Recommendation
By Minute Motion, that the Housing Authority Board, approve Amendment No. 1
to Contract No. HA-33480 with Liberty Landscape, Inc. increasing the annual not-
to-exceed extra work amount from $29,300 to $58,600 for landscape
maintenance extra work at the Authority's rental properties. (This amount is
equal to 20% of the annual contract amount.)
Monies have been included in the FY 2014/2015 proposed Palm Desert Housing
Authority's operating budget, in the appropriate Authority accounts.
Housinq Commission Recommendation
The Housing Commission reviewed the recommendation at its regular meeting of
December 10, 2014. Staff will provide a verbal report upon request.
Executive Summary
Authorizing an increase in the amount allocated for extra work will allow Liberty
Landscape ("Liberty") to correct issues that existed prior to taking over the contract in
July of 2014. The work to be done includes relocating sprinklers, valves, removal of
non-drought tolerant plants as well as removal of turf in areas that provide no benefit to
tenants but instead causes deterioration of hardscapes from water overspray. Any
qualifying turf removal will be submitted to CVWD as part of their "Landscape Water
Management Program".

Backqround
In June 2014, the Authority Board approved a contract with Liberty Landscape, Inc. in
the annual amount of $293,004 with an additional amount for `extra work' not to exceed
10% of the annual contract (or $29,300) for the Authority's rental properties. Liberty
began work on the Authority's rental properties on July 1, 2014 and has steadily been
addressing concerns that existed prior to taking over the contract (extra work).
It has become clear that more work is needed to correct issues that have been lingering
since the elimination of RDA such as relocating sprinklers, valves, removal of water
thirsty plants/turf as well as removal of turf in areas that provides no benefit to tenants
but instead causes deterioration of hardscapes and other hazards.
One problem area in particular at Neighbors Apartments has already gone through the
approval process with CVWD for turf removal. CVWD has agreed to rebate the
Authority up to $1.00 per sq. ft. for the turf removal of approximately 11,950 sq. ft. but
the work must be completed within 90 days of CVWD's approval dated November 14,
2014. To take advantage of the rebates from CVWD we will complete the work from the
allocated extra work amount already approved with the contract. The cost for this work
that includes removal of turF and replacement of drought tolerant plantings and irrigation
is $27,236. All work will be completed at the contract approved rates for `extra work'.
Without this increase, other extra work will have to be postponed until July 2015. Staff
therefore recommends increasing the extra work portion of the contract by an additional
10% of the annual contract, in the amount of $29,300. This will make the total annual
extra work amount for the contract equal to 20% or $58,600.
Fiscal Analvsis
The fiscal impact of this increase is the additional 10% (or $29,300) for the extra work
not to exceed a total of$58,600 annually.

This Contract Amendment covers changes to the subject contract as described herein. The consultant shall perform
all work as necessary or required to complete the Contract Amendment items for a lump sum price agreed upon
between the Consultant and the City of Palm Desert, otherwise referred to as Owner.
Contract Time Extension -0- Days.
Revised Contract Total $293,004 with an additional 20% of the annual contract amount for extra work not-to-exceed
$58,600 annuallv.
The undersigned Consultant approves the foregoing Contract Amendment # 1 as to the changes, if any, in the
contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to
the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Contract Amendment # 1. The Consultant agrees to furnish all labor and materials and perform all other necessary
work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Contract
Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is
understood that the Contract Amendment shall be effective when approved by the Owner.
Execution of this Contract Amendment by the Consultant constitutes a binding accord and satisfaction that fully
satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity,
arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not
limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and Ioss of productivity, as well
as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.

properry o�vner. . Each project must be submitted on a separate application form. To bc cligible for the Program, a residential
property o�wier,HOA,or conunercial property owner must meet the following conditions:
I) Be a customer of CVVJD in good standing. If applicant lives within an HOA, �+�rilten approval fiom the HOA must be
attached to this application;
2) O��m thc properq•at the desi�natcd site,
3) Have a fully functioning irrigation system run b� a working irrigation timer/clock and an actively growing,sprinkler-irrigated
Iurf lawn;
�) Complete the landscape project��ithin 90 days from the date of�+�ritten C\'1'�'U application approval.
CVWD shall revie�r the application and provide HriUen approval of acceptance inro the program If the project qualifies for the
Program.the applicant shall do thc followin�:
I) Develop and submn a landscape design to CV11'D and!or appropriate governing bodies for revieti and approval;
2) Declare t�-pe and le��el of pai�ticipation in the program(see program participation section belou);
3) Install netiv desert-friendly landscape, 24-incl� bufCrr area, and/or sprinkler replacement per CVb1'D approved landscape
design or criteria;
4) Provide a smart irrigation coiitroller for all retro-fitted landscapes (including sprinkler replacement): applicant ma}�
participate in C\'WD's smart controller proaram to obtain a nr�� smart irrigation conu•oller.
