Authorize staff to submit the FY 2014/15 CDBG One-Year Action Plan and AI/FHAP to the U.S. Department of Housing and Urban Development (HUD). Executive Summary The City's Outside Agency Funding Committee met on March 20, 2014, to review and make recommendations on Community Development Block Grant (CDBG) applications for FY 2014/15. The U.S. Department of Housing and Urban Development (HUD) recently released jurisdiction allocations for FY 2014/15 and based on the City's allocation, adjustments were made according to the Committee's approved parameters and are incorporated herein. The City of Palm Desert's allocation for FY 2014/15 is $280,226, which is a reduction of$9,998 from FY 2013/2014. In addition to the FY 2014/15 allocation, the City had $1,345.73 in un- programmed CDBG funds bringing the total funding available for FY 2014/15 to $281,571.73. As part of the annual CDBG process, a Notice of Public Hearing and 30-day public input period was published in the Desert Sun relative to the CDBG Action Plan and Analysis of Impediments to Fair Housing Choice Plan (AI)/Fair Housing Action Plan (FHAP). The Action Plan and AI/FHAP was provided to City Council for review prior to the May 8, 2014, City Council meeting. In addition the AI was submitted to impacted departments for review and comment. No comments were received during the 30-day public input period. STAFF REPORT FY 2014/15 CDBG OUTSIDE AGENCY FUNDING RECOMMENDATION, ONE-YEAR ACTION PLAN, AND ANALYSIS OF IMPEDIMENTS TO FAIR HOUSING CHOICE PLAN (AI)/FAIR HOUSING ACTION PLAN (FHAP) APPROVAL MAY 8, 2014 PAGE 2 Backqround The City conducted its first public hearing to open the 30-day comment period and receive public input regarding the Community Development Block Grant (CDBG) FY 2014/2015 funding cycle at the December 12, 2013, City Council meeting. As part of the Five-Year Consolidated Plan for the FY 2013/14 through FY 2017/18 time period, the City was required by HUD to undertake completion of the Analysis of Impediments to Fair Housing Choice Plan (AI)/Fair Housing Action Plan (FHAP), which was prepared by the City's consultant, Ralph Castenada and Associates. A draft copy of the AI/FHAP was first presented to the City's Outside Agency Funding Committee at its meeting of March 20, 2014, and was also given to City Council members for review and comment. The proposed final AI/FHAP also went through the Citizens Participation process prior to being brought before City Council for consideration and approval. On March 20, 2014, the Committee reviewed all FY 2014/15 CDBG applications received and made recommendations for funding as outlined in the tables below. These tables outline all organizations that submitted CDBG applications, funding recommendation, proposed award amount, and the original amount requested. Those applicants listed in the recommended for funding column have been identified as potential funding recipients. The award distribution formula as stipulated by HUD is provided below and reflected in the awards as shown in the aforementioned tables: • 15% (maximum) for public service; � 20% (maximum) for administration; and • 65°/o to 85% (if all 20% administration funds are not utilized) for capital improvement projects. The specific funding recommendations for each category is Capital Improvement at 65% _ $183,493.73 (including un-programmed funds); Pubic Service at 15% _ $42,033, and Administration at 20% _ $56,045. (The only category that may exceed the maximum cap is Capital Improvement.) In addition, it should be noted that qualifying programs/projects recommended for award of CDBG funding must meet one of the three National Objectives as identified by HUD, which are: 1) to benefit low and moderate income persons (51% or more must be low income); 2) to aid in the prevention of or elimination of slum or blight; and 3) to meet an urgent need such as a natural disaster. See notes in the attached table for specific reasoning of funding recommendations made pertaining to each applicant. For capital improvement type projects, staff will be on-site throughout the project to monitor progress of work, as well as to conduct random employee interviews of contractors and subcontractors, which is required per Davis-Bacon Prevailing Wage regulations. City Council's approval of CDBG applicants and awards will be included within the One-Year Action Plan and submitted to HUD upon approval. Staff recommends approval of the Outside Agency Funding Committee's FY 2014/15 CDBG funding recommendations, One-Year Action Plan, and Analysis of Impediments to Fair Housing Choice Plan (AI)/Fair Housing Action Plan (FHAP) as submitted so that staff may remit items to the U.S. Department of Housing and Urban Development (HUD). HUD requires the City to affirmatively further fair housing through an analysis of impediments fair housing and the implementation of actions to eliminate impediments such as housing discrimination and the lack of housing accessible to disabled persons. The AI and FHAP are summarized in the One-Year Action Plan for FY 2014/15. The City will hold its final public hearing on May 8, 2014, at 4:00 p.m. or thereabouts to accept public comments related to the Community Development Block Grant (CDBG) Program and related items stipulated herein. Anyone interested in providing input for inclusion into the proposed Final Plans is encouraged to attend the meeting or contact the City staff person designated betow. The hearing will be held in the Palm Desert Civic Center, Council Chambers located at 73-510 Fred Waring Drive, Palm Desert. The City, as part of the existing Consolidated Plan process completed a Needs Assessment of which is also available to assist in providing public comment. If desired, a copy may be obtained from the City's website at www.cityofpalmdesert.orq or by request to the City of Palm Desert's Special Programs Department. The City as part of the Citizen's Participation P1an will also accept public input during the 3�-day public comment period that will commence Friday, April 4, 2014, and end on Wednesday, May 7, 2014. The City will make available the One-year Action Plan and completed update of the AI and FHAP at the following location: Palm Desert Civic Center at 73-510 Fred Waring Dr., Palm Desert, CA 92260.
