CALL TO ORDER Wade Tucker, Housing Commission Chair, convened the meeting at 3:30 p.m. II. ROLL CALL Present: Absent: Wade Tucker, Chair Jane Turner Natalie Russo Robert Nevares Others Present: Jean Benson, Councilmember John M. Wohlmuth, City Manager Janet Moore, Director of Housing Jessica Gonzales, Management Analyst - Housing Patty Leon, Recording Secretary III. ORAL COMMUNICATIONS Councilmember Liaison Jean Benson presented the Commissioners with gift certificates and thanked them for their dedication to the Housing Commission. IV. APPROVAL OF MINUTES MINUTES of the Regular Housing Commission meeting of November 14 2012: Commissioner Jane Turner moved, by Minute Motion, to approve the minutes of the November 14, 2012, meeting. Motion was seconded by Commissioner Natalie Russo and passed 4-0. 1 Housing Commission Minutes DECEMBER 12, 2012 V. NEW BUSINESS A. Citywide Tree Pruning Program Janet Moore summarized the staff report, stating that the Landscape Department was not successful in identifying a responsible bidder and therefore requested to reject the bids. The Landscape Department anticipates awarding a contract on January 24th. A staff report will be brought to this Commission at the next meeting after bids are open on January 8th, 2013. Commissioner Wade Tucker asked if the trees have been trimmed before. Mrs. Moore stated that the broad leaf trees are being trimmed earlier in the year as opposed to the summer schedule. Commissioner Natalie Russo moved, by Minute Motion to Receive and File the staff report requesting that the Housing Authority reject all bids for Contract No. C32330 for the 2013 Citywide Tree Pruning Program which also authorizes staff to re -bid the project. Motion was seconded by Commissioner Robert Nevares and passed 4-0. B. Affordable Housing Restriction and Lien Agreement Janet Moore summarized the draft agreement attached to the staff report and stated that the Agreement restricts a home as affordable. She noted that Falcon Crest and Desert Rose homeowners have similar restrictions placed on their homes. She explained how a Desert Rose homeowner who recently purchased a home outside the program is voluntarily asking that a covenant restriction be placed on their home in order to qualify for energy incentives. Commissioner Jane Turner asked if the existing covenants are with the Redevelopment Agency or the City. Ms. Moore responded that almost all the covenants are with the Redevelopment Agency except for the last few have been by the City of Palm Desert. Upon question, Mrs. Moore stated that by operation of Law based on ABIX 26 and AB1484 it automatically designated a housing successor. The City Council designated the Housing Authority as the successor housing agency to the Palm Desert Redevelopment Agency. She stated that we are waiting on the State Department of Finance to respond with respect to the covenants we have throughout the City of Palm Desert in the event we need to transfer to the Housing Authority. 2 Housing Commission Minutes DECEMBER 12, 2012 Commissioner Natalie Russo asked about removing the covenant from a home. Mrs. Moore stated that if a homeowner is interested in selling their property the successor housing agency has the first right of refusal to purchase the home. If the successor does not act on their right, based on the agreement, the homeowner may sell their home at market value and the covenant would be removed at that time. City Manager John Wohlmuth questioned why a homeowner would request to add a covenant on their home given the possibility of losing the opportunity to sell their home at market value. Mrs. Moore stated that in the case at Desert Rose, currently there are homes listed on the MLS at the sales price of the calculated resale price, it's even with market value. In most cases, homeowners want to increase the value of their home by adding solar systems. In the event homeowners want to sell their home over the calculated resale price, the covenant states that owners will pay 25% over the amount to the successor housing agency. Commissioner Jane Turner moved, by Minute Motion to forward the recommendation to the Housing Authority to authorize the Executive Director to enter into agreements to restrict the affordability of homes occupied by households of lower and moderate incomes (at the owner's request) for unrestricted units in Palm Desert including Desert Rose and Falcon Crest. Motion was seconded by Commissioner Natalie Russo and passed 4-0 C. Housing Commission Bylaws Janet Moore stated that the Bylaws have been reviewed by this Commission at