Parcel Map No. 36741.
Background
Parcel Map 36741 is located on the south side of Flagstone Lane, just west of Portola
Avenue. This map provides for the creation of one 3,222 square foot parcel out of the
Shadow Mountain Golf Course lot for an underground water well. The well is to be used
primarily by The Reserve Club for normal everyday irrigation needs. Shadow Mountain
would use the well as a secondary water supply. The tentative map was approved by
the Planning Commission on June 17, 2014, and will expire in June 2016.
No improvement bonds are required because there are no public improvements to be
constructed. However, a grading permit is to be issued for minor site improvements,
including a concrete vault for the well.
There were two points of discussion in regard to this Parcel Map. The site has been
designated as a local "Historic District" per PDMC Section 29.50.010. Secondly, the
site has a "Mills Act" contract as allowed per PDMC Section 29.70.030. Both points

were discussed with the City Attorney and it is their opinion that the Parcel Map will not
affect the current "Historic District" designation or the "Mills Act" contract that is
recorded against the current owners. Therefore, all the parcels (including the new
parcel) are bound by its conditions.
Those conditions of approval related to the map have been satisfied. This map
conforms to the requirements of the Subdivision Map Act and City ordinance, and it is
substantially the same as it appeared on the tentative map.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING PARCEL MAP
36741
BE IT HEREBY RESOLVED by the City Council of Palm Desert, as follows:
1. Parcel Map No. 36741 of City of Palm Desert, California, is hereby
approved as the official subdivision map of said parcel map, subject to
conditions of the Tentative Map.
2. The City Engineer is directed to process the Parcel Map for recording
upon receipt of the required payment of all fees.

CONDITIONS OF APPROVAL
CASE NO: TPM 36741
DEPARTMENT OF COMMUNITY DEVELOPMENT:
1. The development of the property shail conform substantially with exhibits on file with
the Department of Community Development/Planning, as modified by the following
conditions.
2. The development of the property described herein shall be subject to the restrictions
and limitations set forth herein, which are in addition to all municipal ordinances and
state and federal statutes now in force, or which hereafter may be in force.
3. Prior. to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Building & Safety Department
City Fire Marshal
Public Works Department
Evidence of said permit or clearance from the above agencies shall be presented to
the Department of Building & Safety at the time of issuance of a building permit for
the use contemplated herewith.
4. All conditions of approval shall be recorded with the Riverside County Clerk's office
before any building permits are issued. Evidence of recordation shall be submitted to
the Department of Community Development/Planning.
5. Applicant shall defend, indemnify and hold harmless the city against any third party
legal challenge to these approvals, with counsel chosen by the city at applicant's
expense.
6. Teniative Parcel Map 36741 shall be recorded within two years from the date of final
approval unless an extension of time is granted; otherwise said parcel map approval
shall become null, void and of no effect whatsoever.
7. Any proposed change to TPM 36741 will require an amendment, which will result in
a new public hearing.
DEPARTMENT OF PUBLIC WORKS:
8. The Parcel Map shall be submitted to the City Engineer for review and approval.
