My name is Donna Mandeistam and I live at the corner of Spyglass Ln and North View Dr in a development
called the Summit. I am half of the couple referred to in the City of Palm Desert's, Dept of Public Works staff
report submitted by Director Greenwood and attached to your meeting agenda.
1. My husband and I moved to Palm Desert in March of 2013. In the big rainstorm of August 2013, our garage
was flooded due to a clogged unmaintained city drain and drainage channel. The home next door and above us
(48721 North View Dr which backs up to the drainage channel and which has the inlet drain and underground
drainage channel on its property) was inundated. Water poured from the clogged drain and channel into their
back yard, down their pool patio steps and into their living room. It also poured down the slope from their side
yard to our driveway and into our garage. Our pool man was there, our landscape man came over and a
neighbor stopped his car and helped shovel mud off our driveway and back onto the slope. We used push
brooms and removed water from the garage. After the storm was over our gardener shoveled dirt into a berm at
the property line and actually dug a trench down the slope to North View Dr so that any future run off would be
diverted in that direction. We seeded the trench and it is a permanent part of the lawn now. The berm is still
there also to prevent a reoccurrence.
2. We have the tract map, county documents, the city general and strategic plan and drainage plan. We saw on
every document that these were City Drainage Easements and we have seen the City workers come out every
two months and maintain all of the other drains in the Summit except for the outlet drain at the street behind us,
and except for the drain inlet and its underground channel, and except for the actual drainage channels that run
behind the home next to us that flooded. They began to clean the drain outlet at the curb at 48721 North View
Dr two months ago but still do not clean the drain inlet or the underground channel at that location.
3. We went to the City Department of Public Works office in March of this year, took in all of our pictures of the
drain, the channel , our location, etc. We purposefully told them that we had no damage, we cleaned it up, all
we wanted was for someone to put that drain and the channels back on the maintenance schedule. We had
spoken with a former public works worker who said he maintained that drain and the channels during the
nineties. We thought this would take a 10 minute phone call to the maintenance crew but instead it resulted in
multiple meetings or documentation nnd stir o r as l theCity hased e���� ry� , more and pictures, and still, today, ..,. F speak „sty never unplugged
the drain. Our last storm, which was only moderate in intensity, recently filled it right to the edge of overflowing
again and we sent this picture to the City. The statement in the report that says "the Summit channel is of very
little use and unlikely to convey significant storm flows" is also negated by one of our pictures during this last
rainstorm that shows significant water flowing down the channel towards the plugged drain..
4. After the last visit of City Staff in September we were advised that we would get a copy of their staff report
which was never given to us. We just discovered it when we got a copy of the Oct 7th Planning Commission
agenda. We are surprised at some of the language in the report. In the first paragraph, they only mention our
concern over the drainage channel, not the plugged drain and its underground channel. An important omission.
Secondly, at the top of page two it states "there is very little chance of any flood damage to any home as the
channel exists today" Conditions have not changed and they are fully aware that the home next door to us was
flooded! The sentence continues to say "and there was no evidence of erosion that would have existed if water
had flowed from the channel to the aforementioned couple's garage." It is this sentence that angers us the
most. The event took place over a year ago. All the dirt from our driveway was shoveled back on the slope
when the berm was built. City staff only put this in to imply that we were not being truthful. Many people will
read this report and this is an unfair attack on us. We asked that it be amended prior to this hearing. If there is
any doubt as to our truthfulness, the City can contact the the pool man, our gardener, or the neighbor who
helped us clean up. They should have done this prior to making such an insinuation. We would have been
happy to assist with names and phone numbers of witnesses.
You all, as City Council members assume that the Department of Public Works Director has had his staff prepare
a full and honest accounting of the facts. Unfortunately, that has not been the case. While blithely stating that
"there is very little chance of any flood damage to any home as the channel exists today, he failed to inform this
body that the home next door to us at 48721 North View Dr was inundated due to the unmaintained channel
and plugged drain. He and his staff have full knowledge of this and we informed them in writing months ago
when we first came to them. The owner of the home has since abandoned it and let it go into foreclosure but he
is easily reachable by phone and would confirm the flooding, as will our pool man who was there during the
flooding, and the disaster relief company who came out and took away damaged carpet and furniture, and his
gardener who cleaned up the mess in the backyard. This alone, puts the report in question . Several areas lack
truth and integrity and we have pointed them out below. The City itself erred in the 1970's by not stamping the
plans submitted by developers with Accepted or Denied but they signed off on every document and proceeded
to maintain all of the drains. Past practice equals tacit acceptance. Now they are using a legal technicality to try
to avoid their responsibility.
5. In the third paragraph, first sentence, the Director's report states that the Channel provides "only limited
protection to the abutting homes, and no protection to other property, it provides no benefit to the public".
During Director Greenwood's visit to the site in July, he said those very words to us and we asked what "public
benefit" meant. He explained that a property would have to be impacted that did not abut the channel. We told
him and his staff at that time that we did not abut the channel and our garage had been flooded. We are one
property away from the channel. If what we were told at the time was indeed accurate, then both Director
Greenwood and his staff knowingly included false information in their staff report.
6. in the third paragraph, the report states that "other reasons for the rejection are the difficulty in accessing the
entire length of the channel due to its location in 22 separate backyards ...". There are five properties where
homeowners have built fences/walls across the channel and there were landscaping clippings (since removed).
The City is aware that the Summit CC&Rs preclude impeding drainage in any way and that when the City is
ready to resume maintenance of the channels The Summit will ensure that the fences/ walls have been removed.
When these obstacles are removed, City staff would have full access to walking the entire length of the
channels.
7. In the Planning Commission meeting of October 7th, several inaccurate statements were made by city
personnel. They alleged that the drainage channels are no longer needed and that no water flows through them.
Our pictures and the fact that two properties were flooded in August of 2013 shows that to be false. They
stated that no water enters from Bighorn and our neighbor who backs up to the Bighorn holes in the wall has
said that he has seen water coming through the openings from Bighorn into our channel during rainstorms.
They tried to paint the picture of the drainage channels as some separate system but the Summit drainage plan
is one interconnected system and all of its easements were all signed off on and approved by City staff and the
City Council and are still included in City and County documents.
8. We feel strongly that the safety of our families and our property will be put at risk if the City of Palm Desert
abandons its responsibilities to the homeowners in the Summit development. We know you have already seen
the 61 yellow slips of protest from some of our homeowners. Please do not allow the City of Palm Desert to
cherry pick a piece of the City's drainage system and abandon its responsibilities to maintain it. Thank you.

