Contract HA23650A Amendment No. 1 Continued from front This Professional Service Amendment covers changes to the subject contract as described herein. The consultant shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as Owner. Contract Time Extension -0- Days. Revised Contract Total $183,150.00 The undersigned Consultant approves the foregoing Professional Service Amendment # 1 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Professional Service Amendment # 1 . The Consultant agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Professional Service Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the Owner. Letter No.03 November 29, 2006 Lauri Aylaian Palm Desert Redevelopment Agency 73-510 Fred Waring Drive Palm Desert, CA 92260-2578 RE: City of Palm Desert California Villas Project Phase "A" Amendment #01 Dear Ms. Aylaian: Harris & Associates Program Managers Construction Managers Civil Engineers In accordance with our the terms of our Agreement, described below are the basis for my request to amend our contract budget amount for services performed beyond the original contract scope as follows; • Article # 1.0.02 - Construction Administrative Procedures: The construction administrative budget was based on the receipt of all prior project contract documents from the released construction management firm V2C. Upon repeated requests to Anthony Mendoza we did not receive any relevant project documentation related to; • Daily diary's, project status reports, correspondence, or progress construction schedules. This resulted in extended hours to assess prior contractual matters and issues to establish a detailed plan to adequately address with all team members. • The budget proposal was based on dealing with typical project team members, such as City, Contractor, and Architect. There were two other project entities not considered; Cal Villa staff and RPM Company that were involved that necessitated our immediate coordination. We had to generate detailed weekly schedules for Cal Villa staff/tenants and RPM for remediation coordination work. This was time-consuming effort that paid bid dividends — but was not in our original scope of services. • Article 1.0.05 — Change Order Preparation, Negotiation, and Processing: The initial budget proposed was based on reviewing existing Contractor requests for change orders. With no documentation from V2C, we had to spend an extreme amount of time to get all information from the Architect, Contractor, and City to adequately assess and negotiate very delinquent requests for change order not previously addressed to any degree by V2C. I was aware of this increase in scope in each instance but elected to defer sending piecemeal requests to better gauge how long the original budget would last for a more accurate Amendment #01 timeframe. Now that the project is in the 28th week (October) the current balance remaining will get us to the 32nd week (November) of our a 39 week proposed hourly budget. I make it a point to always meet my budgets, but the reality is that the information needed, and not provided, to promptly assess project conditions and contractor claims is the heart of the request to the extent that it more than doubled the construction manager's and administrative hourly effort. I strongly attest that we have provided the City Redevelopment Agency with outstanding services in providing a quality product and have realized City significant cost savings, given the conditions encountered by being proactive. I admit that I am remiss in providing this Amendment request earlier in strict accordance with our agreement, but believe the primary task was to restore order to this construction program.
