C33890C FOR THE UNIVERSITY SITE SOIL STABILIZATION PROJECT, AND AUTHORIZE THE CITY CLERK TO RE -ADVERTISE (PROJECT NO. 767-15) SUBMITTED BY: Mark Greenwood, P.E., Director of Public Works DATE: November 13, 2014 CONTENTS: Location Map Recommendation By Minute Motion: 1. Deem bidders non -responsive for Contract No. C33890C for the University Site Soil Stabilization Project (Project 767-15); and 2. Authorize City Clerk to re -advertise and call for bids for the subject project; and 3. Authorize the project to be rebid without requiring bid bond, performance bond, or payment bond. Background The City has advertised for bids to stabilize the soil on the undeveloped land at the University Site bounded by Frank Sinatra Drive, Gerald Ford Drive, and Cook Street. The lot has been a source of complaints from residents and the South Coast Air Quality Management District due to the blowing sand. The project was advertised, and on October 28, 2014, bids were opened and read aloud. The following is a summary of bids received: Contractor Location Bid Amount EP&A La Quinta, CA $ 53,137.50 Midwest Santa Maria, CA $143,513.75 Staff Report Deem Bidders Non -Responsive for Contract C33890C (Project 767-15) Page 2 of 2 November 13, 2014 Staff reviewed the contract documents and found both bids to contain irregularities. Neither bidder included a valid Bid Bond with their bid. The City Attorney recommends that Council deem the bidders non -responsive. Staff recommends that Council direct the project to be re -bid. Due to the nature of the work being bid, many of the contractors that perform the work are unaccustomed to procuring bonds. The contractors typically work for developers where no bonding is required. Public Works has consulted with the City Attorney who indicated that it is within the Council's authority to waive the requirement for bonds on this type of project. If Council authorizes the contract to be awarded without bonds, Public Works inspectors would make certain all work was performed in accordance with the specifications, knowing that there would be no bonds to recoup costs.
