CALL TO ORDER Wade Tucker, Housing Commission Chair, convened the meeting at 3:30 p.m. II. ROLL CALL Present: Absent: Wade Tucker, Chair Jane Turner Natalie Russo Robert Nevares Others Present: Jean Benson, Councilmember Janet Moore, Director of Housing Jessica Gonzales, Management Analyst - Housing Teresa Vakili, RPM Company Patty Leon, Recording Secretary III. ORAL COMMUNICATIONS None IV. APPROVAL OF MINUTES MINUTES of the Regular Housing Commission meeting of June 13, 2012: Commissioner Natalie Russo moved, by Minute Motion, to approve the minutes of the June 13, 2012, meeting. Motion was seconded by Commissioner Jane Turner and passed 4-0. V. NEW BUSINESS A. PDHA LANDSCAPE CONTRACT 1 Housing Commission Minutes OCTOBER 10, 2012 Janet Moore summarized the staff report and stated that the lowest responsible bidder was Mariposa Landscape. She noted that Mariposa has been working on the properties since September 1st to bring the properties to its current required standards with an anticipated completion date of 30 to 60 days. The contract is a two-year contract. Commissioner Jane Turner moved, by Minute Motion, to receive and file the Palm Desert Housing Authority Board award of contract to Mariposa Landscapes, Inc. in the amount of $293,076 for annual landscape maintenance services at thirteen (13) Housing Authority Properties. Motion was seconded by Commissioner Natalie Russo and passed 4-0. B. 1st AMENDMENT TO THE DSUSD LEASE AGREEMENT Jessica Gonzales stated that a Head Start program is located within the One Quail Place apartment complex and is being leased to the Desert Sands Unified School District for the purpose of operating that program on site. Mr. Wade Tucker commented that he was not aware there was a Head Start at One Quail Place and felt it was a great program. He inquired on the hours of operation. Councilmember Jean Benson stated that most working parents live at the property which is convenient that the program is available. Commissioner Jane Turner moved, by Minute Motion, to receive and file the Palm Desert Housing Authority Board approved First Amendment to Lease Agreement between Desert Sands Unified School District and the Palm Desert Housing Authority for Head Start Program at One Quail Place. Motion was seconded by Commissioner Natalie Russo and passed 4-0. C. AMENDING AND RESTATING THE BYLAWS FOR THE PALM DESERT HOUSING AUTHORITY As previously mentioned at the last Housing Commission meeting, Janet Moore stated that the Housing Authority Bylaws were amended since they referenced the redevelopment agency and the Executive Director to the redevelopment agency in terms of responsibilities. The Bylaws relate to the City Council as the Board of the Housing Authority also known as the Housing Authority Commission (as required by the Law) which was confusing. For clarification 2 Housing Commission Minutes OCTOBER 10, 2012 purposes, staff was allowed to interchange Authority Commission to Housing Authority Board when referencing the City Council. Commissioner Natalie Russo moved, by Minute Motion, to receive and file the Palm Desert Housing Authority Board approval of Resolution no. HA- 46 amending and restating the Bylaws for the Palm Desert Housing Authority which were originally adopted by Resolution HA-1 on January 22, 2008. Motion was seconded by Commissioner Jane Turner and passed 4-0. D. APPOINTMENT OF THE CITY MANAGER AS EXECUTIVE DIRECTOR OF THE PALM DESERT HOUSING AUTHORITY Janet Moore stated that the Resolution amends the section that appoints the City Manager as Executive Director of the Palm Desert Housing Authority. Commissioner Natalie Russo moved, by Minute Motion, to receive and file the Palm Desert Housing Authority Board approval of Resolution No. 2012-63 amending Section 7 of Resolution No. 97-104 which established the Palm Desert Housing ("Authority") as it relates to the appointment of staff to the Authority. Motion was seconded by Commissioner Robert Nevares and passed 4-0. As previously discussed at the last meeting, Ms. Moore stated that staff is reviewing the responsibilities of the Housing Commission now that there will be a change in reviews of the new successor housing agency. The Successor Agency to the Palm Desert Redevelopment Agency ("SARDA") and the Housing Authority Boards will review the transfer and acceptance of assets at their meeting of October 13th. The Oversight Board