IV. CONSENT CALENDAR

Minutes of the regular meeting held on January 8, 2014.
Chairperson Boren, who was absent, contacted staff regarding a
change to the January 8, 2014 minutes on page 6, New Business,
Item E. Consideration of Artists(s) to be Included in City of Palm
Desert's Artist Registry, the motion should be corrected to read,
"Commissioner Bussing moved to not include artist Jenny Balisle in

the City of Palm Desert's Artist Registry. Motion was second by
Commissioner Miller with a 3-3 vote with Boren, Darby, and
Thompson voting AYE and Bussing, Hough, and Miller voting NO.
Artist Jenny Balisle will not be added to the Artist Registry."
Due to the confusion of the motion, Recording Secretary Debbie
Thompson will review the recorded meeting of January 8, 2014,
correct the motion, and continue the item to the meeting of March
12, 2014.
Commissioner Hough moved to direct staff to review and
correct the motion from the minutes of January 8, 2014, and continue
the item to the meeting of March 12, 2014. Motion was seconded by
Commissioner Bussing and carried 4-0-0 with Bussing, Darby,
Hough, and Miller voting AYE with Boren and Thompson absent.
V. DISCUSSION ITEMS
A. ORAL REVIEW OF CITY COUNCIL ACTION —
Councilmember Susan Marie Weber
Ms. Schwartz reported that at its meeting of January 27,
2014, City Council denied the proposed co-sponsorship with
Renova Energy Corporation to commission Deborah Flowers
to create artwork for the set of three utility cabinets on the
northeast corner of EI Paseo and Highway 74. Council
directed staff to work with Renova to search alternate
locations.
Commissioner Miller stated that she saw a painting of a
design by Deborah Flowers at the gallery in Palm Springs
Airport that was very similar to the design that Ms. Flowers
painted on the traffic signal cabinets on EI Paseo and
Larkspur. The painting is titled Solar Energy and Ms. Miller
feels it is free advertising for Solar Energy. Ms. Schwartz
pointed out that the gallery in which Ms. Flowers' painting is
displayed is a community gallery in Palm Springs.
Commissioner Darby commented that she had driven by
Melissa Morgan Fine Art Gallery and noted that because of
the display of the sculptures in front of the gallery, the
orange sun ray design proposed for the traffic signal
cabinets would have been too much of a contrast in that
location. Ms. Schwartz reminded the Commissioners that
when items are on the agenda regarding locations and
placement of artworks, Commissioners should visit the

proposed site, if they are not familiar with it, before voting on
an item.
B. PLANNING COMMISSION REPORT— Ken Stendell
Mr. Stendell reported that at its January 21, 2014 meeting,
the Planning Commission elected a new Chairperson and
Vice Chairperson as well as liaisons to Committees and
Commissions. Mr. Stendell was reappointed as the liaison
to the Art in Public Places Commission.
The Planning Commission approved a 4,000 square foot
single family home above Cahuilla Hills on Chuckwalla.
There was a clarification of the Zoning Ordinance as it
pertains to accessory structures and added to the definition
what an accessory structure is.
C. ARCHITECTURAL REVIEW COMMISSION REPORT —
John Vuksic
No report.
Commissioner Darby expressed her concern of the density
of the developments near Frank Sinatra and Gerald Ford.
Ms. Aylaian explained that more of that type of product will
be seen in the City, particularly in the north sphere which will
be designed to accommodate the students and faculty of the
Universities.
VI. CONSENT ITEMS HELD OVER

VI1. NEW BUSINESS
A. APPROVE THE PROPOSAL FROM AND
COMMISSIONING OF BIJAN MASOUMPANAH FOR A
DESIGN TO BE PAINTED ON THE TRAFFIC SIGNAL
CABINET LOCATED ON THE SOUTHWEST CORNER OF
FRED WARING DRIVE AND COLLEGE OF THE DESERT
Ms. Schwartz mentioned that the traffic signal cabinet on
Fred Waring Drive and College of the Desert with the design
of bighorn sheep that was recently painted by Bijan
Masoumpanah has been very well received. Directly across

the street is its companion cabinet to which staff is proposing
Bijan Masoumpanah paint a design. The commission
amount would be $750. Ms. Schwartz referred to the
agenda packet that included the image of the proposal.
Commissioner Hough moved to approve the proposal
and commission of a design to be painted by Bijan
Masoumpanah on the tratfic signal cabinet located on the
southwest corner of Fred Waring Drive and College of the
Desert. Mofion was seconded by Commissioner Miller and
carried 4-0-0 with Bussing, Darby, Houqh, and Miller votinq
AYE with Boren and Thompson absent.
B. SELECT UP TO THREE SCULPTURES FROM THE
2013/2014 EL PASEO INVITATIONAL EXHIBITION FOR
THE PUBLIC TO CHOOSE ONE TO BE PURCHASED BY
THE CITY OF PALM DESERT
Ms. Schwartz stated that it is common for the City to
purchase a sculpture from the EI Paseo Exhibitions, but not
required. Ms. Schwartz stated that several years ago the
City held a community wide contest on a selection of
sculptures from the EI Paseo Invitational Exhibition, which is
how Danseur by Jean-Louis Corby was added into the City's
permanent collection. Staff would like to hold another
community vote for selection of a sculpture from the
2013/2014 EI Paseo Invitational Exhibition. Staff chose the
following four sculptures from the 2013/2014 EI Paseo
Invitational Exhibition for consideration. Betty by Dore
Capitani ($12,600), Cross-Over by Michael Anderson
($35,000), Taking Flight by Alisa Looney ($18,000), and
Duality by Heath Satow ($24,000). She asked the
Commission to narrow the selection to three to forward to
City Council for approval.
It was the concurrence of the Commission to select Betty by
Dore Capitani, Duality by Heath Satow, and Taking Flight by
Alisa Looney as the sculptures to be included in the contest
to be voted on by the community. Cross-Over by Michael
Anderson will be considered as the alternate sculpture if
necessary.
Commissioner Miller moved to se/ect Betty by Dore
Capitani, Duality by Heath Satow, and Taking Flight by Alisa
Looney with Cross-Over by Michae/Anderson as the a/fernate
as the scu/ptures from the 2013/2014 E/ Paseo Invitational

