REQUEST: AUTHORIZE THE AWARD OF A PROFESSIONAL SERVICES
AGREEMENT (CONTRACT NO. HA- 25760A ) TO VANIR
CONSTRUCTION MANAGEMENT, INC., IN THE AMOUNT OF $177,208
PLUS REIMBURSABLE EXPENSES OF $5,000 FOR CONSTRUCTION
MANAGEMENT SERVICES FOR THE CONSTRUCTION PHASE OF THE
LAGUNA PALMS REHABILITATION PROJECT

Recommendation:
By Minute Motion that the Agency Board authorize:
1. The award of a professional services agreement (Contract No. HA-25760A) to
Vanir Construction Management, Inc., in the amount of $177,208 plus
reimbursable expenses of $5,000 for construction management services for
exterior renovation and site improvements to be conducted at the Laguna Palms
Apartments;
2. Chairman to execute said document; and
3. The Finance Director to set aside the amount of $17,721 as a 10% contingency
(use of contingency requires additional action).
Funds are available in Account Number 871-8610-466-4001.
Executive Summary:
Approval of staffs recommendation will result .in the replacement of the existing consulting
construction management firm, Stantec Inc., for the Laguna Palms Rehabilitation Project with Vanir
Construction Management, Inc., for the remainder of the project. Stantec is unable to provide
sufficient qualified personnel to complete the project to the expectations of the Redevelopment
Agency. Rejection of staff's recommendation would result in the need to continue the services with
Stantec, or use staff resources or another consultant to perform the required services.

Discussion:
Staff's request to replace the current construction management firm, Stantec, is the result of the
inability of Stantec to provide the level of construction management services required under their
contract with the Redevelopment Agency. Stantec purchased The Keith Companies in 2005,
several months after The Keith Companies contracted to perform construction management
services on the Laguna Palms Rehabilitation Project. The key individual assigned to the project left
Stantec at the end of 2005, and Stantec has not been able to fully recover from this Toss during the
design, bidding, and utility undergrounding phases of the project. Nor does Stantec have available
the qualified personnel necessary to manage the project during the construction of the remaining
phases of the work. These phases include asbestos abatement, exterior and interior renovations,
landscaping, and civil improvements. Stantec agrees to the termination of their contract at this
point.
In order to identify an appropriate firm to complete the project, staff reached out to three qualified
construction management firms: Douglas E. Barnhart, Inc., Vanir Construction Management, Inc.,
and Harris & Associates. Each firm was asked to review the scope of work, their existing
commitments and available personnel, and the schedule under which the project is to be completed.
Barnhart was unable to respond to the request for proposals due to their current heavy workload.
However, both Vanir and Harris & Associates provided proposals for full construction management
services, and both were able to commit the appropriate qualified staffing to ensure the completion of
the project in accordance with the standards expected by the Redevelopment Agency.
Staff has reviewed the proposed staffing and pricing from each of the firms and recommends the
award of the contract for construction management services to Vanir Construction Management,
Inc., who not only will provide a Certified Construction Manager (CCM) as the lead, but also
proposed the lower cost. To staff's knowledge, this will be the first project in Palm Desert to be
managed by a CCM. Accordingly, staff requests that the Housing Authority award the subject
contract to Vanir Construction Management in the amount of $177,208 plus $5,000 for
reimbursables.
