Recommendation
By Minute Motion:
1. Accept the work for Contract No. C32910 for the Country Club Median
Landscape Rehabilitation-Cook Street to Portola Avenue as complete, and
2. Authorize the City Clerk to file a Notice of Completion.
Backqround
On September 26, 2013, City Council awarded Contract No. C32910 to Golden Vista
Construction, Inc.,dba Golden Valley Construction, of Palm Springs, California for the Country
Club Drive Median Landscape Rehabilitation Cook Street to Portola Avenue (Project 979-14).
The contract dacuments specified the project was to be complete on November 27, 2013;
however, it was not accepted for commencement of the maintenance period until January 9,
2014. This was 43 days beyond the contract completion date. The contract provided for
fiquidated damages to be assessed at $5QQ.00 per day far each day beyond the completion date.
The contractor was assessed $21,500.00 for contract delay. They were notified of the
assessment and the amount was deducted from their final progress payment.
At the conclusion of the 90-day maintenance period, 27 plants were either dead or missing. The
contractor was notified by the field inspector as well as notified in writing to replace the plant
material by April 8, 2014. The plant material was not replaced.
This area of inedian landscape is normally maintained by the City under a contract. Currently,
Vintage Associates, Inc., is the contracted vendor for these services. Staff contacted Vintage to
replace the plant material at their contract replacement price. The tota� to have the missing plant

material installed was $362.00. This amount will be deducted from the retention amount due
Golden Valley Construction.

1. That the interest or estate stated in paragraph 3 herein in the real property herein described is SOLELY
OWNED by the CITY OF PALM DESERT, A MUNICIPAL CORPORATION, a political subdivision of the State
of California, and whose address is 73-510 FRED WARING DRIVE, PALM DESERT, CALIFORNIA, 92260.
2. That the full name and address of the owner of said interest or estate is set forth in the preceding
paragraph.
3. That the nature of the title of fhe stated owner, as set forth in paragraph 1, is FEE.