Exhibition to be voted on by the community for purchase by
the City of Palm Desert. Motion was seconded by
Commissioner Hough and carried 4-0-0 with Bussing, Darby,
Hough, and Miller voting AYE wifh Boren and Thompson
absent.
C. CONSIDERATION OF ARTIST(S) TO BE INCLUDED IN
CITY OF PALM DESERT'S ARTIST REGISTRY
The following artist applied to be included in the City of Palm
Desert's Artist Registry. Nicola Gadbois.
Commissioner Hough moved to include artist Nicola
Gadbois in the City of Palm Desert's Artist Registry. Motion
was seconded by Commissioner Bussing and carried 4-0-0
with Bussing, Darby, Hough, and Miller voting AYE with Boren
and Thompson absent.
VIII. CONTINUED BUSINESS
A. APPROVE THE DONATION OF HAPPY SWINGING BY
PRINCE MONYO TO THE PUBLIC ART COLLECTION
FROM THE YMCA OF THE DESERT
Ms. Schwartz stated that she informed staff at the YMCA
that at last month's Art in Public Places Commission meeting
the Commission directed staff to have an appraiser evaluate
Happy Swinging. Staff spoke to two appraisers and
determined that it would cost the City approximately $1,200
to have a formal appraisal of the sculpture. Commissioner
Hough reported that she also researched the artwork
through the Artnet database which includes recent auction
prices for similar artworks by the same artist and the prices
were below $1,500. Commissioner Hough gave the Artnet
information to staff for its records. Staff felt it was not worth
having the sculpture appraised. Commissioner Hough also
commented that the City's collection has grown well beyond
the quality of Happy Swinging and would not be in favor of
having it repaired.
Commissioner Hough moved to not accept the donation
from the YMCA of Happy Swinging by Prince Monyo into the
City of Palm Desert's Public Art Collection. Motion was
seconded by Commissioner Darby and carried 4-0-0 with
Bussing, Darby, Hough, and Miller voting AYE with Boren and
Thompson absent.

IX. OLD BUSINESS
NONE
X. PROJECT STATUS REPORTS
A. Palm Desert Community Gallery
Ms. Schwartz reported that the opening reception for
Ancestral Reca/l by Gideon Cohn on Monday, February 10,
was well attended.
Ms. Schwartz reported that she is training Ms. Thompson on
how to hang an exhibition in the gallery.
Ms. Schwartz announced that the Call for Artists for
proposals for the next Community Gallery season is
available.
B. Docent Program
The docent program is in high demand for tours.
C. Public Art Documentary Film Series
Ms. Schwartz reported that the January film, C/ass of `83
was very well received. February's film, My Kid Cou/d Paint
That, is Thursday, February 20.
XI. REPORTS AND REMARKS
A. STAFF
Ms. Schwartz reported that the dates for the Americans for
the Arts Conference conflict with the June Art in Public
Places Commission meeting. She would like to move the
meeting to Wednesday, June 18, if the Commissioners
concur. The Commissioners agreed to change the regularly
scheduled June meeting to Wednesday, June 18.
Ms. Schwartz reported that she communicated with Renova
Energy Corporation and suggested a couple of locations in
the north sphere for Deborah Flowers to paint her proposed
design on a set of traffic signal cabinets, but Renova was not
in favor of the locations.

Ms. Schwartz reported that the artwork by Heath Satow
located in the Desert Gateway shopping center that was
damaged by a car is in process of being replaced. The artist
is busy with other deadlines but should be out to install the
replacement artwork in a couple of months.
Ms. Schwartz reported that City Council has completed the
interviews for those interested in volunteering to serve on
one of the City's Committees or Commissions. The
applicants will be approved at the City Council meeting of
February 27. If approved, the Art in Public Places
Commission will have a new member to fill the vacant seat.
Ms. Schwartz reported that artists Larry and Nancy Cush are
installing the artwork at the Coachella Valley Water District,
and it is coming along nicely.
Ms. Schwartz stated that she has been working with the
Code Compliance Department regarding the sculpture,
Recycle, that the community member from Sandpiper
inquired about at the Commission's January 8, 2014
meeting. The Code officers have not found there to be any
problems in that area as far as people going through the
residents' dumpsters, but the officers will give close attention
to that area. She noted that the only time the City would
move a permanent piece of artwork to a different location, as
requested by the community member, would be due to
issues related to its placement. Commissioner Bussing
commented that Recycle is an artwork where the community
participated in creating it.
B. COMMISSION REPORTS
Commissioner Darby announced that there will be tours of
the COD campus during Modernism Week.
XI. ADJOURNMENT
Commissioner Bussing moved to adjourn the meeting at 9:55 a.m.
Motion was seconded by Commissioner Hough.
