HA-25760 (PORTRAIT HOMES, INC.) IN THE AMOUNT OF $115,072.27 FOR SITE MODIFICATIONS AND EXTENDED GENERAL CONDITIONS FOR THE HOUSING AUTHORITY PROPERTY KNOWN AS LAGUNA PALMS MARTIN ALVAREZ, REDEVELOPMENT MANAGER PORTRAIT HOMES, INC. 265 N. JOY ST., STE. 200 CORONA, CA 92879 MARCH 27, 2008 CHANGE ORDER NO. 6 TO CONTRACT HA-25760 By Minute Motion, that the Housing Authority: 1. Approve Change Order No. 6 to Contract No. HA-25760 with Portrait Homes, Inc., in the cumulative amount of $115,072.27 for items not included in the original contract and extended general conditions; 2. Authorize the Chairman to execute the said documents; 3. Authorize the Finance Director to transfer $60,864.92 from contingency to base for Change Order No. 6; and 4. Appropriate $54,207.35 to base contract from unobligated housing funds. Executive Summary: The Laguna Palms rehabilitation project is substantially complete, with only minor punch list items remaining. Approval of staffs recommendation will authorize Change Order No. 6 in the amount of $115,072.27 to address minor site modifications not included on the plans and close out negotiations with Portrait Homes for extended general conditions (overhead & supervision) associated with project delay. The proposed modifications will finalize the project and improve the project's over-all quality. Attached please find a summary table with itemized costs: Staff Report Approve Change Order No. 6 to Contract No. HA-25760 — Laguna Palms Renovations Page 2 of 4 March 27, 2008 DESCRIPTION Concrete Work Cool deck application at pool, grounding of new deck, ADA transition at northeast corner of property ADA Pool Lift: Required by Building Department Drainage Modifications: Installation of drainage improvements to properly receive drainage from the southwest section of the property Block Wall Modifications: Remove and replace damaged section of west perimeter block wall Modifications to south wall (remove exposed footing and loose blocks) Extended General Conditions: [60 Days ($1,365/Day) Cumulative Total: Discussion: COST $9,900.00 10,000.00 $3,617.57 $4,050.20 $5,604.50 $81,900.00 $115,072.27 The 48-unit Laguna Palms is substantially complete with only minor punch list items remaining. Change Order No. 6 will close out Contract HA-25760. The proposed change order consists of minor site modifications and finalizes contract negotiations regarding extended general conditions for project delays associated with structural redesigns/modifications and the additional scope of work to improve project safety. Concrete Work / Site Modifications: The concrete surrounding the pool requires application of cool decking material. This material reduces the temperature of the deck surface and reduces slipping. In addition to the cool deck, the Building Department requires that we properly ground the new deck (eliminates transmission of electricity). The final item in this category includes minor concrete work associated with creating a new ADA transition (between street and new sidewalk) at northeast corner of property. The total cost to provide these improvements is $9,900.00. ADA Pool Lift: In an effort to enhance the accessibility of the pool for occupants with disabilities, the Building and Safety Department requires that we install an ADA pool lift that will allow individuals with a disability to access the pool. The cost for the lift is estimated at $10,000.00. After installation of final grading at this location, the Public Works Department required additional mitigation to properly handle drainage. The cost to implement this change totals $3,617.57. Block Wall Repairs / Modifications: The modifications under this category consist of repairs to a 15 linear foot section of the existing west perimeter wall, installation of a screen gate to conceal a utility box and the cleanup of an exposed footing area at the south perimeter wall. During site inspections, staff and the construction manager identified a large crack in the existing west perimeter wall. This was noticed prior to the contractor applying the final stucco coat. Staff believes that the damage may have been caused by the construction occurring on the adjacent parcel. The cost to repair this 15 linear foot section of wall is $4,050.00. Staff has contacted the adjacent property owner and is seeking reimbursement for this damage. In order to avoid delay on the stucco finish, staff requested that the contractor make the repairs. The second modification under this category consists of cleaning up of an exposed footing along the existing south perimeter wall and repairs to blocks to receive the stucco finish. This work will improve the aesthetics of the project and totals $5,604.50. Extended General Conditions: The Laguna Palms rehabilitation project under Contract HA-25760 was scheduled to be complete in September 2007. Due to unforeseen structural redesigns to both the single and two story structures, the addition of various new scopes such as a fire sprinkler system and new electrical wiring created impacts to the project's original completion date. The structural modifications were required by the Building and Safety Department and Engineer to comply with today's Code. The addition of a fire sprinkler system and new electrical wiring also required redesigns, but improved the project's safety. These items created impacts to the contractor's extended general conditions (overhead, supervision and administration). Although the approved change orders addressed the costs of these upgrades, the contractor's extended general conditions were not included. The Contractor has requested consideration of extended general conditions for the six- month delay. Staff and the Construction Manager believe that the Contractor should be given consideration for a maximum of 60 days for extended general conditions. This two -month acknowledgement for extended general conditions has been negotiated by our Construction Manager and totals $81,900. If the item is approved, the following conditions would apply: • Completion of all punch list items by March 28, 2008 (assess liquidated damages if project not complete). • Authorize legal counsel to draft an agreement containing language requiring a full and final release for all claims associated with Contract HA-25760. Staff and our Construction Manager have reviewed the proposed change order and recommend approval. On March 12, 2008, the Housing Commission reviewed this item and recommended approval. Therefore, staff is requesting approval of Change Order No. 6 in the amount of $115,072.27. The proposed change order will bring the project to completion. Staff recommends that the remaining $60,864.92 from contingency be transferred to the base contract, and an additional $54,207.35 be appropriated from unobligated housing funds.