public hearing to consider accepting and rejecting certain offers of
dedication within the map of Tract 13008 (The Summit).
Backqround
In March 2014, Public Works staff was contacted by a couple who are residents in The
Summit area regarding the drainage channel and related easements in backyards in
The Summit. Their claim and concern was that the unmaintained backyard channel
near their property caused water from the severe August 2013 storm to enter their
driveway and garage. They also want the City to maintain the channel in perpetuity
because the recorded subdivision map for The Summit contains an offer of dedication to
the City of Palm Desert of easements for storm drain purposes at the locations where
the channel exists.
Unfortunately, in the map of Tract 13008, which recorded in 1979, all offers of
dedications to the City of Palm Desert for the streets and drainage easements were not
specifically accepted or rejected by the City as required by the California Government
Code, and there is no indication that the City accepted the easements by separate
action or document at any time after the map recorded. The Director of Public Works
visited the site and met the resident couple on July 9, 2014, and observed that much of
the backyard channel has been significantly compromised by the homeowners through
the installation of various landscape improvements and other obstructions. Significant

debris was also seen in the channel such as garden clippings and trash. In the
Director's opinion, there is very little chance of any flood damage to any home as the
channel exists today, and there was no evidence of erosion that would have existed if
water had flowed from the channel to the aforementioned couple's garage. The channel
was most likely designed and installed to protect the homes that directly abut the
channel, which was prior to the upstream development of the Canyons at Bighorn that
adjoins the southerly boundary of The Summit. The Canyons at Bighorn project
included a significant storm drain system that was designed to retain storm water on-
site for a 100-year storm, and also provides protection to The Summit. For that reason,
the Director's opinion is that The Summit channel is of very little use and unlikely to
convey significant storm flows.
Current and former Public Works staff have been consulted and only two occasions
have been identified when City staff performed emergency storm response, damage
assessment, and clean up in the 35 years that the backyard channel has been in
existence. On the other hand, City crews have routinely maintained the streets in The
Summit and the adjoining catch basins in the streets, and the downstream under
sidewalk drains (for water draining off of the streets) since the streets were originally
constructed.
Because the channel provides only limited protection to the abutting homes, and no
protection to other property, it provides no benefit to the public. The City Attorney has
weighed in on this subject and concurs with the Director of Public Works that the
backyard channel easement dedication should be rejected. Other reasons for the
rejection are the difficulty in accessing the entire length of the channel due to its location
in 22 separate backyards, the compromised nature of the facility due to property owner
actions, and the additional manpower and time to routinely maintain this channel.
Therefore, staff recommends that Council accept the dedication made in Tract 13008 of
all streets, and four outlet easements for storm drain purposes over Lots 16, 25, 30,
131, and 153 as shown on said map; but reject the dedication of the eight-foot wide
backyard easements to the City of Palm Desert for storm drain purposes. Also, as a
matter of compromising with The Summit homeowners, staff recommends accepting the
dedication of the two side yard easements for storm drain purposes shown over Lots 89
and 99 on said map. The easements are accessed easier because they adjoin public
streets. Acceptance of the easements means that City crews will maintain the
improvements within those easements on a regular schedule, in perpetuity, or until the
City and The Summit agree that City maintenance will cease.
Government Code Section 65402 requires, in part, that the Planning Commission report
to City Council that the subject rejection conforms to the adopted General Plan. At their
meeting of October 7, 2014, the Planning Commission, by minute motion, determined
that the subject rejection does conform to the General Plan.

