HomeMy WebLinkAboutREPORT - Health-Safety Code Sec 33433-c PALM DESERT HOUSING AUTHORITY STAFF REPORT REQUEST: RECEIVE AND FILE REPORT PURSUANT TO SECTION 33433(c) OF THE HEALTH AND SAFETY CODE SUBMITTED BY: Janet Moore, Director of Housing Jessica Gonzales, Management Analyst - Housing DATE: July 11, 2013 Recommendation By Minute Motion, that the Authority Board receive and file this report pursuant to Section 33433 (c) of the Health and Safety Code. Background Pursuant to its Resolution No. 03-34, adopted on April 10, 2003, the City Council authorized the former Palm Desert Redevelopment Agency (Agency) to sell small housing projects pursuant to Section 33433(c). On March 14, 2013, by its Resolution No. 2013-11, the City Council confirmed that the authorization of the former Agency to sell small housing projects pursuant to Health and Safety Code Section 33433(c) transferred to the Palm Desert Housing Authority (Authority) as the successor to the former Agency's housing functions and assets. When a property has sold or leased as a "small housing project", the Authority is required to file a report with the legislative body after the end of the fiscal year which discloses; (i) the name of the owner/purchaser of the property, (ii) the legal description or street address of the property, (iii) the date of the conveyance of the property, (iv) the restrictions posed by the agreement on the owner/purchaser of the property, and, (v) the date on which the public hearing was held on the conveyance of the property, pursuant to Section 33431(c) and 33431. The following properties were sold during the fiscal year 2012/2013 and meet the definition of a "small housing project" because the properties were sold to persons or households of low or moderate income. The Authority conveyed the properties pursuant to Health and Safety Code Section 33433(c). The properties were restricted by a Restrictive Agreement (also known as Unit Regulatory and Lien Agreement ("URLA") or Affordable Housing Restriction and Lien Agreement ("AHRLA")) which were recorded at the time of sale which limits, among other things, affordability, encumbrances, transfers and resales for a period of up to 45 years. Silva Date of Purchase: May 9, 2013 Sales Price: $131,960.00 URLA: Recorded on May 9, 2013 as Instrument #2013-0221218; Covenant Expiration: May 9, 2058 Falcon Crest Development: 74537 King Fisher Circle (APN 624-441-007) Public Hearing: February 14, 2013 Owner/Purchaser: Terence J. Gillespie Date of Purchase: May 15, 2013 Sales Price: $225,000.00 AHRLA: Recorded on May 15, 2013 as Instrument #2013-0231101; Covenant Expiration: May 15, 2056 The Authority currently owns 15 properties (12 in Falcon Crest and 3 in Desert Rose). The Authority is also in negotiations on 5 additional properties in the two developments. Staff recommends that the Authority Board receive and file this report pursuant to Health and Safety Code Section 33433(c). Fiscal Analysis There is no fiscal impact to the Authority to receive and file this report.