of the Successor Agency directed the SARDA to transfer all housing assets to the Housing Authority. Once those assets are transferred staff will get a better idea of the responsibilities in terms of covenants on for -sale properties. The asset report filed with the State included such items as pencils, papers, maintenance items, etc. The State did not object to any of the assets listed. The Housing Commission bylaws are being reviewed to see if there needs to be any amendments. A suggestion was made to allow the option by the Chair of this Commission to elect to cancel a meeting due to lack of agenda items. Ms. Moore asked that if the Commission has any comments, concerns or questions related to the Housing Commission Bylaws to let her know. 3 Housing Commission Minutes OCTOBER 10, 2012 E. RPM COMPANY — AGREEMENT Janet Moore stated that there is no increase in fee from the previous contract. Upon question, Mrs. Moore stated that the initial contract fee in 1998 was $20 then increased to $25 and stopped at $35 five years ago. RPM is willing to hold the same per door cost for the next two years. Commissioner Natalie Russo moved, by Minute Motion, to forward a recommendation to the Housing Authority to authorize the approval of the Agreement for property management services between the Palm Desert Housing Authority and Ray, Douglas, Ann and Patrick, Inc. A.K.A. RPM Company. Motion was seconded by Commissioner Jane Turner and passed 4-0. VI. CONTINUED BUSINESS VI1. REPORTS AND REMARKS A. COMMISSION REPORTS Janet Moore provided a brief update on AB 1484 and Housing Asset List. AB 1484 was enacted late June of 2012. It placed certain timelines for reporting information to the State which included the Housing Asset List to which staff had a very limited time to prepare. A form was provided by the State that asked for a detail report of all the assets intended to transfer to the Housing Authority. 1484 allows cities to obtain what is known as a "Finding of Completion" once certain obligations are met that allows you to utilize bonds that the Redevelopment Agency ("Agency') had for the purpose of which they were intended. There are a significant number of projects that are outstanding such as the Carlos Ortega Villas project. Bond proceeds have been allocated for this project in the event the City is successful in obtaining a "Finding of Completion". Other outstanding projects from the Agency include parks, right-of-ways, and acquisitions for interchanges. The first possible date to receive a "Finding of Completion' from the State is April of 2013, after that we are asked to submit information to the State with respect to a "plan" of the properties owned by the Agency. The affordable housing properties include the expansion site of Las Serenas, the site next to Sagecrest Senior and Carlos Ortega Villas site were included in the asset list and were not objected to by the State. In addition, 1484 requires to provide a due diligence review of cash held by the Agency and Housing fund. The Oversight Board approved the review of the 4 Housing Commission Minutes OCTOBER 10, 2012 housing fund on Monday and the report was submitted to the State; the State has until November 9th to respond. The report indicated that there is no housing cash that can be remitted to the taxing entities. Ms. Moore also reported that the League of California Cities recently filed a lawsuit against 1484; concerned that the Department of Finance violated the administrative procedure law. Upon question of Carlos Ortega Villas, Janet Moore stated that the project is moving forward and is hoping to be able to fund the project by bond proceeds if we receive a "Finding of Completion". The project is very close to being able to submit an actual plan check. B. MONTHLY OCCUPANCY STATUS REPORT The Commission reviewed the Monthly Occupancy Status Report for May, June, July and August. Teresa Vakili reported that the properties are consistent and seven out of thirteen properties are 100% occupied. C. REPORT #1 — MONTHLY OCCUPANCY AND AVERAGE RENT STATEMENT FOR APRIL The Commission reviewed the Monthly Occupancy and Average Rent Statement for May, June, July and August. Upon discussion of income limits, Janet Moore stated that the State sets the income limits and the County distributes them and may differ from County to County. D. REPORT #2 — MONTHLY NET OPERATING INCOME STATEMENTS FOR APRIL The Commission reviewed the Monthly Net Operating Income Statements for May, June, July and August. E. HOUSING AUTHORITY PROPERTIES UPDATE The Commission reviewed the update for June, July, August and September. Teresa Vakili stated that the properties continue to maintain in good standards. 