Staff Report MISC 14-162 — Paint Color June 26, 2014 Page 2 of 2 the incompatibility of the color with the neighborhood and architecture of the home and denied the applicanYs request by a vote of 7-0-1, with Commissioner Levin absent. Analvsis Palm Desert Municipal Code, Section 25.34.110 Exterior Modifications, states that: "The colors of an existing building... or other improvements to real property that are visib/e from public right- of-way shall not be significantly changed unless reviewed and approved by the Director of ARC upon appeal. For purposes of this section, "significantly changed" means a change in hue, shade or intensity of color." Staff reviewed the paint color change and referred the matter to the City's ARC for approval. The new paint color change is out of character for the existing neighborhood and the paint color is not complimentary to the home's blue-grey roof tile. The predominant colors in the neighborhood are off-white and pastels. The new bright shade of yellow and brown accents is not in keeping with color scheme of the neighborhood and home `sticks out' awkwardly on the block. Environmental Review According to the California Environmental Quality Act (CEQA), staff must determine whether a proposed activity is a project subject to CEQA. Staff has determined that the proposal does not meet the definition of a project under CEQA and is therefore not subject to further environmental review. Fiscal Analvsis There is no fiscal impact to the City for the consideration of this proposal. He went out to perfiorm a site visit and feels that the paint color does not match well with the bluish grey roof and is not compatible with the neighborhood; which is mostly pastels. While he was out there, he spoke with a neighbor who was not in favor of the paint color, He presented photos of the home and the neighborhood for review. Staff is not recommending approval of the paint color. MR. ERIC VORTRIEDE, applicant, said he has lived at this property since 2003 and said the selection of this color was made by driving around the surrounding neighborhoods to get ideas from other homes. His house needed to be painted just like many of the homes in the neighborhood. He also mentioned they converted their lawn to desert landscaping. He said there are two houses to the east with colors very close to his color, along with desert landscaping. Had he known there was any kind of restriction he would have come in for a permit. His painter, who has worked in the valley for 30 years, wasn't aware of this ordinance. He believes this has increased his property value and hopes this entices his neighbors to paint their homes. He pointed out there are several neighbors who absolutely love this color. Commissioner Lambell said it appears that this applicant is the first one to make a drastic change from what currently exists in the neighborhood. However, if one neighbor wanted to paint their house a sky blue and another one paints theirs the color of a palm tree, then pretty soon the street will look like a patch work quilt. That is certainly not indicative of Palm Desert nor would it be indicative of the applicant's neighborhood where everyone is in the . � ' same tonal range. Commissioner Clark agreed and said he looked at the whole neighborhood and the uniformity of the color in the neighborhood is something that he doesn't blame people for wanting to get away from. Trying to get away from the bland color is good, but with this color the applicant has gone overboard. Mr. Ceja felt this wasn't compatible with the neighborhood but understands there isn't a need to match every house to the same color palette. However, it is a strong color and doesn't match with the bluish grey roof tiles. Commissioner Mclntosh said sometimes this color can be a good accent color, but not necessarily a good color for the body mass of the building because it contrasts with the neighborhood. He agrees that the neighborhood is washed out and in need of something, however this color jumps out. This Commission has to find the harmony in the community and what works. Commissioner Clark asked what the applicant can do if this is denied. Mr. Tony Bagato, Principal Planner, said the applicant can appeal the decision to City Council (Council). If it is denied through Council, the applicant will have to change the color or ask for a continuance to modify it somehow. As presented today, it would have to change it or be denied. MR. VORTRIEDE felt they made a very careful decision. He admitted to feeling a little put upon with the way this matter came up. He has done nothing but improve the property value of his house. He understands where the City is coming from looking at it from the prospective of the neighborhood harmony. The Commission and the applicant discussed the entire home being painted with one color and the architectural elements on the home. Commissioner Vuksic said he didn't want the Commission to mislead the applicant. He didn't think the applicant could keep the mustard color in certain spots and add another color. Looking at the photo this house stands out even from a distance. Since the house was in sore need of new paint,we decided to take care of both at the same time. We drove around Palm Desert, particularly our immediate neighborhood,looking for ideas for both the landscape and house color. Although we acknowledge that aur choices are a departure from the norm for our block,they are in keeping with many houses in our immediate neighborhood(i.e., one block to either side of Novley Lane West and two blocks East and West of Avenida Estrada). We had no idea we needed to obtain approval for our paint color, particula�ly since there was already precedent for it in our neighborhood. For this very reason, I was frankly in shock when the ARC denied our application for approval of the color. When challenged regarding other houses in the neighborhood that were painted similarly,their responses were along the lines of"we didn't approve it:' In order to make the most informed decision that we could as to whether or not to appeal the decision, we sent a letter to each of our neighbors on our block,explaining the situation and asking them what they thought of the color and whether or not they felt we should be compelfed to change the color. At this time we have received back nine of the 17 letters that we sent. One was returned as the house is vacant and of the others,six are of the opinion that we should not have to change the color and two think that we should. (The letters are attached,and I will bring any others that I receive to the meeting.) I did not know if we were going to appeal or find another color until I picked up the appeal form from the city clerk,and the person who gave me the form mentioned a "Palm Desert color palette." Since then, 1 have scoured the city website and the entire Internet in search of it. I searched every document that makes mention of the word color on the City website and found no mention of any restrictions on residential house color whatsoever. I had to go through the online Palm Desert Municipat Code document page by page to find the section of which we were in violation as the letter from the city (attached)referenced the wrong chapter. It cannot be found using the search function of the city website nor can I find a Google search string that will yield a reference to it. So, if we had attempted to find out if there were restrictions before painting,we would have been led to believe that there were none. The letter that I received from the city informing me of the code compliance violation contains this sentence: "This enables you and your neighbors to maintain your property values,and enhances the quality of life in your neighborhood,as well as for the City of Palm Desert." If that is truly the reason for the ARC action, it is a failure on all counts in that what we have done has significantly enhanced the value of our property,and I cannot begin to describe the negative effect that it has had on our quality of life as Palm Desert residents. All in all,this action feels so arbitrary and unfair to us that we feel compelled to appeal to the City Council. We endeavor to follow the laws of the land and truly regret that we find ourselves in violation of them. The ordinance states that we need to have the approval of the City.