the last meeting and highlighted the main changes that included the meeting schedule. Upon question, Mrs. Moore stated that there were only certain sections of the Redevelopment Law that were repealed which included the dissolution of Redevelopment Agencies. The Housing Authority Law was not repealed and is in full effect. Commissioner Jane Turner asked if staff had reviewed the possibility of changing the number of commissioners from 7 to 5. Mrs. Moore stated that the City Manager recommended waiting for the interview process in case there is interest to this Commission. She noted that the Housing Commission Bylaws do not establish the number of members to a committee/commission; it is an ordinance of the City. 3 Housing Commission Minutes DECEMBER 12, 2012 Commissioner Robert Nevares moved, by Minute Motion to Adopt Resolution No. HC-01 amending and restating the Bylaws for the Palm Desert Housing Commission approved by the Palm Desert Housing Authority on November 12, 2012 by Resolution HA-48. Motion was seconded by Commissioner Natalie Russo and passed 4-0. D. Election of Officers for the year 2013 Commissioner Wade Tucker moved, by Minute Motion, to nominate Robert Nevares for 2013 Commission Chair. Motion was seconded by Jane Turner and passed unanimously. Commissioner Wade Tucker moved, by Minute Motion, to nominate Natalie Russo for 2013 Commission Vice -Chair. Motion was seconded by Jane Turner and passed unanimously. VI. CONTINUED BUSINESS VII. REPORTS AND REMARKS A. COMMISSION REPORTS B. SUMMARY OF CITY COUNCIL, SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY, AND HOUSING AUTHORITY AGENDA ITEMS Jessica Gonzales summarized the memo provided to the Commission for review. C. MONTHLY OCCUPANCY STATUS REPORT The Commission reviewed the Monthly Occupancy Status Report for October. Janet Moore summarized the reports on behalf of Teresa Vakili's absence. D. REPORT #1 — MONTHLY OCCUPANCY AND AVERAGE RENT STATEMENT FOR OCTOBER The Commission reviewed the Monthly Occupancy and Average Rent Statement for October. 4 Housing Commission Minutes DECEMBER 12, 2012 Councilmember Liaison Jean Benson asked if there was a form the residents fill out to request work repairs to their units. Janet Moore responded that there is a form and may include painting of units as well. E. REPORT #2 — MONTHLY NET OPERATING INCOME STATEMENTS FOR OCTOBER The Commission reviewed the Monthly Net Operating Income Statements for October. F. HOUSING AUTHORITY PROPERTIES UPDATE The Commission reviewed the update for November Commissioner Robert Nevares stated that the landscape company is carrying out shrubbery behind Pueblos Apartments creating a safety issue on the pathways. He noted that buildings B, C and F are being affected by the shrubbery removal. Janet Moore stated RPM has instructed the Landscape Company to ensure the path of travel is safe at all times. If a resident has any concern they need to call RPM Company and/or the leasing office. Ms. Moore stated that the landscape company is slowly but surely working on trying to get the properties to standard conditions. Commissioner Jane Turner referenced the report and questioned the satellite dish at La Rocca Villas. Mrs. Moore stated that the Law states that residents are allowed to have satellites however the successor agency can dictate where to install them. One of the concerns is residents will install them over the condensing units which causes damage and improper air flow. Staff is trying to work with satellite companies for proper installations. She further noted that La Rocca Villas does not have a property manager on site to ensure companies are following directions. G. AGENCY HOME IMPROVEMENT PROGRAM UPDATE An update on the Home Improvement Program (HIP) was provided to the Commission for review. Janet Moore summarized the report, reiterated that the program received a grant in the amount of $75,000 for emergencies. There has been a significant amount of interest mostly with roof issues. The funds are available for very low and low income families only. 5 Housing Commission Minutes DECEMBER 12, 2012 IX. NEXT MEETING DATE — JANUARY 9, 2013 A. SCHEDULE OF HOUSING COMMISSION MEETING DATES FOR 2013 Referring to the 2013 meeting date memorandum, Janet Moore stated that in the past, the meeting of August has been canceled due to the cancelation of City Council meetings in the month of August. Commission suggested waiting to cancel the August meeting until June or July. X. ADJOURNMENT With Commission concurrence the meeting was adjourned at 4:00 p.m. to January 9, 2013. (t(±A -e°1k.)
