Recommendation:
By Minute Motion, that the Palm Desert Housing Authority:
1. Approve Contract Amendment No.1 with Harris & Associates in the
amount not -to -exceed $41,137 (Contract No. HA-23650B for additional
construction management services at Phase B of the California Villas
Rehabilitation Project;
2. Authorize Chairman to execute said documents.
Funds are available in Account No. 871-8680-466-4001.
Executive Summary:
Approval of the staff recommendation will authorize Contract Amendment No. 1 with Harris
& Associates to provide additional construction management services not included in the
original contract for the Phase B site improvement project at California Villas Apartments.
Rejection of staff's recommendation would reduce construction oversight controls and
could increase the Authority's exposure to construction -related claims.

Discussion:
In January of 2007, the Housing Authority approved a contract in the amount of
$140,240.00 with Harris & Associates for construction management services related to the
Phase B California Villas renovation project on California Drive.
Harris & Associates has been providing construction management services for the
$3,172,089.89 renovation project which includes, but not limited to, the following
improvements:
• Complete removal of all hardscape and replacement with new ADA accessible
paths of travel throughout the complex
• New shade parking structures and parking lot surfaces
• New irrigation system and plant palette that will bring the complex into full
compliance with water conservation ordinances
• New maintenance building
• Interior environmental clearances and renovations to 25 units
The proposed amendment will authorize additional professional services in the amount of
$41,137 required to properly manage the project through its completion. Although the
project is on schedule and is estimated to be complete in December 2008, additional
services will be required to cover the administration and coordination of the additional
scope added as part of Change Order No. 1. The additional construction management
services will address the following aspects of the project:
• Additional coordination required to address the additional environmental clearances
required for the interior renovations.
• Additional interior improvements to administration building
• Coordination of added drywells required to address on -site retention and the
National Pollutant Discharge Elimination System permit (NPDES).
• Professional services required to properly closeout the project, verify punch list and
compliance with all project specifications.
With the proposed contract amendment, Harris & Associates contract amount totals
$181,377.00, which represents 5 percent of the construction contract ($3,172,089.93). The
amended construction management contract is within industry standards for projects of this
size.

This Professional Service Amendment covers changes to the subject contract as described herein. The consultant
shall perform all work as necessary or required to complete the Professional Service Amendment items for a lump
sum price agreed upon between the Consultant and the Palm Desert Redevelopment Agency, otherwise referred to as
Owner.
Contract Time Extension -0- Days.

The undersigned Consultant approves the foregoing Professional Service Amendment # 1 as to the changes, if any,
in the contract price specified for each item including any and all supervision costs and other miscellaneous costs
relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on
account of said Professional Service Amendment # 1 . The Consultant agrees to furnish all labor and materials and
perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required
to complete the Professional Service Amendment items. This document will become a supplement of the contract and
all provisions will apply hereto. It is understood that the Contract Amendment shall be effective when approved by the
Owner.
Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that
fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or
equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown,
including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of
productivity, as well as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