5 Housing Commission Minutes OCTOBER 10, 2012 Commissioner Jane Turner inquired on porter share day. Ms. Vakili stated that all six ground workers known as porters are assigned to one particular property to complete one week's worth of work; it has been very helpful to the properties. Ms. Vakili stated that besides the high number of service requests on a daily basis, there is other maintenance work on the actual grounds that need to be address to include light fixtures, laundry rooms, handrails, etc. She reiterated how helpful porter share day has been. Commissioner Robert Nevares stated that it is very difficult to have Catalina Gardens' maintenance crew at a different property because he is concerned that then nothing will get done at Catalina. Ms. Vakili stated that besides the porter share day, the maintenance staff at both properties do a great job and have received a lot of compliments from the tenants; Mr. Tucker agreed. In response to Councilmember Jean Benson's question, Ms. Vakili replied that the units have both smoke alarm and carbon monoxide detectors installed to comply with a new law that must be completed by December of 2012. Councilmember Jean Benson commented that there was a detector televised different than a normal smoke detector that would provide a warning a few seconds sooner. Ms. Vakili stated that the detectors installed have that ability as well. Commissioner Natalie Russo asked about the no smoking policy within the units. Ms. Vakili replied that at this time tenants are not restricted to smoke in their units or personal patios; however, a survey was completed of the number of tenants who do not smoke to consider designating non smoking buildings. Per City Ordinance, there are designated smoking areas in the pool areas. Mr. Nevares commented that there have been tenants smoking in front of the laundry rooms and walkways. Ms. Vakili replied that those areas are restricted and those tenants should only be smoking in their units or pool area. Ms. Vakili and Mr. Nevares will meet to discuss in further detail. At this time, Ms. Moore reported on the recent wind storm event. The damage to the properties with the exception of One Quail Place was limited to trees. With regard to One Quail Place, a tree fell on top of a carport that collapsed on top of four cars. The carport has been removed. 6 Housing Commission Minutes OCTOBER 10, 2012 Mr. Tucker stated that the wind storm was a natural disaster and therefore the City should not be monetarily responsible; noting he was an insurance adjuster for many years. Ms. Moore stated that those tenants, whose cars were damaged, among any other resident have the ability to file a claim with the City in the event they had a property losts. She further noted that the City is self -insured and is looking at various options to replace the carport with a different structure; however it might not look the same as the other carports. Commissioner Natalie Russo asked if a certain number of covered carports are required at the units. Ms. Moore replied that the properties assign one covered parking space per unit. With the recent wind storm, One Quail Place lost 6 covered parking spaces. F AGENCY HOME IMPROVEMENT PROGRAM UPDATE An update on the Home Improvement Program (HIP) was provided to the Commission for review. Janet Moore announced that the Program received a grant from CDBG monies for emergencies for very low income residents only. Most of the interested applicants do not have an emergency nature which are roof, AC and heating issues. Commissioner Jane Turner asked if staff was referring interested applicants to non-profit organizations. Ms. Moore replied that some of the non-profit organizations do not have any monies; however Southern California Edison and the Gas Company have senior programs even if they are not considered very low income households. IX. NEXT MEETING DATE — NOVEMBER 14, 2012 Commissioner Jane Turner moved, by Minute Motion, to approve to return the meeting date of Wednesday, November 7, 2012 to its regular meeting date of Wednesday, November 14, 2012.