DESERT, CALIFORNIA, INITIATING PROCEEDINGS TO ACCEPT AND
REJECT CERTAIN OFFERS OF DEDICATION WITHIN THE MAP OF
TRACT NO. 13008 (THE SUMMIT) M.B. 106/24-30, RIV. CO. REC.,
UNDER PROVISIONS OF DIVISION 9, PART 3, CHAPTER 3 OF THE
STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA,
AND FIXING A TIME AND PLACE FOR HEARING ALL PERSONS
INTERESTED IN OR OBJECTING TO THE PROPOSED ACCEPTANCE
AND REJECTION OF THE MAP DEDICATION
The City Council of the City of Palm Desert, California, does hereby
DETERMINE, ORDER AND RESOLVE as follows:

provisions of Division 9, Part 3, Chapter 3 of the Streets and Highways Code, to accept

That the hour of 4:00 p.m. on the 13t" day of November 2014 in the Council
Chamber, 73-510 Fred Waring Drive, Palm Desert, California, is hereby fixed as the
time and place of hearing all persons interested in or objecting to the proposed
acceptance and rejection of said map dedications; and
III.
That the City Clerk is hereby directed to publish a notice of said hearing in The
Desert Sun, a newspaper of general circulation, circulated in the City of Palm Desert,
California, twice, the first date of publication being two (2) weeks before the date of the
hearing, and the City officials of the City of Palm Desert are hereby instructed to post

Dear Mr. Wohlmuth,
I have just received information that the City of Palm Desert is considering
abandonment of the responsibility of cleaning, maintenance and repair of The
Summit drainage system. I am writing to you with the hope that you and the City
Council will not go forward with this plan. I purchased my home in The Summit in
2005 knowing that the City had been given an easement for the purpose of
maintaining the drainage system. That knowledge gave me a sense of security
regarding the possibility of flooding damage to my property.
I have lived in the Coachella Valley my entire life and am very aware of the torrential
downpours that can occur. Flooding becoming very serious in mere minutes. I have
witnessed many floods here in the desert, remembering very welt 1976 when my
parents were living in Silver Spur Ranch.
I know that the City of Palm Desert has done a tremendous amount of work to
correct flood control since then. Palm Desert is a wonderful place to live due to all of
the great improvements to the City over the years. Please do not abandon the
maintenance of our drainage system. I don't want to imagine what could happen if
the maintenance was left to our HOA. I know you will understand that it isn't always
easy for neighbors to agree on things or for everyone to follow the appropriate
guidelines to maintain an effective drainage system. I believe it could become a
nightmare sometime down the road and should be avoided.
Thank you very much for taking time to read this and for considering my thoughts. I
will appre�iate your help with having this removed from the City Council's agenda.

Re: A Proposal to abandon the drainage easement in the Summit development.
Dear Mr. Wohlmuth:
First, I want to commend you for the work you do on behalf of the City of Palm Desert.
It has been brought to my attention that the City of Palm Desert will be considering abandoning its drain-
age and maintenance responsibility in the Summit. As with many projects in the city we feel that the
drainage system requires the City of Palm Desert to have regulariy scheduled inspection, maintenance
and repair to protect the health and safety of our homes and families.
The resident's homes in the Summit are valued at approximately $1,000,000. We are mostly professional
individuais who are keen about local, state and national politics. We pay an inordinate amount of taxes to
the city for services. However, some services are more appropriately the responsibility of the city.
Personally, I have no objection to paying taxes when they are justified. However, in this matter, I believe
the city should respect your time-honored obligation.
The Summit has 156 homes - most with multiple persons living in the same domicile. Our association has
contacted you and we remain confident that your recommendation will include protecting not only Summit
residents, but all of your council's constituents from unfair practices.
